Roanoke City, Virginia

Zoning, building permits and septic rules in Roanoke, Virginia

Roanoke, Virginia requires a building permit for residential construction, and the City of Roanoke issues those permits and administers its own zoning under Chapter 36.2 of the City Code12. Septic and well permits for homes inside the city come from the Virginia Department of Health's Roanoke Health District, not city hall3. City staff review single- and two-family residential applications in 5 business days once complete4.

Does Roanoke, Virginia have zoning?

Yes. The City of Roanoke administers its own zoning code, Chapter 36.2 of the City Code, and building and zoning permits inside the city are reviewed against it210.

What the zoning code allows on a particular lot depends on its district. We could not confirm Roanoke's rules on long-term RV living, tiny homes, manufactured homes, minimum lot size, setbacks or lot coverage, so do not assume any of them. To learn what a specific parcel permits, call the city's zoning staff at10; they handle zoning verification and the official zoning map.

Accessory dwellings are allowed only in a limited way: an accessory dwelling must sit on the same lot of record as the principal structure, and the review process varies with the zoning district, principal use, size and land disturbed8.

Do you need a building permit in Roanoke, and who issues it?

Yes. Building work inside Roanoke requires a permit from the City of Roanoke's Planning, Building & Development department, which runs the Permit Center1. Reviews run against the 2021 Virginia Statewide Uniform Building Code and the city zoning code5.

An application includes a completed residential or commercial building and zoning permit application, plans drawn to scale where applicable, and a floodplain elevation certificate if the site is in a special flood hazard area1. When a general contractor does building work together with plumbing, electrical or HVAC on one project, a combination permit applies1. Fees are due when the permit is issued11.

A permit stays valid while work proceeds and an inspection has happened within the last 6 months4. Virginia lets an inspecting authority waive inspection where construction costs less than $2,50012. The city's Permit Center is the office to call:13.

Can an owner build their own house in Roanoke?

Yes, for contractor licensing, but the work still needs permits and inspections. Virginia exempts a person who performs or supervises construction of no more than one primary residence owned and used by that person in any 24-month period from contractor licensing, and that exemption does not exempt the work from the Uniform Statewide Building Code7. In Roanoke, an owner-builder submits an owner/builder affidavit with the permit application when claiming the licensing exemption1413.

How do septic permits work inside Roanoke?

The city does not issue septic permits. Septic and well permits for homes inside Roanoke come from the Virginia Department of Health's Roanoke Health District, through its Environmental Health Office315. We could not confirm whether Roanoke requires a connection to public sewer or water, so ask the city and the Western Virginia Water Authority before you buy.

The applicant submits the Commonwealth of Virginia application for a sewage disposal system and/or private well construction permit, with supporting work from a licensed private consultant, and pays a fee6. Virginia's statutory septic application fee is $75, which can be waived for low-income applicants16. Roanoke city residents do not automatically qualify for health-department evaluation and design services3.

A well construction permit costs $30017. Only 13.6% of the soils in Roanoke are rated not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system18.

Can you live in an RV or tiny home in Roanoke?

We could not confirm whether Roanoke allows long-term RV living, temporary camping or tiny-home occupancy on private land inside the city. The answer sits in the use rules of Chapter 36.2, so ask the city's zoning staff at10 about the specific parcel before you buy or move anything onto it.

Virginia's campground rules do not answer the question. They cover permitted campgrounds with three or more campsites, not living in an RV on your own lot19. A manufactured home is a different case: where a locality zones, state law limits how it can exclude qualifying manufactured housing, so ask the zoning office which Roanoke districts apply20.

Building a home in Roanoke: the steps, in order

  1. Confirm the lot's zoning district and permitted uses with the city's zoning staff10.
  2. If the lot lacks public sewer or water, apply to the Roanoke Health District for septic and well permits615.
  3. Submit the residential building and zoning permit application, scaled plans and, if you are an owner-builder, the owner/builder affidavit to the Permit Center114.
  4. Wait for review, which takes 5 business days for single- and two-family homes after the application is complete4.
  5. Pay fees when the permit is issued11.
  6. Call for inspections at each stage, from footings through final21.
  7. Get a certificate of occupancy before anyone moves in; the building official issues it within 5 working days after the final inspection is approved22.

What to check before you buy land in Roanoke

Roanoke is both a city and its own county-equivalent, so the county-level page at Roanoke city covers the same ground. The city has about 2,285 people per square mile23, so expect an urban lot, not rural acreage.

Check flood zones first: a floodplain elevation certificate is part of the permit application in special flood hazard areas1. A driveway entrance onto a state-maintained highway needs a VDOT land use permit24; we could not confirm the city's rules for driveways on city streets. Also ask about water and sewer availability, since the city's permit checklist asks for a letter from the Western Virginia Water Authority where applicable1.

Roanoke's effective property tax rate is 1%, and the median property tax bill is $1,828 a year2526.

Watch-outs

  • We could not confirm Roanoke's minimum lot size, setbacks, height limits or lot coverage for residential districts; ask the city's zoning staff at10 before relying on any figure from a third-party zoning site.
  • Short-term rentals, homestays, long-term RV living and tiny-home occupancy inside Roanoke are unconfirmed; Virginia lets localities regulate short-term rentals through zoning27.
  • A certificate of occupancy is required to occupy a new structure and to close on a sale or mortgage, so do not move in or list the property before the city issues one9.
