Zoning, building permits and septic rules in Wellington, Utah

Wellington, Utah, in Carbon County, adopts its own zoning, and a building permit from the city is required before anything is erected, moved or structurally altered inside city limits12. Septic permits for lots without sewer come from the Southeast Utah Health District, not the city3. Carbon County's building department also asks for proof of Wellington zoning approval before it will take a permit application4.

Does Wellington, Utah have zoning, and what does it mean for lot size and setbacks?

Yes. Wellington has its own land use code, and Chapter 9 regulates residential uses in six zones: R-1-43, R-1-21, R-1-10, R-1-7, R-M and Mobile Home5.

The district decides the numbers. In R-1-43 the minimum lot area is one acre8, with a front yard of 30 feet, a side yard of 15 feet for a dwelling and a rear yard of 30 feet for the main building11. Buildings in R-1-43 top out at two and a half stories or 35 feet12. In R-1-21 the minimum lot area is half an acre9.

Manufactured homes in R-1-43 must be multi-section units, each section at least 10 feet wide, set on a permanent foundation10. We could not confirm the rules for RVs, tiny homes or accessory dwellings inside the city; ask the Wellington City Office13.

Do you need a building permit in Wellington, and who issues it?

Yes. Wellington's land use code says no building or other structure may be erected, moved, added to or structurally altered inside the city without a permit issued by the city's administrator2. The permit is issued only when the work conforms to the zoning in effect at the time of application2.

Applications come with plans drawn to scale, in triplicate14. The city building inspector inspects work during construction6 and issues a permit of occupancy before the building is used7.

Carbon County's Building Department states that it serves incorporated areas too and asks for proof of city zoning approval for Wellington applications415. Which office does plan review for a Wellington lot is something we could not confirm, so call the Wellington City Office first13.

How do septic permits work inside Wellington?

Septic permits are not a city matter. Carbon County states that where an area is not served by sewer, septic approval and a permit must come from the Southeast Utah Health District3. The district requires a permit and plan design approval for onsite wastewater systems16.

Utah rules require connection to a public sewer when one is available and practicable, so a lot on a city sewer line may not be eligible for a septic system at all17. We could not confirm which Wellington streets have city sewer; the Wellington City Office can tell you13.

Carbon County's basic septic permit was listed at $354.00 plus a $40.00 state fee on the 2024 fee schedule18.

Building a home in Wellington: the steps, in order

  1. Call the Wellington City Office to confirm your lot's zoning district and whether city sewer and water reach it13.
  2. Check the lot against the district's minimum lot area and setbacks811.
  3. If no sewer is available, start the septic site and soil evaluation with the Southeast Utah Health District18.
  4. Submit the building permit application with plans in triplicate14.
  5. Build, and have the city building inspector inspect the work6.
  6. Obtain the permit of occupancy before moving in7.

What stays with Carbon County, and what to check before you buy in Wellington

Land outside Wellington's city limits falls under the county. Carbon County's rules for unincorporated land, including its driveway road encroachment permit, are on the Carbon County page.

Building permits expire if work is not begun within 90 days or substantially complete within two years14. Carbon County's effective property tax rate is 0.6%20.

Watch-outs

  • Wellington's land use code copy we reviewed is dated August 27, 2008, so confirm current amendments with the Wellington City Office before relying on a lot size or setback1.
  • We could not confirm whether Wellington has an owner-builder exemption, which building code edition the city enforces, or permit fees; ask the Wellington City Office13.
  • A single-family lot outside city limits is a different jurisdiction with different rules; check the parcel's address against city limits before you rely on this page21.

Unanswered questions are usually a sign that Wellington publishes no rule on the point, not that none exists. Carbon County’s page lists the county offices to call.
