Zoning, building permits and septic rules in the Village of Greenport, New York

The Village of Greenport, in Suffolk County, New York, requires a building permit before construction starts1. Greenport also runs its own zoning code, which Suffolk County does not do for it23. Septic and wastewater approvals come from the Suffolk County Department of Health Services, not the village4.

Does Greenport, NY have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. The Village of Greenport adopts and amends its own zoning chapter, last rewritten in its entirety in October 20232. Suffolk County has no direct power of zoning, so for any parcel inside village limits the village code is the zoning rule3. The code sets up residence, commercial, waterfront and park districts6.

Rules differ by district. In the R-1 One-Family Residence District, a house needs at least 1,000 square feet of livable floor area8. The lot must be at least 10,000 square feet, 80 feet wide and 100 feet deep9. Setbacks are 30 feet front and rear, 12 feet on one side and 30 feet combined on both sides11. Lot coverage tops out at 30 percent12, and buildings may rise 2.5 stories or 35 feet13.

We could not confirm whether Greenport allows living in an RV, camping on a lot, or a tiny home as a dwelling. Ask the Village Building Department before buying with that plan5.

Do you need a building permit in Greenport, NY, and who issues it?

Yes. The Village requires a building permit before construction begins1. Exceptions cover necessary repairs that do not materially affect structural features, replacement windows and doors, and some minor alterations1. The Village of Greenport Building Department & Code Enforcement, at 236 Third Street, takes applications and answers questions at (631) 477-02485. Suffolk County does not issue these permits.

The application must give enough detail for officials to confirm the work meets the zoning code14. The fee is set from time to time by resolution of the Board of Trustees, so ask the department for the current amount15. Inspections happen during construction16. A certificate of occupancy is required before a new or altered building is used, and the building cannot be occupied more than 30 days after completed permitted work without one17.

A homeowner acting as general contractor on an owner-occupied one- to four-family home can use New York's statewide BP-1 form18. We could not confirm whether the village adds its own owner-builder rules, so ask the Building Department.

How do septic permits work inside Greenport village limits?

Septic and wastewater approvals for new homes in Greenport run through Suffolk County, not the village. A permit is required from the Suffolk County Department of Health Services for a new home or business4. The Office of Wastewater Management in Yaphank handles it at (631) 852-58007.

The village ties the two together: the Building Inspector cannot issue a certificate of occupancy until Suffolk County Department of Health approval is granted in writing17. After construction of an approved system, the county requires an inspection before use19.

For single-family projects on individual systems outside Groundwater Management Zones III, V and VI, the county health rule asks for parcels of at least 20,000 square feet20. Inside those zones the figure is 40,000 square feet21. Greenport's R-1 minimum is only 10,000 square feet9, so a small village lot generally depends on a sewer connection. We could not confirm the village's sewer connection rules or whether a lot needs to connect, so ask the Village Building Department and the county. Suffolk County soils also rate poorly for conventional drain fields, so expect a site evaluation22.

Building a home in Greenport, NY: the steps, in order

  1. Confirm the zoning district and its lot size, setback, coverage and height limits with the Village Building Department65.
  2. If the lot needs to be created or changed, plan for Planning Board approval, because the village regulates subdivision and merger of land23.
  3. Check whether the lot lies in a mapped flood hazard area; development there needs a floodplain development permit10.
  4. Get county wastewater approval from the Suffolk County Office of Wastewater Management47.
  5. File the building permit application with the village1.
  6. Build with village inspections along the way16.
  7. Request the certificate of occupancy, which needs Suffolk County Department of Health approval first17.

What stays with Suffolk County, and what to check before you buy in Greenport

Suffolk County handles septic approvals and private-well water testing; it does not zone land or issue building permits for village lots424. For land outside the village, see the Suffolk County page, because village rules do not apply there.

Rental plans need extra care: the village code places restrictions on short-term rental of dwelling units25. A driveway onto a county road needs Suffolk County right-of-way approval26, and a driveway onto a state highway needs a state permit27. We could not confirm the village's own driveway or curb-cut approval, so ask the Building Department.

On cost, Suffolk County's effective property tax rate is 1.9 percent28, and the typical home value is about $727,00029. Those figures are county-wide, not specific to Greenport.

Watch-outs

  • Greenport's zoning chapter was rewritten in October 2023, so older zoning summaries online may be out of date2.
  • Septic approval comes from Suffolk County, and the village will not issue a certificate of occupancy without it17.
  • We could not confirm village rules on RV occupancy, tiny homes, accessory dwellings or wells; call the Village Building Department at (631) 477-0248 before relying on any of them5.
  • Building in a mapped flood hazard area requires a separate floodplain development permit10.
