Do you need a building permit in the Town of Rochester, NY?
Yes. The Town of Rochester requires a building permit for any work that must conform to the state Uniform Code or Energy Code, including construction, enlargement, alteration, removal or relocation of a building or structure2. Listed exemptions exist, but they do not apply where zoning or another town code provision requires a permit2. Work cannot start until the permit is issued8.
The state sets the baseline: the Uniform Code applies in every New York town outside New York City, and a town cannot exclude itself from it9. The 2025 Uniform Code governs permit applications filed since December 31, 202510.
Nonresidential farm buildings used directly and solely for agriculture have a conditional exemption, but zoning or other town code provisions may still require a permit7. We could not find an owner-builder permit exemption in the town's building chapter, so assume an owner building their own home still needs the permit.
Who issues building permits in the Town of Rochester, and how do you reach them?
The town's own Code Enforcement Officer issues building permits inside the Town of Rochester, not Ulster County2. The town's Buildings and Code Enforcement office says all permit applications begin there, even for projects that also need planning board review, and that applications go through its GovWell online portal11. Applications must be written on a form acceptable to the Code Enforcement Officer and signed by the owner or an authorized agent8.
Call the office at (845) 626-2433 or email [email protected]11. For zoning questions, the town's Planning & Zoning office is a separate line12.
Ulster County's building-code role covers only localities that have opted out of running their own program and county-owned buildings13. Rochester has its own permit chapter, so the county counter is the wrong office for a private building permit here2.
Does the Town of Rochester have zoning, and what does it mean for RVs, tiny homes and setbacks?
Yes. The Town of Rochester has its own zoning law, Chapter 140, adopted by the Town Board in 20141. Ulster County does not zone: New York gives zoning power to cities, towns and villages, not counties14.
Districts set the numbers. In the R-1 Neighborhood Residential District, lot coverage is capped at 40% and buildings at 35 feet and 2.5 stories1516. Manufactured housing parks are allowed only as special uses in the AR-3 and R-2 districts, on parcels of at least 15 acres with at least 200 feet of road frontage, and they need a town license6.
We could not confirm town rules on living in an RV, tiny-home occupancy, accessory dwelling units or minimum home size. For a tiny house, state code treats one built to Appendix BB as a dwelling, but local zoning and wastewater rules still apply17. Ask the Planning & Zoning office before you buy12.
How do septic permits work in the Town of Rochester?
Septic plans for Ulster County, including the Town of Rochester, are reviewed and approved by the Ulster County Department of Health, which also handles plan review for residential systems318. The county says that most townships require approved septic plans before issuing a building permit, so start with the health department, then apply to the town18.
Plans must come from a New York-licensed professional engineer or registered architect, and at least two copies go to the county for approval19. County field representatives check the installed system during construction20. The county notes that review can take up to 6 months on smaller residential properties18.
We could not confirm whether the town adds its own septic or well requirements. Ask the town's Code Enforcement office, and the county health department for well questions. Soils matter here: the share of county soils rated not limited for a conventional drain field is 0%, so expect a site evaluation and often an engineered system21.
Building a home in the Town of Rochester: the steps, in order
- Call the town's Planning & Zoning office to confirm your district and whether the use you want is allowed112.
- Get septic plans designed by a licensed engineer or architect and approved by the Ulster County Department of Health19.
- Apply for the building permit through the Code Enforcement office and its online portal11.
- If the project needs planning board review, or you are dividing land, expect that review and county map steps to come first; a conditionally approved plat does not authorize building permits until it is signed and recorded22.
- Keep work exposed until the Code Enforcement Officer inspects it4.
- Get a certificate of occupancy before using or occupying the building5.
What stays with Ulster County and the state, and what to check before you buy in the Town of Rochester
Septic review stays with the Ulster County Department of Health3. A driveway onto a state highway needs a NYSDOT permit23; we could not confirm a town driveway permit for local roads. Land outside the town is covered on the Ulster County page.
Check floodplain status too: private development in a mapped flood hazard area needs a local floodplain permit24. The town code has a floodplain section, but we could not confirm its permit details.
County-level context: Ulster County's effective property tax rate is 1.9%25, and about 88.7% of the land is wooded26.
Watch-outs
- Paper building permit applications are no longer accepted by the town except for zoning applications and short-term rentals; use the online portal11.
- Zoning, building permits and septic are three different offices here: the town issues building permits and sets zoning, while Ulster County Department of Health reviews septic23.
- We could not confirm the town's rules on RVs, tiny homes, accessory dwellings, minimum home size, wells or short-term rentals; call the town's Planning & Zoning office before you commit12.
- Septic design review can take up to 6 months on smaller residential properties, so start it before you schedule construction18.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
