Zoning, building permits and septic rules in the Town of Arapaho, Oklahoma

The Town of Arapaho, Oklahoma requires a separate building permit from the Town Clerk for each building or structure built, placed, moved or altered inside town limits1. The town also regulates land use under its own zoning chapter2. Septic systems need a state DEQ Authorization to Construct3; how that applies inside town limits we could not confirm.

Does Arapaho, Oklahoma have zoning, and what does it mean for lot size and setbacks?

Yes. The Town of Arapaho classifies and regulates the use of land, buildings and structures within its corporate limits under Chapter 154 of its code2. Which rules apply to a parcel depends on its district and the official zoning map, so confirm the district with the Town Clerk before you buy.

In the R-1 Residential District, a single-family dwelling needs a lot of at least 5,000 square feet, and a two-family dwelling needs at least 6,000 square feet5. A garage apartment on the same lot as a single-family home needs at least 6,000 square feet of lot area8. R-1 front yards are generally at least 25 feet, and interior-lot side yards are at least 5 feet for a one-story dwelling or 10 feet for a taller one6.

We could not confirm Arapaho's rules on minimum home size, lot coverage or building height.

Do you need a building permit in Arapaho, and who issues it?

Yes. Inside Arapaho town limits, you need a separate building permit for each building or structure you erect, enlarge, relocate, repair, place, alter, move or demolish, including mobile and modular homes, and you get it from the Town Clerk's office19. The town has adopted the State Uniform Building Code along with plumbing, electrical, housing and fire-prevention codes4, and permitted premises are inspected10.

The permit fee is set by the Town Board of Trustees, and we could not find an amount in the code11. The Board also sets application procedures and hands them to applicants when they apply12. Ask the Town Clerk for the current fee and procedure. We could not confirm whether Arapaho offers an owner-builder exception or issues certificates of occupancy.

How do septic permits work in Arapaho?

Oklahoma's Department of Environmental Quality (DEQ) runs the statewide on-site sewage program, and installing or modifying a system requires a DEQ Authorization to Construct, which is assigned to the local DEQ Environmental Specialist for review313. New installations must be inspected and approved by DEQ, or self-inspected and approved by a certified installer, before use13.

We could not confirm any separate town septic rule inside Arapaho limits, or whether the town requires sewer connection. Ask the Town Clerk whether municipal sewer serves the lot, and call DEQ if it does not. County-wide, about 19% of soils rate "not limited" for a conventional drain field14, so expect a site evaluation.

Can you live in an RV or tiny home in Arapaho?

We could not confirm Arapaho's rules on long-term RV living, temporary camping or tiny homes on private land. The town's code has manufactured-home and RV-park provisions, but we did not confirm what they allow on a private lot. Because the town zones land, do not assume the answer matches the rest of Custer County. Ask the Town Clerk in writing before you park an RV or place a tiny or manufactured home.

Outside town limits, Custer County says it has no zoning or fire safety and health regulations beyond those set by state statute or city ordinance15. That county statement does not apply inside Arapaho.

Building a home in Arapaho: the steps, in order

  1. Ask the Town Clerk for the zoning district of the lot and the current permit fee and procedure212.
  2. Check lot size and setbacks for that district; R-1 sets 5,000 square feet and a 25-foot front yard as a starting point56.
  3. If the lot has no sewer, get a DEQ Authorization to Construct before installing a septic system3.
  4. Get the town building permit from the Town Clerk before work starts1.
  5. Arrange the inspections the town's building official requires10.
  6. For a private domestic water well, Oklahoma requires no water permit for domestic use of groundwater7; we could not confirm a separate town well rule.

What stays with Custer County, and what to check before you buy

Custer County has no building permit requirement in unincorporated areas, but that rule covers land outside town limits, not Arapaho lots16. For land outside the town, see the Custer County page. The county does require a permit for any encroachment on county rights-of-way16, and a development permit for projects in a special flood hazard area, with information at the Commissioner's Office in the courthouse at Arapaho1718.

For a lot on a state highway, an ODOT driveway agreement is needed before work in the right-of-way19. Custer County's effective property tax rate is about 0.7%20.

Watch-outs

  • Do not assume Custer County's no-permit rule for unincorporated land applies in Arapaho; inside town limits a Town Clerk building permit is required116.
  • The permit fee, application procedure and any owner-builder exception are not published in the code we reviewed; ask the Town Clerk before you budget1112.
  • Septic, well, flood-zone and RV rules inside town limits are unconfirmed; ask the Town Clerk and call DEQ before you buy a lot without sewer3.
