Barbour County, West Virginia

Zoning, building permits and septic rules in Philippi, West Virginia

The City of Philippi, in Barbour County, West Virginia, runs its own zoning code and its own floodplain building permits through a city Permit Officer12. Parking a trailer you will sleep in needs a permit from the City Clerk3. Septic tanks are barred on any lot the city sewer already serves4; elsewhere, septic permits come from the Barbour County Health Department5.

Does Philippi, West Virginia have zoning?

Yes. Philippi has a city zoning code that defines districts and sets coverage, setback, height and yard rules1. Barbour County itself has no zoning ordinance on its published list, so the city code is the one that matters inside city limits9.

The district we reviewed is HR-O. There, minimum lot area is 3,000 square feet per unit and 7,200 square feet in total6, and buildings may cover at most 30% of the lot10. A principal building needs a 30-foot rear yard and 10-foot side yards, and the front yard is 20 inches or the setback of the neighboring buildings11. The main building tops out at 35 feet and an accessory building at 15 feet7. These figures come from an ordinance passed in 1995 and apply only in HR-O; we did not list every other district, so ask the City Clerk which district a parcel is in.

Do you need a building permit in Philippi, and who issues it?

Inside Philippi, building permits come from the city, not from Barbour County. The county states that development within Junior, Philippi or Belington requires permitting through that municipality12. The county Development Permit applies only outside those municipalities.

The city code makes it unlawful to build, substantially improve or place a structure, manufactured homes included, in the floodplain without a permit from the city's Permit Officer2. Where land is subdivided or otherwise developed, a site plan must also be approved by the Permit Officer first13. The city's fee schedule starts at $5 for work estimated at up to $50, then $10 up to $500 and $20 up to $1,000, with a per-dollar rate above that14.

Whether a house outside the floodplain needs a building permit, and which technical building code the city enforces, we could not confirm. Call the City Clerk before you start. West Virginia has no statewide building-code requirement; adoption is left to each local government15.

How do septic permits work inside Philippi?

Inside Philippi, the first question is whether the city sewer reaches the lot. City code bars privies, septic tanks, cesspools and similar facilities on any property presently served by a city sanitary sewer, with exceptions that the code spells out elsewhere4.

If the city sewer does not serve a lot, septic is possible, but we could not confirm who inspects it inside city limits. For Barbour County, the Barbour County Health Department's Environmental Health Division regulates and inspects septic systems and issues septic permits1617. State law requires a written permit before any septic system is installed18. Wells need a permit from the local health department before drilling19. Call the health department before you buy a lot that is not on city sewer.

Can you live in an RV or trailer in Philippi?

Only with a permit. Philippi's code says no person may park a trailer for human occupancy within city limits without first securing a permit, and the City Clerk issues it3. The application and fee follow the building-permit process.

No permit is granted for a trailer on a lot that already has a residence or another mobile home, unless the applicant shows a demonstrable hardship other than financial, such as caring for a close relative who cannot care for themselves. Hardship permits last six months and renewal means reapplying3.

We did not find a Philippi rule on tiny homes or temporary camping, so ask the City Clerk. West Virginia law says a municipality may not prohibit at least one accessory dwelling unit on a lot with a single-family house, under ordinances in effect on or after January 1, 202720.

Building a home in Philippi: the steps, in order

  1. Call the City Clerk at 304-457-3700 to confirm the zoning district, setbacks and whether your project needs a city permit21.
  2. Check whether the lot is in the floodplain; if so, apply to the city Permit Officer before any development2.
  3. Confirm sewer service. If the city sewer serves the lot, you must connect rather than install a septic tank4.
  4. If the lot is not on sewer, contact the Barbour County Health Department for septic and well permits17.
  5. If the driveway meets a state road, get a free permit from the Division of Highways22.
  6. Disturbing one acre or more requires a state stormwater construction permit23.
  7. Owners may do their own work without a contractor license, but that does not waive any permit or inspection8.

What stays with Barbour County, and what to check before you buy

Land outside city limits is a different case. Unincorporated Barbour County requires a Development Permit from the County Floodplain Coordinator for new construction, with a residential application fee of $7524. For rules outside the city, see the Barbour County page.

County-level numbers help set expectations: Barbour County's effective property tax rate is 0.4%, with a median bill of $538 a year2526. Only about 0.8% of county soils rate as not limited for a conventional septic drain field, so expect a site evaluation or an engineered system on lots without sewer27.

Watch-outs

  • We could not confirm which building-code edition the City of Philippi enforces or whether a house outside the floodplain needs a city building permit; ask the City Clerk before buying or building2.
  • We could not confirm who issues septic permits for lots inside Philippi city limits; ask the Barbour County Health Department before you rely on a septic system5.
  • The HR-O dimensions here come from a 1995 ordinance and apply only to that district; other districts may differ6.
