Zoning, building permits and septic rules in Colonial Beach, Virginia

The Town of Colonial Beach, Virginia adopts and administers its own Zoning Ordinance inside town limits instead of Westmoreland County zoning1. Building permits in Virginia follow the statewide building code enforced by a local building official2, and we could not confirm which town office issues them, so ask the town planning office first. Septic permits in Westmoreland County come from the Health Department's Environmental Health Division3.

Does Colonial Beach, Virginia have zoning, and what does it mean for lot size and setbacks?

Yes. Colonial Beach adopts its own Zoning Ordinance, and it applies to all land inside town limits instead of Westmoreland County zoning1. Only uses expressly listed for a district are permitted there; an unlisted use is prohibited1. The town's districts include A-1 Agricultural, R-1, R-2, R-2A, R-3, R-4, MHP manufactured home park, CR, C-1, C-2, maritime commercial, resort commercial, I-1 light industrial and PUD, plus flood plain and Chesapeake Bay overlays9.

In the R-1 district, the minimum lot is 12,000 square feet6. R-1 front setbacks run from 20 to 35 feet, the rear setback is at least 35 feet, and side setbacks are 7 feet on one side and 15 feet combined10. Lot coverage in R-1 is capped at 36% without mitigation11, and height at 35 feet12.

In the R-2 district, the minimum lot is 5,000 square feet7. R-2 front setbacks run from 15 to 30 feet, the rear setback is at least 25 feet, and side setbacks are 5 feet on one side and 15 feet combined13. Check the town's official zoning map for your parcel's district; the posted ordinance articles date from 2012 and 2013 and later amendments were not checked1.

Do you need a building permit in Colonial Beach, and who issues it?

A building permit is required for construction anywhere in Virginia under the statewide building code, and the applicant must show contractor licensure or a written statement that the applicant is not subject to licensure4. Enforcement belongs to the local government's building inspections department2. We could not confirm which Colonial Beach office issues building permits and inspections, so call the town's Planning and Community Development office before you hire anyone.

The town does issue zoning permits. Colonial Beach issues a zoning permit before lots are consolidated or when accessory structures are placed on vacant lots, and the permit expires if the activity does not start within 1 year5. The town's forms page lists a Principal Structure or Renovation Addition to Principal Structure form, a Zoning Permit Short Form and a Trades Permit form14.

Westmoreland County's Building Official and the county's zoning permit rules cover unincorporated Westmoreland County, not land inside Colonial Beach15. Sending a town address to the county planning counter means going to the wrong office.

Can you live in an RV, manufactured home or tiny home in Colonial Beach?

We could not confirm a Colonial Beach rule on living in an RV on private land; the town's ordinance articles we reviewed regulate where RVs may be parked, not whether people may sleep in them, so ask the planning office16.

Manufactured homes are allowed in the town's MHP district, at a maximum density of 8 dwelling units per acre17. Manufactured homes outside the MHP district were not addressed in the text we reviewed.

For tiny homes, Virginia's building code lets a dwelling of 400 square feet or less use Appendix AQ as an alternative path, but that is a building-code rule and does not grant zoning approval, placement rights or septic approval18. Accessory apartments larger than 750 square feet may be permitted in R-1 and R-2 subject to an approved site plan and conditions set by town council1920.

How do septic permits work inside Colonial Beach?

Septic permits are not a town function. Virginia requires a written construction permit before any sewage disposal system is built, expanded or modified21, and in Westmoreland County the Health Department's Environmental Health Division handles the permit process3. A new septic system needs a soil determination and a septic permit before installation, and an operation permit after inspection is needed for the certificate of occupancy8.

Whether a given lot inside the town must connect to public sewer is a question we could not confirm. The county notes that public water and sewer are available in specified areas, including areas served by the Town of Colonial Beach, and that a private septic system is required outside public sewer areas22. Ask the town's utility billing office and the Environmental Health office which applies before you close.

Soils matter too: about 12% of soils across Westmoreland County rate as not limited for a conventional drain field, so expect a site evaluation on any lot that needs septic23.

Building a home in Colonial Beach: the steps, in order

  1. Call the town's Planning and Community Development office to confirm the zoning district, setbacks and any flood plain or Chesapeake Bay overlay on your lot916.
  2. Ask the same office who issues building permits and inspections inside town limits; we could not confirm this.
  3. Apply for the zoning permit the town requires before building on or consolidating lots5.
  4. Confirm sewer: either a public connection or a Health Department septic permit2224.
  5. Build to the statewide building code, with the local building official inspecting footings, foundations, framing and a final inspection25.
  6. Obtain a certificate of occupancy before anyone moves in26.

What stays with Westmoreland County, and what to check before you buy

Septic and private-well permits stay with the Westmoreland County Health Department3. A private well construction or abandonment permit costs $30027. For land outside town limits, use the Westmoreland County page, because county rules apply only to unincorporated land15.

Check flood risk first. In R-1, new principal structures must be flood proofed 3 feet above base flood elevation28, and Virginia allows a building official to require permits for otherwise exempt items in a special flood hazard area29. A driveway or entrance onto a state-maintained road needs a VDOT land-use permit30. Westmoreland County's effective property tax rate is 0.6%31, and typical home insurance runs about $1,504 a year32.

Watch-outs

  • We could not confirm which Colonial Beach office issues building permits, inspections and certificates of occupancy, so confirm with the Planning and Community Development office before you sign a contractor16.
  • The Colonial Beach zoning articles we reviewed date from 2012 and 2013, so ask the planning office whether later amendments changed your district's rules1.
  • An owner-builder exemption from contractor licensing does not exempt the work from the building code, permits or inspections33.
  • Rules for living in an RV, tiny home, minimum dwelling size and private wells inside town limits were not confirmed; ask the town before buying with that plan16.

Unanswered questions are usually a sign that Town of Colonial Beach publishes no rule on the point, not that none exists. Westmoreland County’s page lists the county offices to call.
