The Town of Halfmoon, New York requires a Town building permit before work that must meet the state Uniform Code begins1. Halfmoon adopted its own zoning chapter2, and a septic application is filed with the Town's Building Planning and Development Department3. Saratoga County does not zone land4.

Do you need a building permit in the Town of Halfmoon?
Yes. Halfmoon's Town Code says no one may start work that needs a building permit without first getting one from the Town1. The code lists a few exceptions, including certain nonstructural repairs, specified finish work and demolition of agricultural buildings1. New York lets each town choose whether to exempt small detached sheds, and a state-listed exemption never excuses work that violates the Uniform Code8.
Permits are only the start. Work must stay exposed until the Code Enforcement Officer or an authorized inspector accepts it9, and a permitted building may be used or occupied only after the Town issues a certificate of occupancy or compliance6.
Who issues building permits in Halfmoon, and how do you reach them?
The Town of Halfmoon issues its own building permits through its code enforcement office, not Saratoga County10. The county's published building-department list gives the Town's contact as 2 Halfmoon Town Plaza, Halfmoon, NY 12065, phone 518-371-7410 x226011.
Applications are written, on a form the Code Enforcement Officer provides or accepts, signed by the owner or an authorized agent12. Fees come from a schedule the Town Board sets by resolution, so ask the office for the current amounts13.
Does Halfmoon have zoning, and what does it mean for RVs, tiny homes and lot size?
Halfmoon has its own zoning. Chapter 165 of the Town Code was adopted by the Town Board and has been amended since2. The chapter establishes districts including Agriculture-Residence (A-R), R-1, R-2, R-3, office, commercial, industrial and neighborhood business, plus overlay districts5. Saratoga County has no zoning power of its own, because New York gives zoning authority to cities, towns and villages, not counties4.
We could not confirm the minimum lot size, setbacks, minimum home size, RV occupancy, tiny-home or accessory-dwelling rules for any Halfmoon district. Look up the parcel's district on the Town zoning map and ask the Town's code enforcement office before you buy.
How do septic permits work inside Halfmoon?
Halfmoon regulates septic systems itself. The Town code bars installing or altering a septic tank, leaching pit, privy or similar system anywhere in the Town except as Chapter 134 provides14. The owner files an application with the Town's Building Planning and Development Department before starting construction of any part of the waste disposal system3. Systems that New York State permits directly are outside the Town chapter15.
Saratoga County's Department of Health sends single-home systems that are not part of a realty subdivision to the local building department16. The county itself reviews realty subdivisions, which are five or more residential lots of five acres or less within three years17. USDA rates only about 5.5% of Saratoga County soils as not limited for a conventional drain field, so plan on a site evaluation and possibly an engineered system18.
Building a home in Halfmoon: the steps, in order
- Find the parcel's zoning district and confirm your use is allowed5.
- If you are dividing land, check Town subdivision rules in Chapter 143 first7.
- Check flood-prone areas, where the Town regulates filling, grading and other development19.
- File the septic application with the Building Planning and Development Department3.
- Apply in writing for the building permit12.
- Keep work exposed for inspection9.
- Get the certificate of occupancy before moving in6.
A driveway onto a state highway needs a NYSDOT permit20; driveway work in a county right-of-way needs a county permit21. We could not confirm a Town driveway rule.
What stays with Saratoga County, and what to check before you buy
The county's septic and planning offices cover only part of the picture. The county planning board reviews certain zoning and subdivision actions within 500 feet of state or county rights-of-way, municipal boundaries or agricultural districts22. The county health department approves realty subdivisions and its sewer district must approve connections to county sewer infrastructure23. For land outside Halfmoon, see the Saratoga County page.
County-level numbers: the effective property tax rate is 1.5%24 and the median property tax bill is 4,843 dollars a year25. Typical home values are about 474,850 dollars26.
Watch-outs
- Halfmoon's zoning chapter has a travel-trailer section and the Town code has a mobile-homes chapter, but we could not confirm their operative rules on RV occupancy, tiny homes, accessory dwellings or manufactured homes; ask the Town's code enforcement office first5.
- Minimum lot size, setbacks and minimum home size are set district by district in the zoning chapter, and we could not confirm them; ask the Town for the parcel's district standards5.
- We found no private-well permit rule from the Town or state; ask the Town and the Saratoga County Department of Health before drilling16.
- Parcels in flood-prone areas face extra Town controls on development19.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
