Do you need a building permit in the Town of Stratton, Vermont?

Yes. Stratton requires a Town zoning permit before covered construction, reconstruction, conversion, structural alteration, relocation, enlargement or a change of use begins.1 A structure or addition smaller than 100 square feet may be exempt when it complies with the ordinance, subject to the Greenbelt Overlay exception and other applicable requirements.1 The Town also states that a construction footprint greater than 100 square feet requires a zoning permit.10

Stratton's zoning permit is not a complete substitute for state requirements. New homes and covered residential alterations must address Vermont Residential Building Energy Standards, while an owner-occupied single-family residence is generally outside the state public-building code unless its use brings it within that law.1112 The narrow owner-builder exception applies only to state residential energy standards; it does not create a general exemption from Stratton zoning approval, wastewater approval or other project requirements.9

Who issues zoning permits in the Town of Stratton?

Town of Stratton Planning & Permitting is the local contact for zoning-permit applications and development guidance.10 The office lists 802-874-4164 for zoning questions and publishes the zoning application and an access-permit application for driveways or work in the Town right-of-way.10

Applications and fees go to the Zoning Administrator or Town Office, and some proposals require additional review by the Planning Commission or Zoning Board of Adjustment.13 After approval, the zoning permit must be posted near the road for 15 days before construction starts and remain posted through completion.13 A Certificate of Completion finalizes a zoning-permitted project; the reviewed rule describes that document as a completion certificate, not a general certificate of occupancy.14 The Town's published application lists a $20 fee for the first $10,000 of project cost, plus specified additional, recording and address-processing charges.15

Does the Town of Stratton have zoning?

Yes. The Town of Stratton has municipal zoning, and the parcel's district and any overlay determine permitted uses and dimensional standards.25 In the Residential District, the minimum lot is 2 acres with 200 feet of frontage on a public or private road.16 Residential District structures, including decks, must be 50 feet from property lines and 50 feet from the road or right-of-way centerline.17

The Village District has different standards: a one-family residential lot requires 1 acre and 100 feet of frontage, with a 25-foot property-line setback and a 50-foot road-centerline setback.1819 A single-family manufactured or mobile home is an allowed Residential District use, subject to the district dimensions and other applicable approvals.8 Stratton's reviewed ordinance does not establish a minimum dwelling-floor-area rule, so ask Planning & Permitting before designing a tiny home.

How do septic and well permits work inside Stratton?

Vermont, rather than Windham County or the Town zoning office, issues the State Water/Wastewater permits that apply to septic systems inside Stratton.3 New or upgraded wastewater systems require state approval when the project triggers the program, and adding bedrooms may require a septic upgrade and permit.6 New private wells serving development also require state potable-water approval.4

The Vermont DEC Springfield Regional Office serves Stratton and provides regional permit assistance at 100 Mineral Street in Springfield, telephone 802-522-2220.20 A substantially completed permitted water and wastewater system must be inspected, and the state must receive the required installer or licensed-designer certification before the permit becomes valid for that completed system.21 Outside the resort area, Stratton properties generally use private wells and septic systems; resort-area properties use the Winhall-Stratton water and sewer system.22

Can you live in an RV or tiny home in the Town of Stratton?

Stratton regulates an RV park as a parcel with 3 or more campers or trailers, or a parcel set up to accommodate more than 2, and such parks are conditional uses in listed districts.7 That rule does not answer whether one RV may be occupied temporarily or long-term on an individual parcel. Ask Planning & Permitting about the parcel, duration, utilities and sanitation before using an RV as housing.

The reviewed Town rules do not provide a separate tiny-home category or a confirmed minimum dwelling-floor-area standard. A tiny home therefore needs a parcel-specific zoning answer based on its district, construction type and proposed use. A manufactured or mobile home used as a single-family residence is allowed in the Residential District, subject to applicable dimensional rules and approvals.8 Any occupied unit requiring a new or changed septic system or private well must also satisfy state water and wastewater permitting.64

Building a home in the Town of Stratton: what are the steps?

  1. Ask Planning & Permitting to identify the zoning district and overlays, then confirm the proposed dwelling, lot size, frontage and setbacks.25
  2. Bring in the site and wastewater professionals needed for the State Water/Wastewater permit and any new private well before fixing the home location.64
  3. If the driveway connects to a Town road, obtain the Town access permit and coordinate the entrance location before construction.23
  4. Submit the zoning application and fees to the Zoning Administrator or Town Office, allowing time for board review when required.13
  5. After approval, post the zoning permit near the road for 15 days before starting construction.13
  6. Complete required wastewater inspections and certification, then obtain Stratton's Certificate of Completion to close the zoning permit.2114

What should you check before buying land in Stratton?

Confirm the zoning district and every overlay before relying on acreage alone, because Residential and Village District lot, frontage and setback standards differ.16181719 Development in an Area of Special Flood Hazard or the Floodway requires a zoning permit or conditional-use approval, with additional board review for new construction, substantial improvements and Floodway development.24

Treat wastewater feasibility as a purchase contingency: only 9.8% of Windham County soils are mapped without severe limitations for a conventional septic drain field.25 Verify whether the parcel is served by the resort water and sewer system or will depend on a private well and septic system.22 Confirm access too, because a driveway connection to a Town road requires an access permit.23 Windham County's effective property-tax rate is about 1.9%, and its median annual property-tax bill is about $4,968.2627

Watch-outs

  • A structure smaller than 100 square feet may avoid the Town zoning permit only if it still complies with the ordinance and applicable exceptions.1
  • Stratton's RV-park rule does not confirm that an individual RV may be occupied on private land; ask Planning & Permitting before using one as housing.7
  • Bedroom additions may force a septic-system upgrade and a State Water/Wastewater permit.6
  • Flood-hazard and Floodway development requires local zoning or conditional-use approval before work begins.24
