Does Vergennes, Vermont have zoning, and what does it cover?

Yes. The City of Vergennes adopts and administers its own zoning bylaws, run by the city zoning administrator and the development review board1. Addison County itself does not zone: Vermont law gives zoning power to cities and towns, not counties5.

The bylaws divide the city into districts, including Medium Density Residential (MDR) and Low Density Residential (LDR), plus flood-hazard and other overlays10. Rules differ by district. For a one-household dwelling in MDR, front yards must be at least 30 feet and side and rear yards at least 15 feet, with lot coverage capped at 25%1112. In LDR, the minimum is 20 feet on the front, side and rear, with coverage capped at 20%1314. Building height tops out at 35 feet in both districts, and accessory structures at 24 feet1516.

Under the bylaws, any use or structure not expressly allowed, permitted or exempt is deemed prohibited2. Confirm your parcel's district with the zoning administrator before you buy.

Do you need a building permit in Vergennes, and who issues it?

Inside Vergennes city limits, no land development may begin, and no land or structure may be used, moved, extended or occupied, until the zoning administrator has issued a zoning permit2. Uses exempt under the bylaws, including agricultural practices, are excluded2.

The bylaws establish a zoning permit; we could not confirm a separate city building permit or building-code permit, so ask the zoning administrator whether one applies to your project17. Vermont does not impose its Fire & Building Safety Code on owner-occupied single-family homes6.

The zoning administrator may also require a certificate of occupancy once a one-household or two-household project is complete18. Farm structures used for agricultural practices do not need a permit, but the owner must notify the city, and dwellings for human habitation are still regulated19.

Who is the zoning contact in Vergennes, and how do you reach them?

The City of Vergennes Zoning Administrator is the point of contact for all questions involving development in the city17. Call 802-877-1232 or email [email protected]17. The city's zoning page lists the applications and fees.

Applications are available from the zoning administrator, who helps applicants work out which permits and approvals they need20. Projects that are conditional uses or not in full conformance with the bylaws go to the development review board, which meets monthly17. We could not find the city's fee schedule in the bylaws, so ask for the current fees when you apply20.

How do septic permits work in Vergennes?

Septic permits for Vergennes come from the state, not the city. Vermont requires a state permit to build or replace a septic system or private water supply3, and the state, not the county or city, is the default permitting authority4. For Addison County towns including Vergennes, that is the Vermont DEC Wastewater System & Potable Water Supply Program, Rutland Regional Office, at 802-786-590021.

A permitted system is not complete until the state receives an installation certification from the installer or licensed designer22. A city or town may also prohibit certain connections or require hookup to municipal sewer; we could not confirm Vergennes' connection rules, so ask the city before you buy23.

Addison County's soils matter too: about 9% of county soils rate as not limited for a conventional drain field, so many lots outside city sewer need a site evaluation or an engineered system24.

Can you live in an RV or tiny home in Vergennes?

We could not confirm a rule for long-term RV living, temporary camping or tiny homes inside Vergennes. We did not find an RV-occupancy rule in the city zoning bylaws, and a missing rule is not permission. Ask the zoning administrator before you plan to live in either17.

Vermont law does let an owner-occupied single-family lot add one accessory dwelling unit8. In Vergennes, the owner must live in either the main dwelling or the accessory unit, the property must have enough wastewater capacity, and a detached unit may not exceed 60 percent of the main dwelling's habitable floor area7.

Building a home in Vergennes: the steps, in order

  1. Ask the zoning administrator which district your parcel is in and whether your plan fits it17.
  2. Apply for a zoning permit; projects needing conditional use or not fully conforming also go to the development review board217.
  3. Get the state wastewater and potable water permit from Vermont DEC321.
  4. If the driveway meets a state highway, get a state driveway permit; town highways need a permit from the town25.
  5. Ask whether the lot falls in a flood hazard area, where extra review applies26.
  6. Finish construction, then ask the zoning administrator whether a certificate of occupancy is required18.

What stays with Addison County, and what to check before you buy
