Do you need a building permit in the Village of Rochester, Wisconsin?
Yes. Inside the Village of Rochester, no owner or contractor may start construction of a building, or a mechanical, electrical or plumbing system, before obtaining a valid permit1. New buildings, decks, detached accessory buildings, additions, re-roofing, re-siding and new or remodeled electrical, HVAC and plumbing work all need permits, while minor interior finishing and minor repairs the Building Inspector deems minor are excepted1.
A new one- or two-family home also needs a permit under Wisconsin's Uniform Dwelling Code8. The state lets an owner who occupies, or will occupy, the home take out the construction and erosion-control permits without a certified dwelling contractor7. That does not waive the permit or inspections. We could not confirm that the village offers any separate owner-builder exemption from its own permit rules, so ask the Building Inspector.
Who issues building permits in the Village of Rochester, and how do you reach them?
The village's own Building Inspector issues building permits and performs structural, electrical, plumbing and HVAC inspections inside Rochester2. Call (262) 424-6957 before starting work on a home2. Application forms are available from the Building Inspector or the Clerk-Treasurer's office, and the same page lists a driveway permit application2.
New one- and two-family homes are applied for through the state's online building permit system9. Required inspections are footings, foundation, rough, insulation and final10. Permit fees are set by the village; the occupancy permit fee is set by the Village Board and paid before the occupancy permit is issued11. The village adopts Wisconsin's dwelling, plumbing, electrical and stormwater rules by reference12.
Does the Village of Rochester have zoning, and what does it mean for lot size and setbacks?
Yes. The village has its own zoning administrator, who answers questions on minimum lot sizes, setbacks and floodplain requirements3. County zoning does not cover the village; Racine County's zoning permits are for unincorporated townships13.
In the R-1 Single-Family Residential District, lots need at least 12,000 sq ft and 90 ft of width6. Setbacks in R-1 are 40 ft from the street, 8 ft on one side with 20 ft total on both sides, and the greater of 25 ft or 20% of lot depth at the rear14. R-2 uses a 25 ft street setback with the same side and rear rules15. Minimum dwelling size in both R-1 and R-2 is 1,200 sq ft for one story and 1,700 sq ft for multi-story, without garage516. Conventional subdivisions are capped at 35 percent lot coverage including buildings and other impervious surfaces17.
How do septic permits work in the Village of Rochester?
Racine County Development Services issues septic (POWTS sanitary) permits for the entire county, and a sanitary permit must come before a building permit for a new dwelling on an unsewered parcel4. Phone 262-886-844018.
Inside the village, a septic system is allowed only where the village code does not require connection to public sanitary sewer, and it must be designed under Wisconsin Administrative Code chapter SPS 38319. Where public sewer can reasonably be extended to a proposed subdivision, the village makes that extension a condition of approval20. A subdivision plat that relies on septic systems and private wells needs lots of at least 40,000 sq ft and 150 ft wide19. For a subdivision without public sewer, request a village exemption letter before applying to the county20. Wisconsin also requires a visual septic inspection at least once every 3 years21.
Can you live in an RV or tiny home in the Village of Rochester?
We could not confirm a village rule for living in an RV, camping on private land, or occupying a tiny home or individual manufactured home inside Rochester. The village adopts Wisconsin's camping-unit rules by reference12, but that is not a private-land occupancy rule. Ask the Zoning Administrator at (262) 399-3346 before buying a lot for this purpose3. Racine County's RV limits in floodplain areas are county rules for its own floodplain ordinance, not a village rule22.
Building a home in the Village of Rochester: the steps, in order
- Call the Zoning Administrator to confirm the district, lot size, setbacks and any floodplain limits3.
- If the parcel is not on public sewer, ask Racine County Development Services for a septic sanitary permit; the county requires it before a building permit on an unsewered parcel4.
- For a private well, Wisconsin requires a DNR notification number before construction23.
- Apply for the building permit through the Building Inspector; new homes go through the state's online permit system92.
- Call for inspections of each phase before covering the work24.
- Take occupancy after a final inspection with no major health or safety violations25.
What stays with Racine County, and what to check before you buy in Rochester
Septic permits stay with Racine County Development Services4. Land outside village limits is a different question; see the Racine County page for rules on unincorporated land.
Before buying, confirm floodplain status, since the village zoning code has floodplain districts3 and in a floodway Wisconsin prohibits new structures and sewage systems26. A driveway onto a state highway needs a WisDOT connection permit27. Racine County's effective property tax rate is 1.7% with a median bill of $4,071 a year2829. Soils matter too: only 2.3% of Racine County soils rate as not limited for a conventional drain field, so expect a site evaluation or an engineered system30.
Watch-outs
- We could not confirm village rules for private wells, floodplain development standards, short-term rentals or agricultural exemptions inside Rochester; ask the Zoning Administrator at (262) 399-33463.
- Racine County's zoning permits cover unincorporated townships, not the village, so the county planning counter is the wrong stop for building permits or zoning inside Rochester13.
- A building permit for a new home on a septic system cannot be issued until the sanitary permit exists31.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
