Does the Village of Clyde have zoning, and what does it mean for lot size and setbacks?

Yes. The Village of Clyde administers its own zoning under Chapter 190, and no building or land may be used or built on except in conformity with the regulations for its district1. The districts are R-1, R-2, PD, C-1, C-2 and M-1, plus an Open Land district5.

In the R-1 Low Density Residential District, the minimum lot area is 15,000 square feet7. The rear yard is 40 feet and side yards total 30 feet, with neither under 10 feet12. Lot coverage is capped at 25%13.

In R-2 Medium Density Residential, the minimum lot area is 10,000 square feet8. The rear yard is 20 feet and each side yard is 10 feet14. Any single-family dwelling in the village must have at least 1,000 square feet of living space, which rules out most tiny homes6.

Do you need a building permit in the Village of Clyde, and who issues it?

Yes. Inside the Village of Clyde, a building permit is required for all work that must conform to the Uniform Code, and the village code enforcement officer issues it2. Listed exemptions exist, such as playground equipment and certain pools2. New York's state rules also let a local program exclude some small detached sheds up to 144 square feet, though excluded work must still meet the code15.

The village enforces the state Uniform Fire Prevention and Building Code and the Energy Code16. The permit holder must notify the officer when work is ready for inspection17. A certificate of compliance is required for all permitted work11. We did not confirm the village's permit fees; ask the village office18.

How do septic permits work inside the Village of Clyde?

We could not confirm who reviews septic systems for an address inside the Village of Clyde. New York approval for onsite systems can come from a city health department, a county health department or a district office of the State Department of Health, depending on the property10. Alternative systems need plan approval from the State or county health department official before construction19.

Most village lots may be on public sewer, but we have not confirmed that for any address. Ask the village office whether the lot connects to village sewer18, and call Wayne County Public Health to confirm which health office would review a septic plan4. The permit rule is not the whole picture: Wayne County's soil survey rates only 11.4% of soils as not limited for a conventional drain field, so a site evaluation is likely20.

Can you live in an RV or tiny home in the Village of Clyde?

We could not confirm that living in an RV is allowed or prohibited inside the village. The only rule we found is a parking and storage rule: campers and recreational vehicles may not be parked or stored outdoors in a residential front yard except in the established driveway, and must sit at least two feet from a side lot line and five feet from a rear lot line9. That rule does not address sleeping in one.

For tiny homes, the village requires 1,000 square feet of heated living space in a single-family dwelling6. Manufactured homes are allowed as single-family dwellings in R-1 and R-2 under Appendix C of Chapter 19021. Ask the code enforcement officer before buying a lot for an RV or small dwelling18.

Building a home in the Village of Clyde: the steps, in order

  1. Confirm the district (R-1, R-2 or another) and the lot size, setbacks and height limits for it with the code enforcement officer518.
  2. Check height: R-1 allows 35 feet and 2 1/2 stories, and R-2 allows 40 feet and three stories2223.
  3. Apply for a building permit from the village code enforcement officer2.
  4. Confirm water, sewer or septic arrangements with the village office and Wayne County Public Health4.
  5. Call for inspections as work is ready, and keep work uncovered until it is inspected17.
  6. Get a certificate of compliance before you occupy the building11.

What stays with Wayne County, and what to check before you buy in Clyde

Wayne County does not zone land; each town and village sets its own zoning ordinance3. The county does not issue building permits for the village either24. What stays with the county is septic review contact through Wayne County Public Health4 and driveway culvert permits on county roads, which cost $400 per 20-foot length of pipe25. A driveway onto a state highway needs a permit from NYSDOT26.

Flood rules are set by the village, and the village code has a Flood Damage Prevention chapter we did not open; ask the code enforcement officer18. Land outside the village is covered on the Wayne County page. Wayne County's effective property tax rate is 2.6%27.

Watch-outs

  • Village rules apply only inside Clyde village limits; land in the surrounding town has its own zoning and permit office, so confirm the parcel is inside the village28.
  • We could not confirm building permit fees, the village's driveway rules or its floodplain rules; ask the village office18.
  • Village zoning referrals can go to the Wayne County Planning Board, but final decisions are made by local boards28.
