Building permits, zoning and land rules in the Town of Putney, Vermont

The Town of Putney in Windham County requires a zoning permit before construction, structural alteration, enlargement, excavation, subdivision or a change of use begins.1 A separate general residential building permit could not be confirmed, while Vermont excludes most owner-occupied single-family homes from the state public-building code.2 Septic systems and private water supplies generally require a Vermont wastewater and potable-water-supply permit, subject to statutory exemptions.3

Do you need a building permit in the Town of Putney, Vermont?

Putney requires a zoning permit before land development begins, including construction, reconstruction, conversion, structural alteration, relocation, enlargement, excavation, landfill, parcel division or a change of use.1 The town materials do not clearly establish a separate general building permit for an ordinary new home, so ask the Putney Zoning Office whether the proposed use or design triggers another approval. The office specifically handles zoning permits for new construction, additions, changes of use, subdivisions and signs.9

Vermont's public-building code generally excludes an owner-occupied single-family residence unless the property is put to a covered public-building use.2 That exclusion does not erase Putney zoning review or Vermont energy rules. An owner-builder can qualify for a residential-energy exemption only by meeting occupancy, construction-control, disclosure and later recording conditions; the exemption is not a general waiver of municipal permits.7

Who issues zoning permits in the Town of Putney?

The Town of Putney Zoning Office administers the local permitting process and helps applicants determine what forms and approvals are needed.9 Contact the office before fixing a house location or ordering plans, because Putney regulates both the use and dimensions of development. The town's underlying districts are Conservation, Resource, Rural Residential, Village Residential, Village and Multiple Use, and overlay districts can add requirements.10

A complete zoning application includes the application form, zoning and recording fees, applicable local approvals and any additional information requested by the Zoning Administrator.11 The Zoning Administrator generally acts within 30 days after an application is complete, and an approved permit does not take effect until the 15-day appeal period passes or an appeal is resolved.11 Putney's current fee amounts were not confirmed; the bylaw says the zoning-permit fee is set by the Board of Selectpeople and that recording or independent technical-review charges may also apply.12

How does Putney zoning affect lot size, setbacks and home types?

Putney's dimensional rules depend on the zoning district and utility service. In the Rural Residential District, a single- or two-family dwelling generally requires 2 acres and a 200-foot minimum lot width or depth.6 Rural Residential buildings generally must sit at least 15 feet from a town or state highway right-of-way and 20 feet from other lot lines.13 In the Resource District, the comparable dwelling minimum is 10 acres with 400 feet of lot width or depth, while setbacks are 15 feet from a highway right-of-way and 40 feet from other lot lines.1415

Putney allows manufactured or mobile homes on the same terms as conventional housing, subject to applicable zoning.8 The reviewed Putney rules do not establish a distinct tiny-home category or a minimum dwelling floor area, so a small-house proposal should be checked against the parcel's district, wastewater capacity and use rules with the Zoning Office.

Can you live in an RV while building in Putney?

Putney allows one recreational vehicle or travel trailer to be used for camping with the landowner's approval for no more than 120 days per calendar year, while residential occupancy and utility hookups are limited to 6 months per year.5 These are local limits, not permission to bypass wastewater or other approvals.

On a construction site, mobile homes or travel trailers may serve temporarily as dwellings only after conditional-use approval and zoning permits, and the new residences must also have zoning permits.16 That construction-site use may last no more than 2 years or until the new residence is occupied, whichever comes first; the Development Review Board may grant conditional-use extensions.16 Bonafide primitive or wilderness camping is excluded from the zoning rules unless the Zoning Administrator finds a likely health hazard, public nuisance or source of pollution.17

How do septic and well permits work inside Putney?

Vermont generally requires a wastewater and potable-water-supply permit to construct, replace or modify a septic system or a potable-water well, subject to statutory exemptions.3 The Vermont DEC Wastewater System & Potable Water Supply Program issues permits for soil-based wastewater systems, non-public potable-water supplies, and municipal water and sewer connections.18 Ask that program to confirm the regional reviewer and any exemption for the parcel before relying on an existing system or starting design.

A permitted water and wastewater system must be inspected, properly tested and certified after substantial completion before the permit becomes valid.19 Site feasibility deserves early attention: across Windham County, only 9.8% of mapped soils avoid a severe limitation rating for a conventional septic drain field.20 That county-level figure does not decide a Putney parcel, but it makes a licensed designer's site evaluation a sensible early contingency. Putney's accessory-dwelling rule also requires sufficient wastewater capacity.21

Building a home in Putney: what should you do first?

  1. Confirm the parcel's zoning district, overlays and proposed use with the Putney Zoning Office. Putney's official zoning map is kept in the Town Clerk's Office.4
  2. Test the concept against district lot size, setbacks and access before paying for final plans. A driveway affecting a town highway right-of-way needs written permission from the town's legislative body or designee, while work affecting a state highway right-of-way needs written permission from the Vermont Agency of Transportation.22
  3. Hire a qualified licensed designer to evaluate the water and wastewater system; Vermont water and wastewater permits require a qualified licensed designer.18
  4. Assemble the Putney zoning application and any site-plan, conditional-use, subdivision, flood-hazard or other approvals that apply.1
  5. Allow for the local decision and appeal timing before construction starts. A complete application has a 30-day action period, followed by a 15-day period before the permit takes effect if no appeal intervenes.11
  6. If the project required Development Review Board approval before the zoning permit, obtain the required certificate of occupancy before use.23

What should you check before buying land in Putney?

Start with the exact district and any flood-hazard overlay, because Putney regulates construction and development in mapped flood-hazard areas and can require review before the zoning permit issues.24 Confirm legal highway access separately; a zoning-compliant house site does not itself establish permission for a new entrance into a town or state highway right-of-way.22

Treat wastewater feasibility as a purchase contingency. Only 9.8% of Windham County's mapped soils avoid a severe limitation rating for a conventional septic drain field, and 51.8% of county land has a slope of 15% or less.2025 Those county-wide measurements are screening signals rather than parcel findings. Windham County's effective property-tax rate is 1.9%, and its median annual property-tax bill is $4,968; obtain the actual Putney tax record and assessment for the property.2627 Finally, verify whether public water or sewer is available and whether connection is required, because the reviewed rules distinguish sewered and non-sewered lots but do not establish a general connection threshold.

Watch-outs

  • A Putney zoning permit is not the same thing as a general building permit; the town's materials clearly require zoning approval for construction but do not confirm a separate general residential building permit.1
  • Ordinary residential construction inspections were not confirmed, but Putney authorizes inspections before, during and after work in regulated flood-hazard areas.28
  • A Putney zoning permit generally does not take effect until the 15-day appeal period has passed or any appeal is resolved.11
