Do you need a building permit in Trinidad, Texas?
Yes. Trinidad's code says no building or structure may be constructed, installed, built or altered until a city permit has been issued, and the permit must not have expired1. Required permits expire 120 days after issuance, and an expired permit can be renewed for 30 days after expiration for a renewal fee8. Starting work before getting the permit doubles the fees1.
The city adopted the 2015 International Residential Code for one- and two-family dwellings and townhouses4. New residential construction costs a $450 flat fee plus $0.10 per square foot, and residential remodeling costs $3505. A final inspection must find the building compliant before the building official issues a certificate of occupancy or completion6.
Who issues building permits in Trinidad, and how do you reach them?
The City of Trinidad issues building permits through its Permit Department, which lists the city phone line 903-778-25259. City Hall is at 100 Park Street, open Monday through Friday10.
The city's posted fee schedule also lists a certificate of occupancy at $75 and a special use permit or mobile home permit at $3009. Henderson County's development office handles floodplain matters only outside city limits, so inside Trinidad the city is the office to call, not the county planning counter.
Does Trinidad have zoning, and what does it mean for RVs and tiny homes?
Trinidad has a zoning chapter, Chapter 151 of the city code, which adopts its zoning document by reference2. We could not read the referenced district rules, so we cannot confirm minimum lot sizes, setbacks, minimum home size, RV occupancy, tiny-home occupancy or accessory dwellings in any Trinidad district. Ask the City of Trinidad Permit Department at 903-778-2525 which district a parcel is in and what that district allows before you buy9.
Do not assume the county's rules apply. Henderson County itself has adopted no county zoning ordinance, so the county's lighter rules cover only unincorporated land11.
How do septic permits work inside Trinidad?
Trinidad's utility code requires occupied buildings in city-water-service areas to connect to city water and wastewater, with an authorized on-site septic system as the exception for sewer service3. A property abutting a public way with a public water supply and within 200 feet of the water line is deemed to have city-water access3. Texas requires a permit and approved plan to construct, alter, repair, extend or operate a septic system12.
We could not confirm which office permits a septic system inside city limits. Henderson County Septic Services at 903-257-9057 publishes the county's septic permit application, so call it and the city together before counting on a septic system13.
Building a home in Trinidad: the steps, in order
- Call the City of Trinidad Permit Department at 903-778-2525 and confirm the parcel's zoning district and whether city water and sewer reach it93.
- Ask whether the lot is a legal lot or needs to go through the city's subdivision code first7.
- Get the city building permit before any work starts, because fees double if work begins first1.
- Build to the city's adopted 2015 residential code4.
- Finish within the 120-day permit window or renew within 30 days8.
- Pass the final inspection to receive the certificate of occupancy6.
What stays with Henderson County, and what to check before you buy
Land outside Trinidad city limits is a different case: see the Henderson County page for unincorporated rules. Henderson County's floodplain administration covers areas outside any city limits14.
Wells in Henderson County fall under the Neches and Trinity Valleys Groundwater Conservation District, which requires a drilling permit for non-exempt wells15. We could not confirm a separate city well rule inside Trinidad. A driveway onto a state highway needs a TxDOT permit on Form 105816. County-level figures: Henderson County's effective property tax rate is about 1%17.
Watch-outs
- The city's zoning document is adopted by reference and we could not read its district rules, so confirm lot size, setbacks, RV and tiny-home rules with the Permit Department before buying2.
- The city's code requires owners to connect to city water and sewer where service is available, so a septic-only plan can be refused in those areas3.
- Starting work before the permit is issued doubles the permit fees1.
- We could not confirm an owner-builder exemption from city permits; Texas trade-license exemptions do not replace the city building permit, so ask the Permit Department9.
