Weber County, Utah

Zoning, building permits and septic rules in West Haven, Utah

West Haven, Utah publishes its own zoning code and adopts its own building codes, so building permits and zoning inside city limits are handled by the city, not Weber County12. The city's Building Department issues permits for new construction, additions and remodeling3. Septic permits are a separate office: for Weber County the local health department is the Weber-Morgan Health Department4. We could not confirm West Haven's rules on RVs or tiny homes.

Does West Haven, Utah have zoning?

Yes. West Haven's published zoning code covers land inside city limits and names residential districts (R-1, R-2, R-3, R-4, RE-15, RE-20), agricultural districts (A-1, A-2), a manufactured-home park zone, commercial, mixed-use, manufacturing and open-space zones1. Weber County's own zoning applies only to unincorporated land, so county rules do not govern a West Haven lot8.

In the RE-15 and RE-20 residential districts, the minimum lot is 15,000 and 20,000 square feet for the listed uses5. Front and rear setbacks for the main building are 30 feet, and dwelling side yards are 10 feet each with a combined width of at least 24 feet9. Maximum height is 2 1/2 stories or 35 feet10.

In the A-1 agricultural district, the base minimum lot is 20,000 square feet, with 2-acre and 5-acre minimums for uses that require them6. Main-building rear setbacks are 30 feet and dwelling side yards follow the same 10-foot, 24-foot-combined pattern11. A single-family dwelling can be up to 35 feet tall12.

We could not confirm what West Haven's code says about living in an RV, camping, tiny homes or accessory dwelling units. Ask City Hall before you rely on any of them13.

Do you need a building permit in West Haven, and who issues it?

The West Haven Building Department issues permits for new construction, additions and remodeling inside city limits, and inspects the work against the approved plans3. The city adopts the international building codes and applies newer versions as they take effect, without a separate council vote2. Utah's State Construction Code sits underneath, and the state describes the building permit requirement as applying to new construction and certain alterations14.

Fees are not a flat number. West Haven calculates building permit fees from valuation tables and formulas in force on the date you apply, with other fees in the city's Consolidated Fee Schedule15. The city's own page says it aims for an initial plan review of 7-14 working days for residential projects3.

We could not confirm the city's written rules on inspections, certificates of occupancy or its owner-builder process. Call the Building Department at 385-389-2690 before you buy or start drawings3.

How do septic permits work inside West Haven?

Septic permits are not issued by the city's Building Department. For Weber County, the local health department that handles onsite wastewater is the Weber-Morgan Health Department4. We could not confirm whether your West Haven lot is on city sewer or needs its own system, so ask the city first and the health department second16.

If a lot does need a septic system, the Weber-Morgan Health Department requires a feasibility process with site and soil evaluation, and an approved culinary water source before it issues a permit17. The department's published conventional septic permit fee is $375, plus a $40 state fee17. Mound systems list at $850 and at-grade systems at $95017.

Weber County is a poor match for conventional drain fields: only 2.6% of its soils rate "not limited" for them, so expect a site evaluation and possibly an engineered system18. That figure is county-wide, not specific to West Haven.

Building a home in West Haven: the steps, in order

  1. Confirm the lot's zoning district with City Hall at 801-731-4519 and check lot size and setbacks against the district tables131.
  2. Ask whether the lot has city sewer. If not, start the septic feasibility process with the Weber-Morgan Health Department1617.
  3. Submit plans to the West Haven Building Department for a building permit3.
  4. Build with inspections of the permitted work3.
  5. Owners building their own home should know that Utah's licensure exemption does not remove permit, zoning or occupancy requirements7.

What stays with Weber County (and what to check before you buy)

Weber County's building, zoning and driveway rules apply to unincorporated land, not to West Haven lots, so a county page will not answer a city-limits question19. The Weber County page covers land outside the city.

Wells and flood hazards need separate checks. Utah requires a valid water right and a Start Card before constructing a shallow well20. We could not confirm how West Haven treats flood-hazard development, although its code includes a Flood Damage and Prevention chapter, so ask the city.

County-level figures: Weber County's effective property tax rate is 0.6%21, and its median property tax bill is $2,415 a year22.

Watch-outs

  • West Haven's rules on RV living, camping, tiny homes and accessory dwelling units could not be confirmed, so ask City Hall at 801-731-4519 before buying for those uses13.
  • Do not use Weber County's unincorporated-area permit and zoning pages for a West Haven lot; they cover only land outside city limits8.
  • Utah's owner-builder exemption covers contractor licensure only and does not waive building permits or inspections7.

Unanswered questions are usually a sign that West Haven publishes no rule on the point, not that none exists. Weber County’s page lists the county offices to call.
