Zoning, building permits and septic rules in Yachats, Oregon

Inside Yachats, Oregon, the City Planner reviews a building application first, then Lincoln County's Building Division issues the building permit and does every inspection12. Yachats publishes its own zoning districts and zoning maps3. We could not confirm who issues septic permits inside city limits, so ask the Lincoln County Onsite Waste Management Division4.

Does Yachats have zoning, and what are the R-1 lot and setback rules?

Yes. The City of Yachats publishes its own zoning code, with designated use zones and zoning maps3. In the R-1 Residential Zone the minimum lot is 7,500 square feet where both public water and public sewage serve the lot, and 20,000 square feet where public water serves it but public sewage cannot practically reach it5. Front yards are 20 feet, street side yards are 20 feet and rear yards are 10 feet6. Buildings, porches and decks may cover no more than 30% of the lot10, and no R-1 building may exceed 30 feet7. Other Yachats zones have their own standards, so confirm your parcel's zone with the City Planner1. Splitting a lot is a separate city approval under the partition and subdivision chapter11.

Do you need a building permit in Yachats, and who issues it?

Yes for new construction: the Lincoln County Building Division states that any new construction or any addition, alteration or repair to an existing building requires a building permit2. In Yachats the permit is a two-step handoff. The applicant submits drawings and a site plan to the City Planner, who checks code compliance and water and sewer availability and sets system development charges. The City then forwards the approved application to Lincoln County, which reviews structural, electrical, plumbing and mechanical work, issues the permit and runs all inspections1. The Building Division confirms it issues permits and inspects for Yachats and four other cities2. Oregon builds to the Oregon Residential Specialty Code for one- and two-family homes12. We could not confirm the city's fee amounts; ask the City Planner.

How do septic permits work inside Yachats?

We could not confirm who issues septic permits for lots inside Yachats city limits. The city's code treats private sewage disposal as a subject, but we could not verify the operative sections. Lincoln County's Onsite Waste Management Division administers septic permits as a contract agent of Oregon DEQ13, and DEQ contracts with local jurisdictions in most Oregon counties14. The county's published septic procedures are described for unincorporated land, so call the division to learn whether your lot is on city sewer, needs a site evaluation, or needs a permit4. The City Planner also checks water and sewer availability as part of every building application1. The R-1 lot-size rule shows why it matters: a lot that sewer cannot practically serve needs 20,000 square feet5.

Can you live in an RV or tiny home on your land in Yachats?

Only briefly, and only while building. In the Yachats R-1 zone, an RV may be used as a dwelling only during construction of a new dwelling, or a remodel that makes an existing home uninhabitable, and a building permit must be issued for that work8. Construction must start within 90 days of placing the RV, and the RV must leave within one year of construction starting8. We could not confirm rules for tiny homes or for RV living in Yachats zones other than R-1, so ask the City Planner before buying1. Lincoln County's RV and tiny-home rules apply to unincorporated land, not to lots inside Yachats; the Lincoln County page covers land outside the city.

Can you put a manufactured home on a Yachats lot?

Yes, with conditions. In the R-1 zone, single-family manufactured homes on individual lots are allowed if they are multi-sectional and enclose at least 1,000 square feet15. The home also needs an excavated and backfilled foundation with skirting, must meet thermal-envelope and HUD-insignia requirements, and must satisfy the zone's lot, yard, height and coverage rules15. The 1,000-square-foot minimum applies to manufactured homes; we did not verify a general minimum floor area for site-built houses16. Accessory dwelling units inside the city are unconfirmed, so ask the City Planner1.

Building a home in Yachats: the steps, in order

  1. Confirm your parcel's zone and lot-size category with the City Planner1.
  2. Check water and sewer availability and the septic question with the city and the county septic division14.
  3. If the lot is in a flood-prone area, a development permit is required before construction begins17.
  4. Submit the building permit application, contractor's responsibilities form, three sets of drawings and a scaled site plan to the City Planner1.
  5. Pay the city's fees; the city forwards the application to Lincoln County1.
  6. Lincoln County reviews, issues the building permit and inspects throughout construction2.
  7. If you build it yourself, Oregon's owner-builder option requires a signed owner statement before the permit issues9.

What stays with Lincoln County, and what to check before you buy in Yachats

Watch-outs

  • Septic authority for lots inside Yachats city limits is unconfirmed, so call the Lincoln County Onsite Waste Management Division before you make an offer4.
  • Do not rely on Lincoln County's unincorporated-area RV, tiny-home or lot-size rules inside Yachats; the city's residential-zone rules limit RV living to the construction period8.
  • A lot that city sewer cannot practically serve needs 20,000 square feet in R-1, nearly triple the 7,500-square-foot minimum5.
