Do you need a building permit in Asharoken, NY?

Yes. The Village of Asharoken requires a building permit, and work may not start until the permit is issued and posted where it is visible from the road1. The village has adopted the New York State Uniform Fire Prevention and Building Construction Code9. Suffolk County itself does not issue building permits for private homes; the village does that work inside its limits10.

The fee is $100 for the first $1,000 of cost plus $20 for each additional $1,000, according to the village permit form4. The village says to allow a minimum of four weeks for review11. A new building also needs a certificate of occupancy before anyone uses it8.

Who issues building permits in Asharoken, and how do you reach them?

Applications go to the village clerk at Village Hall, and the village building inspector reviews them12. The clerk can be reached at 631-261-709812. The inspector must be notified five business days before each requested inspection13. Work hours on permitted jobs are weekdays only, with no weekend or federal-holiday work12.

The village permit form also tells applicants that approvals from other agencies must be in hand first, and that a permit will not be issued until they are approved12.

Does Asharoken have zoning, and what does it mean for lot size and setbacks?

Yes. Asharoken adopts its own zoning, and Suffolk County does not zone land214. The village has three residence districts, A, B and C5. Rules differ sharply by district:

  • A district: a building lot needs at least 10,000 square feet and 50 feet of frontage6. Buildings, including accessory buildings, may cover at most 50 percent of the lot15. A dwelling needs at least 1,200 square feet of ground-floor habitable area7.
  • B district: new lots need at least one acre and 100 feet of width16. Yards are 50 feet front, 25 feet side and 50 feet rear17. Building coverage tops out at 25 percent18.
  • C district: new lots need at least two acres and 150 feet of width19. Yards are 75 feet front, 50 feet side and 75 feet rear20.

The village code also requires the access street to be on the official village map before a permit can issue21. We could not confirm height limits, RV or tiny-home rules; ask the village clerk.

How do septic permits work in Asharoken?

The village does not issue septic permits. The village permit form points applicants to the Suffolk County Department of Health for a certificate of approval for sewage disposal, to be obtained before backfilling22. The county office that runs this is the Office of Wastewater Management23. Septic approval is a county function across Suffolk County, city or village24.

Soils matter: USDA rates only about 1% of Suffolk County soils as not limited for a conventional drain field, so expect a site evaluation and often an engineered system25. We could not confirm whether a new home in Asharoken must connect to public sewer or water, or whether a private well is allowed; ask the village clerk and the county health department.

Can you live in an RV or tiny home in Asharoken?

We could not confirm either answer. The village code has a chapter on parking and storage of trailers on residential property, but we have not verified what it says about living in an RV or camper, and we found no tiny-home rule. The A district minimum of 1,200 square feet on the ground floor for a dwelling is a hurdle for a very small home7. Suffolk County has no county zoning of its own on tiny homes26, so the village is the office to ask12.

Building a home in Asharoken: the steps, in order

  1. Confirm the lot's residence district (A, B or C) and check its lot size, frontage and yard rules5.
  2. Confirm the street giving access is on the official village map21.
  3. Get the Suffolk County Department of Health approvals the village permit form calls for, plus any other agency permits123.
  4. File the building permit packet with the village clerk and allow at least four weeks for review11.
  5. Pay the permit fee once the application is approved, then post the permit where it is visible from the road1.
  6. Notify the building inspector five business days before each inspection13.
  7. Obtain a certificate of occupancy, which needs a final survey with elevation certificate before the building is used8.

What stays with Suffolk County, and what to check before you buy in Asharoken

Septic approval, private-well testing and driveway work on county roads stay with Suffolk County rather than the village242728. For land outside the village, see the Suffolk County page.

New construction or an addition must supply an elevation certification after completion29, so check the flood zone before buying. Suffolk County's effective property tax rate is 1.9%30, and the typical home value in the county is about $726,69231.

Watch-outs

  • Asharoken's own zoning chapters on height limits, the full district list and the board of zoning appeals were not confirmed, so ask the village clerk at 631-261-7098 before relying on district rules12.
  • The village fee schedule may set fees beyond the $100 plus $20 per $1,000 shown on the permit form4.
  • Whether the village requires owner-builders to hire a licensed contractor is unconfirmed; ask the village clerk12.
