Do you need a building permit in the Village of Lake Delton, WI?

Lake Delton requires a building permit from the Building Inspector before erecting, enlarging, moving, altering, converting, changing the use of or demolishing a building or structure.1 Non-electrical maintenance and upkeep repairs costing no more than $2,000 are exempt, and the Building Inspector may waive a permit for insignificant alterations or normal-maintenance equipment replacement.1 Ask the Village Building Inspection/Zoning Office to classify the proposed work before relying on an exemption.4

Lake Delton’s building code covers new construction, repairs, remodeling and use changes, while incorporating applicable Wisconsin administrative codes.11 An owner who occupies or will occupy the home can obtain the Wisconsin UDC construction and erosion-control permits without Dwelling Contractor certification; that allowance does not eliminate the building permit.9

Who issues building permits in the Village of Lake Delton?

The Village Building Inspection/Zoning Office is the starting point for Lake Delton residential and commercial building applications.4 Use the Village building application page to reach the application links and arrange an appointment, because the department has no set hours.4 Call 608-254-2558 Option 2 to schedule the appointment.4

Commercial plans should go to the Village for preliminary development review before other approvals.12 Wisconsin DSPS approval does not constitute Village zoning approval, so a commercial project needs its local zoning determination as well as the applicable building-code review.4 Conditional-use applications carry a non-refundable $450 fee; preliminary and final development-review applications cost $250 and $500 respectively.12 Those are application-specific fees, rather than a universal home-building permit price.12

Does the Village of Lake Delton have zoning, lot-size and setback rules?

Lake Delton has Village zoning, including Agricultural, R-1 Single-Family Residential, R-3 Mobile Home and C-1 Commercial districts; these examples are not a complete district list.25 In R-1, permitted uses require a 6,000-square-foot lot and 60-foot average width; conditional uses require 10,000 square feet and 75-foot width.7 The Agricultural district requires 5 acres per family.8

For R-1 permitted uses, principal buildings have a 20-foot front setback and 20-foot rear setback, with potentially stricter state requirements along certain state highways.13 Principal-building side setbacks are 6 feet on each side for pre-existing lots no wider than 66 feet; otherwise the requirement is 8 feet on one side and 20 feet total.13 R-1 accessory buildings require 4-foot side and rear setbacks.13 Across Village districts, at least 10% of the lot must be landscaped, pervious area maintained in vegetation; vehicle-use gravel is counted as impervious area.14

How do septic permits work inside the Village of Lake Delton?

Sauk County administers private onsite wastewater treatment systems throughout the county, including Lake Delton, except where Wisconsin statutes provide otherwise.3 A new home using a private septic system cannot receive its building permit until the sanitary permit has been issued.15 Submit the county sanitary application through OpenGov, and ask Sauk County Land Resources and Environment about system approval.1617

Sauk County lists a permit review period of 7–10 days; that review period should not be treated as the whole design-and-installation timeline.17 Countywide, only 3.2% of soils are rated not limited for a conventional septic drain field, a strict rating that supports getting a site evaluation rather than assuming septic is impossible.18 Wisconsin requires private septic systems to be visually inspected at least every 3 years.19

Can you live in an RV or tiny home in the Village of Lake Delton?

We could not confirm permission to occupy an RV as a residence in Lake Delton; ask the Village Building Inspection/Zoning Office about the proposed address and duration before buying an RV for housing.4 Lake Delton’s residential parking rules restrict RV and trailer parking by yard, length, paving, setbacks and livability space, so parking approval alone does not establish residential occupancy approval.20 The general building-code scope excludes recreational vehicles and mobile homes, but does not exempt their on-site additions.11

For a small dwelling in R-1, the Village requires at least 720 square feet of floor area per family for permitted and conditional uses.6 We could not confirm a distinct tiny-home or accessory-dwelling occupancy rule; ask the Village office to determine the proposed use and district requirements.4 A newly erected building requires a certificate of occupancy before use.10

Building a home in the Village of Lake Delton: what comes first?

  1. Take the proposed use, lot dimensions and site layout to the Village Building Inspection/Zoning Office; district-specific lot and setback standards determine the available building footprint.47813
  2. If the home will use private septic, obtain Sauk County sanitary approval before the Village building permit can be issued.315
  3. Submit the Village building application and required plans, and begin construction only after the applicable plans are approved and the building permit is issued and posted.1215
  4. Obtain the residential driveway or parking-pad permit before work; Lake Delton requires driveways to be paved within 1 year of construction.20 A connection to a state highway also requires WisDOT approval.21
  5. Arrange required inspections before covering electrical, plumbing, HVAC or structural work, and secure the Village certificate of occupancy before moving in.2210

What should you check before buying land in the Village of Lake Delton?

Ask the Village Building Inspection/Zoning Office to confirm the parcel’s zoning district and whether the proposed home, accessory dwelling or rental use fits the local approval process.4 We could not confirm the Village’s current short-term-rental operating restrictions; Wisconsin separately requires a DATCP lodging permit for facilities rented to tourists or transients.423

For a private well, Wisconsin generally requires a Well Construction Notification Number before construction and a construction report within 30 days afterward, with separate approval requirements for high-capacity wells.24 Ask the Village office about floodplain requirements before committing to a site layout: Wisconsin floodplain rules can restrict structures, wells and sewage systems in floodways.425 For land outside Village limits, use the Sauk County guide to identify the applicable county or town zoning authority; county zoning is not administered for every municipality.26

Watch-outs

  • Lake Delton requires completed building and applicable fire inspections before final occupancy; a temporary occupancy certificate is possible only under the Village’s stated safety conditions.2210
  • We could not confirm a general agricultural exemption from Lake Delton building or zoning requirements; ask the Village Building Inspection/Zoning Office before planning a barn or farm structure.4
  • Lake Delton’s owner-performed plumbing provision concerns a home the owner owns and occupies, requires a permit and inspection fees, and remains subject to state code.27
