Building permits, zoning and septic rules in the Village of Lloyd Harbor, New York

The Village of Lloyd Harbor in Suffolk County, New York runs its own zoning under Chapter 205 of the village code1. Building work follows the New York State Uniform Fire Prevention and Building Code, and building permits are handled at the village level2. Septic and well approvals sit with Suffolk County, not the village3.

Does Lloyd Harbor have zoning, and what does it mean for lots and setbacks?

Yes. The Village of Lloyd Harbor adopted its own zoning chapter, Chapter 205, in 1966 and amends it by village board action1. Suffolk County has no direct zoning power of its own, so the village, not the county, decides what can be built on a Lloyd Harbor lot8. The code divides the village into 10 districts, including Residence A-1, Residence A-2, floodplain, coastal overlay and estuarine districts4.

In the Residence A-1 District, a vacant lot needs a net lot area of at least two acres, though the code does not require more than five gross acres, and it must contain a potential building site5. A principal building of 6,000 square feet or less must sit at least 60 feet from the front lot line and 40 feet from every other boundary; larger buildings have to be set back farther6. A principal building may cover no more than 7.5% of the gross lot area, and all buildings together no more than 15%9. A new or altered principal residence in A-1 needs at least 1,250 square feet on one story, 1,500 on one and a half stories, or 1,800 on two stories7.

Do you need a building permit in Lloyd Harbor, and who issues it?

Yes. The village's code makes the New York State Uniform Fire Prevention and Building Code the controlling building construction regulation in the Village of Lloyd Harbor2. The state requires building permits for work that must conform to that code, with certain exceptions10. Lloyd Harbor's village Building Department is the office to call for building permits, and it routes applications to the Building Inspector, Village Engineer, Village Arborist, Permit Review Board or Zoning Board as appropriate11.

A drainage plan can be part of the application: the village code bars a building permit for new construction unless the application includes on-site drainage for new roofs, terraces, patios and driveways, where the Building Inspector or Village Engineer find it necessary12. A certificate of occupancy or compliance is required for all work that needed a building permit13.

How do septic permits work in Lloyd Harbor?

Septic approvals for a new home in Suffolk County come from the Suffolk County Department of Health Services' Office of Wastewater Management, not from the village14. Construction of a new home needs prior county approval of the water supply and sewage disposal facilities15. After construction, an inspection must be requested before the system is used16.

On parcels outside an existing sewer district and outside Groundwater Management Zones III, V and VI, the county code ties individual septic systems to parcels of at least 20,000 square feet, with exemptions17. In Zones III, V and VI the threshold is 40,000 square feet18. We could not confirm which zone a given Lloyd Harbor parcel sits in or whether the village adds its own septic rules; ask the Office of Wastewater Management at19.

Can you live in an RV or tiny home on your land in Lloyd Harbor?

We could not confirm a village rule on long-term RV living, camping or tiny homes in Lloyd Harbor. The village zoning chapter has a section titled for motor homes and trailers, but we could not read its operative text, so call the village Building Department before parking or living in an RV on a lot11. Suffolk County's one-camper-per-site limit applies to county campgrounds and says nothing about private land20.

Building a home in Lloyd Harbor: the steps, in order

  1. Call the village Building Department to confirm the district, lot and setback rules for the parcel11.
  2. Check the lot against the zoning rules, such as the A-1 two-acre net lot area and 60-foot front setback56.
  3. Apply to Suffolk County's Office of Wastewater Management for septic and water approval before building15.
  4. Submit the village building permit application with a drainage plan if the Building Inspector or Village Engineer require one12.
  5. Request county inspection of the septic system before use16.
  6. Obtain the certificate of occupancy or compliance for work that needed a building permit13.

What stays with Suffolk County, and what to check before you buy?

Suffolk County handles septic and wastewater approvals for the village3, and a driveway that touches a county road needs a county Highway Work Permit21. Suffolk County has a rate of effective property tax of 1.9%22 and a median bill of $10,001 a year23. Those are county figures, not Lloyd Harbor's alone. For land outside village limits, see the Suffolk County page.

Watch-outs

  • We could not confirm the village's rules on owner-built homes, septic inside village limits, wells, accessory dwellings or tiny homes; ask the village Building Department at (631) 549-264011.
  • Lot, setback and house-size numbers here apply to the Residence A-1 District; other districts such as A-2 and the floodplain and coastal overlays have their own requirements4.
  • Driveway work that reduces existing buffer vegetation in the Residence A-2 District must be found appropriate by the Site and Building Permit Review Board24.
