Do you need a building permit in the Town of Whitingham, Vermont?

Yes. Whitingham requires a Town zoning permit before land or building development begins or a structure is used, extended or occupied.1 An accessory structure smaller than 120 square feet is exempt from the zoning permit, but it must still meet the district setbacks.1 The Town's permit page also identifies permits for expanding a dwelling footprint, new structures over 120 square feet, subdivisions, changes of use, demolition, signs and fences over 4.5 feet tall.11

The municipal zoning permit is not the whole approval picture. Covered residential construction must address Vermont Residential Building Energy Standards, while owner-occupied single-family homes are generally excluded from the state public-building code unless their use brings them within that law.1213 The owner-builder exception is limited to state energy standards and does not waive Whitingham zoning approval or state wastewater requirements.10

Who issues zoning permits in the Town of Whitingham?

The Town of Whitingham Zoning Administrator is the local contact for zoning questions and zoning-permit applications at (802) 368-7500 or [email protected].14 The office is at 2948 VT Route 100 in Jacksonville.14

A complete application must include the required information and fee, proof that wastewater and potable-water permits have been applied for, applicable local approvals, and satisfaction of relevant state-agency stipulations.15 The published single-family building fee is $100 plus $0.05 per square foot, and every application carries a $30 recording fee.16 The Zoning Administrator has 30 days after receiving the application, payment and necessary data to issue, deny or refer it; failure to act makes the permit deemed issued on day 31.15 We could not confirm a general residential inspection or certificate-of-occupancy procedure, so ask the Zoning Administrator what closes out the specific project.

Does the Town of Whitingham have zoning?

Yes. Whitingham has municipal zoning, and its map and bylaw establish Conservation, Rural Lands, Rural Residential and Village districts.25 The parcel's mapped district matters because permitted uses and dimensions vary. In the Rural Lands District, a single-family residential lot has a 3-acre minimum, while other provisions for existing lots and waivers may affect a particular parcel.17

Rural Lands District development has a 65-foot minimum setback from the center of the traveled way or road right-of-way, 40 feet from the next property line and 125 feet from a lake.18 Buildings in that district have a 35-foot height limit, and maximum lot coverage is 10%.1920 Do not apply those Rural Lands figures to a parcel in another district; ask the Zoning Administrator to confirm the map designation, overlays and any nonconforming-lot or waiver provisions.

How do septic permits work inside Whitingham?

Vermont regulates septic and potable-water systems inside Whitingham. A state permit is required for a new water supply or wastewater system, and modification, replacement, connection to a changed structure or some changes of use can also trigger review.4 Whitingham requires proof that the wastewater and potable-water permit applications have been made before issuing a local zoning permit for a permitted use.21

The Vermont DEC Springfield Regional Office serves Whitingham and provides permit assistance at 100 Mineral Street in Springfield, telephone 802-522-2220.22 State permits require a qualified licensed designer to design the water or wastewater system.22 A substantially completed permitted system is not valid until the state receives the required installation certification from the installer or licensed designer.23 Treat septic feasibility as a purchase contingency: only 9.8% of Windham County soils are mapped without severe limitations for a conventional drain field.24

Can you live in an RV or tiny home in Whitingham?

Whitingham treats a recreational vehicle as temporary living accommodation, but listed changes can turn it into a permanent structure requiring a zoning permit.6 Those changes include skirting or insulation, a foundation or removed wheels, an attached deck or stairs, immobilization, potable-water or wastewater connections, or inability to travel legally; the vehicle must also be registered and inspected for road travel.6 The reviewed rule does not establish a general duration for occupying an otherwise road-ready RV, so ask the Zoning Administrator before treating one as housing.

A tiny home used as a dwelling requires a zoning permit even when it is no larger than 120 square feet and no taller than 8 feet.7 Whitingham also allows a more limited primitive-camp option in the Conservation, Rural Lands and Rural Residential districts: occupancy cannot exceed 3 consecutive weeks or 60 total days in a calendar year, and interior plumbing is limited to one sink with water.8

Building a home in the Town of Whitingham: what are the steps?

  1. Ask the Zoning Administrator to confirm the parcel's district, allowed use, lot standards, setbacks and any flood-hazard overlay.525
  2. Establish legal access; a new driveway requires a Town access permit, and an access easement or right-of-way must meet the applicable width rules.326
  3. Hire the appropriate site and wastewater professionals and apply for the required state water and wastewater approvals.4
  4. Submit a complete zoning application, plot or site plan when applicable, proof of the water and wastewater applications, and the required Town fee.2721
  5. Allow for Planning Commission or Zoning Board review when the use requires it, and do not treat approval as effective until the appeal period passes.27
  6. Complete the work under the zoning permit and obtain the state installation certification for a permitted wastewater system.1523

What should you check before buying land in Whitingham?

Start with the official zoning map rather than the listing description, because Whitingham's district standards control uses, lot size, setbacks, height and lot coverage.5 For land without road frontage, confirm the permanent easement or right-of-way before closing; Whitingham generally requires at least 40 feet, and the Planning Commission may require up to 50 feet when it serves more than 2 lots or uses.26

Check flood status early. Construction and development in a Special Flood Hazard Area require a Zoning Administrator permit, and new residential and nonresidential structures in the regulated area are prohibited unless authorized by variance or waiver.25 Confirm wastewater feasibility with a licensed designer and the state before fixing the house site.4 Windham County's effective property-tax rate is about 1.9%, and its median annual property-tax bill is about $4,968; those county figures are context, not a parcel-specific tax estimate.2829

Watch-outs

  • The small-accessory-structure exemption does not waive district setbacks, and dwelling-unit tiny homes still require a zoning permit.17
  • Connecting an RV to potable water or wastewater is one of the conditions that makes it a permit-required permanent structure.6
  • A primitive camp is not a full-time-home workaround: occupancy and plumbing are expressly limited.8
  • Special Flood Hazard Area development needs local review, and new structures face a prohibition unless a variance or waiver applies.25
