Does Ocean Beach, NY have zoning, and what does it mean for lots and setbacks?

Yes. The Village of Ocean Beach, in Suffolk County, adopts its own zoning chapter, which regulates the height, number of stories and size of buildings and other structures10. The village maps four districts: Residence R-4, Oceanfront Dune (DD), Business (C) and Bayfront Recreation (BRD)2. Suffolk County itself has no direct zoning control, so the village code is the zoning rulebook for any lot inside the village3.

In the Residence R-4 District, a single-family dwelling needs a minimum plot area of 4,000 square feet7 and at least 600 square feet of ground-floor area, not counting sheds, decks or ramps8. A two-story building may not exceed 24 feet in height11. Detached guesthouses, bathhouses or guest rooms that are not part of the principal structure are prohibited in R-412.

Oceanfront, business and bayfront lots follow different district rules we have not summarized here; ask the Building Inspector which district a parcel sits in.

Do you need a building permit in Ocean Beach, NY, and who issues it?

Yes. Inside the Village of Ocean Beach, nobody may erect, enlarge, alter, relocate, demolish or change the occupancy of a building or structure without first obtaining a separate building permit for each building, structure or activity1. The village adopted the New York State Building Code by resolution13. Applications go to the village Building Inspector on the village's form, and the applicant signs a statement of familiarity with the Building Code and Zoning Law14. Fees are set by the Board of Trustees from time to time, and a refundable debris-clearance deposit accompanies the application15.

New construction of 100 square feet or more also needs a certified landscape plan1. The Building Inspector examines the premises once a permit has been issued16. Suffolk County does not issue building permits for private homes; the village does.

Who is the Ocean Beach building department, and how do you reach it?

Building inspection and code enforcement are located in the village office17. Call 631-583-5940 or email [email protected]17. The village website carries the construction permit, fence permit and ordinary repair and maintenance application forms17.

A certificate of occupancy is required before a newly erected or altered building is used or occupied, and a building with permit-required work cannot stay in use more than 30 days after completion without one5.

How do septic permits work in Ocean Beach, NY?

Septic approvals for Suffolk County, including Ocean Beach, come from the Suffolk County Department of Health Services, Office of Wastewater Management, under Article 6 of the Suffolk County Sanitary Code4. The county requires an inspection before use and as-built plans after satisfactory field inspection18. Contact the office at (631) 852-570019.

The village code adds its own layer: where public sewers are unavailable, private wastewater disposal needs village approval and a permit6. Where a community sewerage system is required, an individual system may not be used20. Individual systems are approved only when parcel size, groundwater zone and soil conditions allow21.

Only a sliver of Suffolk County soil is rated not limited for conventional septic drain fields (about 1.2%), so expect a site evaluation and possibly an engineered or advanced system22. We could not confirm village rules on private wells; ask the village office.

Can you live in an RV or tiny home in Ocean Beach, NY?

We could not confirm any village rule on long-term RV occupancy, temporary camping or tiny-home occupancy in Ocean Beach, so do not assume any of them is allowed. Ask the Building Inspector at 631-583-5940 before bringing an RV or tiny home onto a lot17. Any dwelling that is erected or changes occupancy still needs a building permit and a certificate of occupancy15.

Renting is a separate matter: Ocean Beach prohibits transient rentals of dwelling units, meaning occupancy of fewer than seven consecutive days9.

Building a home in Ocean Beach, NY: the steps, in order

  1. Confirm the zoning district of the parcel with the Building Inspector and check lot size and height limits2.
  2. Contact the Suffolk County Office of Wastewater Management about the septic or sewage approval19, and the village about its private wastewater permit if public sewers are unavailable6.
  3. Submit the village building permit application with plans and specifications, and a landscape plan for new construction of 100 square feet or more1.
  4. Build to the New York State Building Code and expect inspections1316.
  5. Obtain a certificate of occupancy before using the building5.

What stays with Suffolk County, and what to check before you buy in Ocean Beach?

Septic and wastewater approvals stay with Suffolk County's health department4. For land outside the village, see the Suffolk County page. Suffolk County's typical home value is about $726,69223, and its effective property tax rate is 1.9%24; these are county-level figures, not Ocean Beach's.

Before buying, ask the village office which zoning district applies, whether the lot meets the minimum plot area, and whether a driveway, well or agricultural use is addressed anywhere in the village code, since we could not confirm village rules on any of those.

Watch-outs

  • Rules in this guide apply inside the Village of Ocean Beach only, where the village zoning chapter governs; for land elsewhere in Suffolk County, use the county page and the local town or village office10.
  • Private-well rules, owner-builder provisions and driveway access inside the village could not be confirmed, so ask the village office at 631-583-594017.
  • Rentals of fewer than seven consecutive days are prohibited, which matters for any buyer counting on short-term rental income9.
  • Septic needs county approval and, where public sewers are unavailable, a village permit as well46.
