Building permits, zoning and septic rules in Salem, Virginia

The City of Salem, Virginia adopts and administers its own zoning ordinance1 and requires building permits for most new construction, issued by city Community Development2. Septic and private-well permits are not a city matter: they come from the Virginia Department of Health's Roanoke-area onsite program3. Salem is an independent city, so there is no separate county office to call4.

Do you need a building permit in Salem, Virginia?

Yes, for most work. The City of Salem requires a building permit for most new residential and commercial construction, additions and interior alterations2. Salem's city building department enforces the Virginia Uniform Statewide Building Code, which applies to construction inside city limits5.

The city's permit FAQ lists items that do not need a building permit, including residential window or door replacements, residential reroofs, residing, gutters, kitchen cabinets, playground equipment and on-grade patios2. Even when no building permit is needed, setbacks and other zoning requirements can still apply2. Contractors must hold a valid City business license to pull a permit2.

Doing the work yourself does not change the answer: Virginia's owner-builder exemption covers contractor licensing only and does not exempt the work from the building code9. Salem appears to offer no owner-builder permit exemption of its own8; ask Building Inspections to confirm.

Who issues building permits in Salem, and how do you reach them?

The City of Salem Building Inspections office, part of Community Development, issues building permits and runs construction inspections inside the city10. Applications, payments and inspection scheduling go through the city's online Cityworks permit system10.

A residential new-construction application needs one digital (PDF) copy of plans emailed to Community Development or on CD, a completed application, shrink-swell soil test results and a certified plat showing easements and structures11. Permits are issued by the city Community Development office11.

Statewide, the building official's final inspection comes before a certificate of occupancy, which Virginia requires before anyone occupies a new building12. We could not confirm Salem's own building permit fee schedule, so ask Building Inspections for the current fee before you budget13.

Does Salem have zoning, and what does it mean for RVs, tiny homes and setbacks?

Yes. The City of Salem adopted a zoning ordinance under the Code of Virginia and its planning division administers it1. The zoning map and the ordinance text define each district14, and each district designates uses as "by right" or as "special exceptions"15. Zoning permits are required regardless of structure size1.

Dimensional rules differ by district. One city plat for an RSF-zoned parcel on Roanoke Boulevard shows 25-foot front and rear setbacks and side yards of at least 10 percent of lot width, but those figures belong to that parcel and should not be applied to other Salem districts16. We could not confirm lot-size, minimum home size or height rules for Salem's residential districts.

For tiny homes, a dwelling of 400 square feet or less may use Virginia's Appendix AQ alternative under the state code, but that does not grant Salem zoning approval, site eligibility, setbacks or septic approval7. We could not confirm whether Salem allows living in an RV on a lot; ask Planning & Zoning before you buy.

How do septic and well permits work in Salem, Virginia?

Septic and private-well permits for Salem are handled by the Virginia Department of Health through the Roanoke-area onsite sewage and well program, not by the city3. Most of the city is served by public sewer17, so confirm sewer availability for your address before planning a septic system. We could not confirm whether Salem requires connection to public water or sewer when available.

The application is the Commonwealth of Virginia sewage disposal and/or private well construction permit application, with a site sketch, a surveyed plat or waiver request, and the fee18. Check the water supply box for a well19. The statutory onsite sewage permit application fee is $75, with waivers and refunds in some cases20; the fee page lists $300 for a well construction permit21.

Salem residents do not automatically qualify for health department evaluation and design services. They must submit supporting work from a DPOR-licensed private consultant or petition VDH for services3. USDA rates about 14% of Salem's soils as not limited for a conventional drain field22, so expect a site evaluation and possibly an engineered system.

Can you live in an RV or tiny home on your land in Salem?

We could not confirm Salem's rules for living in an RV, temporary camping or placing a manufactured home; the answer sits in the city's zoning ordinance. Ask City of Salem Planning & Zoning, which administers that ordinance15.

Virginia's campground rules do not answer the question for a private lot. They cover campgrounds with three or more campsites, and a state permit allows temporary camping of 14 days or less23. A tiny house built as a dwelling under the state residential code is a separate path, and it still needs Salem zoning and septic approval7.

Building a home in Salem: the steps, in order

  1. Call City of Salem Planning & Zoning to confirm your parcel's district and that a house is an allowed use15.
  2. Check floodplain status; building in a Salem floodplain requires a preconstruction certificate of elevation6.
  3. If the lot has no public sewer or water, apply to the Virginia Department of Health for the sewage and/or well permit18.
  4. Apply for the building permit through the city's online system with plans, soil test results and a certified plat11.
  5. Schedule the required inspections with Building Inspections24.
  6. Obtain a certificate of occupancy before moving in12; in a floodplain, the post-construction certificate of elevation must come first6.

What stays with Roanoke-area and state offices, and what to check before you buy in Salem

Salem is an independent city; the Salem city page has the area-level view. Inside Salem, septic and wells stay with the Virginia Department of Health3, and the city also lists an erosion and sediment control permit from its engineering department for residential projects6.

Before buying, check floodplain status6, the zoning district14, and whether a driveway onto a state-maintained road needs a VDOT land use permit25. Salem's effective property tax rate is about 0.9%26, and the median property tax bill is about $2,232 a year27.

Watch-outs

  • Salem's zoning district standards (lot size, minimum home size, height, RV and camping rules) are not confirmed here; ask City of Salem Planning & Zoning before you buy15.
  • A permit may not be needed for small projects, but setbacks and other zoning requirements can still apply2.
  • Salem city residents cannot assume the health department will design a septic system; a DPOR-licensed consultant is often needed3.
  • Permits are issued only between 8 am and 4 pm, Monday through Friday2.
