Do you need a building permit in Eureka Springs, Arkansas?

Yes, for almost any change to a property inside city limits. A building permit must be obtained from the Building Inspector whenever a structure or building is erected, improved, moved or structurally altered, and the code expressly extends the requirement to painting, fencing, sidewalks, driveways, permanent walkways and retaining walls.1 The city has adopted the International Building Code, excluding Appendix Chapter B.9

New residential and new commercial work must be inspected before a certificate of occupancy is issued, and a re-inspection costs $50 per site visit.10 The city says building permits are issued or denied within 10 business days after the application is filed, so build that into your schedule.11

Arkansas exempts an owner-builder from contractor licensing only. That exemption does not remove separate building permit, inspection, fire-code or zoning requirements.8

Who issues building permits in Eureka Springs, and how do you reach them?

The City of Eureka Springs Building and Safety office issues sign, building, plumbing, gas plumbing, electrical, mechanical, tree-cut and certificate of occupancy permits.11 Call 479-363-5187; the office is at 3174 E Van Buren. Applications are available at the Building Inspector's office during regular business hours, and inspections are scheduled by appointment at least 24 hours in advance.11

The city's general number at City Hall, 44 South Main Street, is 479-253-9703.12

Inside the city, the city issues building permits and sets zoning, and the Building Inspector regulates septic tanks as well.3 A septic system also falls under Arkansas Department of Health rules, so ask the Building Inspector which state approvals apply.13

Does Eureka Springs have zoning, and what does it mean for height and use?

Yes. Eureka Springs adopts and administers Title 14 zoning, and the city is divided into zones or districts with their own use, dimensional, historic-district and conditional-use rules.2

In the Agricultural district and in R-2 Contemporary Residential, buildings may be no more than 35 feet above primary street frontage and no more than 2.5 stories visible from it.56

Short-term rentals are tightly restricted in residential districts. In R-1 Victorian Residential, weekly rentals are limited to those that existed before July 2013, and in R-2 tourist lodging requires a Conditional Use Permit.1415

We could not confirm minimum dwelling sizes, lot-coverage percentages or an agricultural exemption from city permits. Arkansas law requires municipalities to allow at least one accessory dwelling unit by right on a single-family lot, but we did not find Eureka Springs's own ADU provision, so ask the city before you plan one.16

How do septic permits work in Eureka Springs, Arkansas?

Inside the city, the Building Inspector is the inspector for septic tanks, and a tank must conform to the recommendations of the state board of health.3 Statewide rules also require a permit for construction before building and a permit for operation after inspection and approval.13 Contact the Arkansas Department of Health's onsite wastewater program at 501-661-2171 for the state side.17

Public sewer comes first. When a city sanitary sewer is in the street, alley or right-of-way within 500 feet of the property line, connection is required within 90 days after official notice, at the owner's expense.7 A private system must connect within 90 days once public sewer becomes available, except for owners discharging under a valid NPDES permit.18

Soils are a constraint here: only about 1.9% of soils in Carroll County rate as not very limited for a conventional drain field, so expect a site evaluation and possibly an engineered system.19

Can you live in an RV or tiny home on your land in Eureka Springs?

Only briefly. It is unlawful to camp on private property, or to sleep in or use a vehicle for habitation on private property, for more than seven days per year inside the city.4 On public property, camping is prohibited unless the property is a designated public campground or a special overnight police permit is provided.20

So an RV cannot serve as a long-term home or construction-period home on a city lot. Other zoning and building-code requirements may also apply.4

We found no provision that specifically addresses tiny homes, so a tiny home is likely treated as a regular dwelling that needs a building permit and must meet zoning and sewer rules. Confirm with the Building Inspector at 479-363-5187 before buying or building.11

Building a home in Eureka Springs: the steps, in order

  1. Confirm the lot's zoning district and any historic-district rules with the city.2
  2. Check whether a city sewer is within 500 feet of the property line.7
  3. If you need a septic tank, work with the Building Inspector and the Arkansas Department of Health before building.317
  4. If your driveway meets a state highway, get an Arkansas Department of Transportation permit as well as any city requirements.21
  5. Apply for the building permit at the Building Inspector's office and allow up to 10 business days for a decision.11
  6. Schedule inspections at least 24 hours ahead, and finish with the inspection that precedes the certificate of occupancy.1110

What to check before you buy land in Eureka Springs, Arkansas

Confirm the parcel is inside the city limits; city building permits and zoning apply only there, and Carroll County appears to have no county-wide zoning for unincorporated land.22

Check the flood map. New construction and substantial improvements in special flood-hazard areas must have the lowest residential floor, including basement, elevated to or above base flood elevation.23

Ask about driveways. Installing or repairing a driveway needs a building permit inside the city.24
