Does Brenham, Texas have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Brenham divides the land inside its limits into 10 districts, and its zoning ordinance is Appendix A of the Brenham Code of Ordinances1. Districts include R-1, R-2, R-3, business districts B-1 to B-4, an industrial district, planned development and downtown overlay districts8.

In the R-1 single-family district, no building may go on a lot smaller than 7,000 square feet7. R-1 front and rear yards are at least 25 feet, and side yards are at least 10 feet9. Buildings, accessory buildings and other impervious surfaces together may cover no more than 55 percent of an R-1 lot10, and buildings may not exceed 35 feet in height11.

The figures above are for the R-1 district only7. Check your parcel's district on the official zoning map before you rely on them.

Do you need a building permit in Brenham, and who issues it?

Yes. Inside Brenham city limits, the city says an application should be made and a permit obtained before any construction starts, covering new homes, additions and accessory buildings23. Painting, flooring, cabinets and counter tops do not need permits2.

The City of Brenham's Development Services department handles building permits, and applications go through the city's online permit portal12. Driveways inside city limits are also listed among work that needs a permit13. The city publishes a fee schedule for permits, applications and inspections14.

For construction, the city follows the 2021 international building codes and the 2020 National Electrical Code5.

Who is the Brenham building department and how do you reach it?

The City of Brenham Development Services department is at 200 W. Vulcan St., Brenham, TX 77833, phone 979-337-72203. Its portal handles building, health, fire, sign, solicitor and planning permits3.

The same department takes planning applications such as plats, rezoning and variances, and the city publishes a floodplain permit application for work in flood-prone areas3. Dividing land inside the city is regulated under the city's subdivision chapter15.

Can you live in an RV, tiny home or manufactured home in Brenham?

Manufactured homes are allowed only in the R-3 district, on a lot that is an existing R-3 lot or meets R-1 minimum lot standards, with yards that meet R-1 standards6. Mobile home structures are prohibited inside city limits6.

Accessory dwelling units are listed as a specific use in R-1, but the detailed standards are not something we could confirm16. We also could not confirm rules for RV living, temporary camping or tiny homes inside Brenham, so ask Development Services at 979-337-7220 before you buy3.

The easier rules apply outside city limits: unincorporated Washington County has no county zoning, so no county rule limits RV or tiny-home occupancy there17. See the Washington County page for that land.

How do septic permits work inside Brenham?

Washington County Environmental Health administers septic permitting throughout Washington County18, and its OSSF order covers the whole county except areas regulated under an existing order, ordinance or resolution4. A permit is required for any new, altered, repaired or enlarged septic system, regardless of acreage19.

We could not confirm whether a lot inside Brenham city limits is covered by that county order or by a city ordinance. Most city lots connect to public sewer; for any lot without a sewer connection, call Washington County Environmental Health at 979-277-6290 and Brenham Development Services at 979-337-7220183.

Building a home in Brenham: the steps, in order

  1. Confirm the zoning district and its lot, yard and height rules with Development Services, 979-337-722013.
  2. Settle sewer or septic: ask Washington County Environmental Health and the city who permits it for your lot18.
  3. Submit your building permit application and plans through the city's online permit portal12.
  4. Start construction only after the permit is issued; the work is built to the 2021 international building codes and the 2020 National Electrical Code52.
  5. Schedule inspections through the portal or by phone3.

What stays with Washington County, and what to check before you buy

Septic permitting is the main item that sits with Washington County rather than the city4. Land outside Brenham city limits follows county rules instead: Washington County does not require a building permit in its unincorporated areas, though septic, floodplain and driveway permits still apply20. The Washington County page covers that land.

Before buying, ask which side of the city limit the parcel falls on, because that decides whether the city's permits and zoning or the county's rules apply. Washington County's effective property tax rate is 1.1%21.

Watch-outs

  • Rules above are for land inside Brenham city limits; a parcel just outside is governed by Washington County, which does not require a building permit in unincorporated areas but does require septic permits2019.
  • We could not confirm who permits septic systems on lots inside Brenham city limits, or the rules for RVs, tiny homes and minimum dwelling size; call Development Services at 979-337-72203.
  • The lot, yard and height numbers shown are for the R-1 district only; R-3 allows a taller building, and other districts differ11.
