Does Rocky Mount, VA have zoning?

Yes. The Town of Rocky Mount administers its own Zoning & Subdivision Ordinance, which replaces earlier town zoning and subdivision ordinances1. Inside town limits, the town's Planning & Zoning administrator enforces it, and the Community Development department issues zoning permits4.

The ordinance publishes districts including Residential Agricultural (RA), R1, R2, R3, RB, C1, C2, CBD, M1 and M2, and the zoning map is adopted as part of the ordinance9. Look up your parcel's district before you plan anything, because dimensional rules differ by district.

For RA and R1, Table 4-2 prints a maximum height of 35 feet for primary structures and 12 feet for accessory structures; confirm which district each figure belongs to with the zoning administrator10. Where a lot has no public water or sewer, the minimum lot size is set by the health official11. We could not confirm the setback figures for RA and R1, so ask the town before you place a structure4.

The county's zoning map does not decide anything inside town. Outside town limits, Franklin County parcels may be zoned or marked NZ (not zoned)12.

Do you need a building permit in Rocky Mount, VA, and who issues it?

Yes. Franklin County's building code page states that a building permit is required to construct, alter, repair, add to, remove or demolish any building or structure in the Town of Rocky Mount2. The permit comes from Franklin County Building Inspections, not from a town office13.

Applications must be approved and fees paid before the permit is issued and before any construction begins14. Inspections follow the Virginia Uniform Statewide Building Code15, and a certificate of occupancy is required before the building is occupied8.

A zoning permit is a separate step from the town: the town zoning permit application needs a plat showing lot lines, setbacks, connections to public water and sewer, and floodplain limits14. Franklin County lists new site-built dwellings at $0.18 per square foot with a $180 minimum16.

Some small work is exempt statewide, such as a detached storage shed of 256 square feet or less17.

How do septic permits work in Rocky Mount, VA?

Septic permits are a state health matter, not a town one. The Virginia Department of Health, through the West Piedmont Health District, assists residents with private wells and onsite sewage systems in Franklin County3. Virginia law requires a written permit before anyone constructs, expands or modifies a sewage disposal system, with a $75 application fee that can be waived in some cases18.

We could not confirm which lots inside Rocky Mount are served by public sewer. If a lot is not, expect to need an onsite sewage permit; ask the Franklin County Health Department before you buy19. The town's zoning permit application also asks for the points where the lot connects to public water and sewer, so the town's Planning & Zoning office can tell you what utilities reach a given parcel14.

Can you live in an RV or tiny home in Rocky Mount, VA?

We could not find a general rule for living in an RV on a lot in town, so call the Planning & Zoning office before you try it4. What the ordinance does say: an RV, travel trailer or camper may not be used as an accessory dwelling5. In the floodplain overlay, an RV must stay fewer than 180 consecutive days and be ready for highway use, or meet the floodplain requirements instead5.

Virginia's campground rules do not answer this question; they cover permitted campgrounds, not a single lot20.

We did not find a tiny-home provision. Two options the ordinance does address: manufactured homes need a permanent foundation and skirting under the building code7, and an accessory dwelling is allowed only with a single-unit detached dwelling, one per lot, at most 60% of the main dwelling's first-floor area, and at least 15 feet from it if detached6.

Building a home in Rocky Mount, VA: the steps, in order

  1. Confirm the parcel's zoning district with the town's Planning & Zoning office, and ask about setbacks, which we could not confirm4.
  2. Ask the Franklin County Health Department whether the lot has public sewer or needs an onsite system permit19.
  3. Apply for the town zoning permit with a plat showing lot lines, setbacks, utility connections and floodplain limits14.
  4. Apply for the building permit from Franklin County Building Inspections; fees are due before the permit is issued14.
  5. Schedule the required inspections as work proceeds21.
  6. Get the certificate of occupancy before anyone moves in8.

If you plan to build your own primary residence, Virginia's contractor-licensing exemption does not exempt the work from the building code22.

What stays with Franklin County, and what to check before you buy

Building permits, inspections and certificates of occupancy are handled by Franklin County even for lots inside the town2. Septic and wells go through the health department3. The town controls zoning and subdivision of land inside its limits23.

For land outside town limits, the county's rules apply instead; see the Franklin County page.

Before you buy inside town, check the floodplain overlay: zoning permit plats must show all floodplain limits, and enclosures in flood areas need a signed non-conversion agreement recorded on the deed24. Short-term rentals are limited, and the host must show the dwelling is the host's primary residence25. A driveway onto a state-maintained road needs a VDOT land use permit26. Franklin County's effective property tax rate is 0.5%27.
