Do you need a building permit in Ayr Township, Pennsylvania?

Yes. Ayr Township requires a UCC building permit before construction or building work covered by Pennsylvania's Uniform Construction Code begins.1 The statewide UCC governs construction in the township, and Fulton County's comprehensive plan says every county municipality elected to administer and enforce the code locally.3

Pennsylvania's current municipal contact list identifies Ayr Township as an opt-in municipality and provides a phone number for its Building Code Official.9 Call that office before work begins to confirm the application, fee, plans and inspection sequence for the project.

A construction code official must inspect permitted work, and a covered residential building cannot be occupied until a building code official issues a certificate of occupancy.1011

Who issues building permits in Ayr Township?

Ayr Township administers the UCC locally, and Pennsylvania's municipal contact list supplies the township Building Code Official's phone number.39 That office is the first call for UCC building-permit applications, inspections and occupancy approval.

Keep building-code review separate from land-development review. Ayr Township regulates subdivision and land development, while the Fulton County Planning Commission reviews submitted plans before the township acts.6 Fulton County Planning & Mapping can answer county-review and mapping questions, but Ayr Township's Board of Supervisors decides township subdivision and land-development applications.1213

Current township building and land-development fee amounts could not be confirmed. The subdivision ordinance says its application fees are set by Board of Supervisors resolution, so request the current schedules from the Township Municipal Office and Building Code Official.14159

Does Ayr Township have zoning, lot-size or setback rules?

Fulton County's planning FAQ identifies McConnellsburg Borough as the county municipality with zoning and does not identify Ayr Township, so Ayr Township has no identified local zoning code or zoning districts.216 No zoning does not mean no land-development standards.

For residential subdivision lots, Ayr Township's ordinance ties minimum area to utilities: a lot without public water or sewer must have at least 43,560 square feet and room for original and replacement absorption beds; the minimum is 21,780 square feet with public water but no public sewer, and 9,000 square feet with both.7 Those are subdivision standards, not a township-wide zoning schedule.

Residential subdivision setbacks also vary with utilities. Without public utilities, the ordinance requires the greater of 35 feet from the road right-of-way or 60 feet from the road centerline, plus 10-foot side and 25-foot rear setbacks.17

How do septic permits work inside Ayr Township?

Ayr Township's Sewage Enforcement Officer handles on-lot sewage permitting and enforcement inside the township.418 Pennsylvania generally requires a local-agency permit before installing, constructing, altering, repairing or connecting an individual or community sewage system, or occupying a building that will use one.19

Make septic feasibility an early purchase contingency: only 3.9% of Fulton County soils are rated without severe limitations for a conventional septic drain field.20 That county-level measure does not decide whether a particular Ayr Township parcel will pass a site evaluation.

Where no municipal sewer is available, Ayr Township's subdivision ordinance allows an individual on-lot septic system or another satisfactory disposal method, subject to township, site and regulatory requirements.21 Ask the Sewage Enforcement Officer about testing, the permit application, inspections, exemptions and current fees before choosing a homesite.18

Can you live in an RV or tiny home in Ayr Township?

We could not confirm an Ayr Township rule that resolves long-term RV occupancy, temporary camping, tiny-home occupancy or a minimum dwelling size. The absence of identified local zoning does not by itself approve residential occupancy.2 Ask the Township Municipal Office how the proposed use is classified and ask the Sewage Enforcement Officer what sewage approval is required before using an RV or tiny home as living quarters.1518

A tiny home that qualifies as a building or dwelling can still require a UCC building permit, inspections and a certificate of occupancy.11011 A manufactured home also remains subject to UCC rules for site preparation, foundations, utility work, additions, repairs, relocation or occupancy changes where the state rule applies.22 Confirm the unit's classification before purchase.9

Building a home in Ayr Township: what are the steps?

  1. Call Ayr Township's Building Code Official for the correct UCC building-permit application, current fee and plan requirements.9
  1. Contact the Sewage Enforcement Officer before fixing the house location, and confirm the parcel's on-lot sewage tests, permit and inspection requirements.418
  1. Ask the Township Municipal Office whether the proposal triggers subdivision, land-development, stormwater or floodplain review.615
  1. Resolve driveway access: a subdivision or land development using a township road needs township highway-occupancy approval, while access to a state highway needs PennDOT approval.23
  1. Obtain the UCC building permit before covered work starts and schedule required inspections as construction progresses.110
  1. Obtain the certificate of occupancy before using the completed covered residence.11

What should you check before buying land in Ayr Township?

Confirm the recorded parcel, road ownership, utility availability and whether a split or development proposal requires township approval and county planning review.6 Fulton County Planning & Mapping can help with county maps and review questions.13

Check sewage feasibility before relying on a proposed homesite because Fulton County's soil rating is unfavorable for conventional drain fields.20 If public water or sewer is accessible to a high-density subdivision and has capacity, Ayr Township's ordinance can require connection; otherwise, subdivision lots may use qualifying individual water and sewage systems.2425

Ask the Township Municipal Office about floodplain and stormwater review, and identify whether driveway access is from a township or state road.1523 We could not confirm a separate Ayr Township private-well permit rule, so ask the township before drilling.15

Watch-outs

  • No identified Ayr Township zoning does not mean no approvals: UCC building permits, sewage permits, subdivision review and floodplain rules can still apply.2156
  • Only 3.9% of Fulton County soils are rated without severe limitations for a conventional septic drain field, so check sewage feasibility before committing to a homesite.20
  • Ayr Township's lot-size and setback figures apply to residential subdivision lots under the subdivision ordinance, not as a general zoning schedule for every existing parcel.717
  • Long-term RV occupancy, temporary camping, tiny-home occupancy and a township minimum dwelling size remain unconfirmed; ask the Township Municipal Office and Sewage Enforcement Officer before relying on those uses.1518
