Do you need a building permit in the Town of Esopus, New York?

Yes. Inside the Town of Esopus, no one may start building, enlarging, altering, demolishing or changing the occupancy of a building or structure without a separate building permit from the Building Inspector, and only ordinary non-structural repairs are exempt2. An application is required for any proposed work except work costing less than $250 for labor and materials6.

The Town of Esopus accepted the New York State Uniform Fire Prevention and Building Code, so the state code is what the Building Inspector enforces9. New construction carries a fee of $0.50 per square foot, and decks count as new construction5. The Building Inspector must approve or disapprove an application within 30 days after filing6.

A certificate of occupancy or certificate of compliance is not issued unless the required inspections and approvals were completed, and the owner or agent must tell the Building Inspector when work is ready for inspection10.

Who issues building permits in the Town of Esopus, and how do you reach them?

The Town of Esopus Building Department issues building permits for land inside the town2. The Town Hall is at 1 Town Hall Way, Ulster Park, NY 12487, and the department's phone number is 845-331-863011. Planning Board and Zoning Board of Appeals questions go to [email protected]12.

For logging or blasting permits, the Town directs applicants to the Building Inspector's office during normal business hours11. If a project creates a new footprint or any ground disturbance, including land clearing, grading or a septic system, Town local law requires an EAF mapper run to be given to the building department before work starts11.

The Ulster County code-enforcement program covers only localities that have opted out of running their own; Esopus issues its own building permits, so the County is not the office for building permits here2.

Does the Town of Esopus have zoning, and what does it mean for lot size, RVs and tiny homes?

Yes. The Town of Esopus divides its land into zoning districts, and use in each district follows the Schedule of Permitted Use Regulations1. The Official Zoning Map is kept up to date in the Town Clerk's office, and the code identifies residential, mixed-use, industrial, waterfront, overlay, floating-zone and planned-unit-development districts13. Check the district for the exact parcel before you buy.

We could not confirm the minimum lot size, setbacks or lot coverage for any district, so ask the Building Department for the District Area and Bulk schedule for the parcel. We also could not confirm whether the Town allows living in an RV, camping on private land, or a tiny home as a dwelling, so get the answer from the Town in writing before relying on any of them.

New York counties do not zone unincorporated land themselves14, which is why the Town's code, not Ulster County, decides these questions inside Esopus.

Can you build an accessory dwelling unit in the Town of Esopus?

Yes, on eligible lots. Accessory dwelling units are allowed in the Town of Esopus under the Schedule of Permitted Use Regulations, limited to a lot whose principal use is a detached one-family dwelling7. An ADU must be at least 400 square feet, no larger than 750 square feet or the principal home's livable area, whichever is less, with no more than two bedrooms8. Attached or exterior ADUs may not exceed 15 feet in height15.

Interior and attached ADUs may be permitted by right with a building permit, while exterior ADUs on lots under twice the required minimum lot size need Planning Board site-plan review7. An ADU cannot be a short-term rental for five years after its certificate of occupancy is issued16.

How do septic permits work inside the Town of Esopus?

Septic permits in Ulster County come from the Ulster County Department of Health, Environmental Health Division, which covers residential onsite wastewater systems3. Constructing an onsite wastewater treatment system requires a permit and an inspection of the finished system417. The Town's own code does not name the septic authority for Esopus, so confirm with the County health office that it handles your parcel.

Expect septic to come early. Most townships in Ulster County require approved plans before they issue a building permit18, and the Esopus application asks for compliance with State and County Boards of Health rules19. The County asks you to schedule a witnessed soil-profile test pit or deep hole18.

USDA rates none of Ulster County's soils as not limited for a conventional drain field20. That is a strict rating, not a ban, but it means a site evaluation and possibly an engineered system. Call (845) 340-301018.

Building a home in the Town of Esopus: the steps, in order

  1. Find the zoning district for the parcel and ask the Building Department for the area and bulk requirements13.
  2. Call the Ulster County Department of Health to schedule the soil test and get septic plans approved18.
  3. Run the EAF mapper if the project adds a footprint or disturbs ground, and give the result to the Building Department11.
  4. Check driveway needs: the Town application must show compliance with Town, county or state driveway cut permits19. A residence on a state highway needs a NYSDOT permit for a driveway21.
  5. Apply for the building permit with the Building Inspector, who decides within 30 days6.
  6. Schedule inspections as work proceeds and get the certificate of occupancy10.

What stays with Ulster County, and what to check before you buy in Esopus

Ulster County, not the Town, runs septic review3 and subdivision filing and map certification after the local planning board approves a subdivision22. Subdivision of land inside Esopus is regulated by the Town's subdivision chapter and Planning Board23. For land outside the town, see the Ulster County page.

Farm operations in a county-adopted state-certified agricultural district are protected from some Town restrictions, and Esopus's code exempts them from its junk prohibition to the extent needed for the farm24.

For the money side, Ulster County's effective property tax rate is 1.9%25 and the median property tax bill is $6,124 a year26. Ask the Building Department about flood rules for the parcel: the Town code has a Flood Damage Prevention chapter, and development in FEMA-mapped flood hazard areas needs a local permit27.

Watch-outs

  • We could not confirm whether the Town of Esopus allows RV living, temporary camping or tiny-home occupancy, so call the Building Department at 845-331-8630 before you plan on any of them11.
  • We could not confirm an owner-builder exemption from Town building permit rules in Esopus, so ask the Building Inspector whether homeowners can pull their own permit2.
  • Minimum lot sizes and setbacks vary by zoning district, and we could not confirm the values, so get the parcel's district requirements before closing13.
  • Esopus's rules do not apply outside the town; for land elsewhere in Ulster County, use the Ulster County page and that town's own offices1.
