Do you need a building permit in the Village of Baldwinsville, NY?

Yes. Inside the Village of Baldwinsville, a building permit is required for any work that must conform to the state uniform code or energy code, and work may not begin until the Code Enforcement Officer issues the permit1. The village enforces the New York State Uniform Fire Prevention and Building Code through its own village code9.

A few small jobs are exempt, such as finish work and repairs with no fire or life-safety impact, but an exemption never authorizes work that breaks the code1. The village's own page lists additions, sheds, decks and fences, and structural renovations among the work that needs a permit10. When in doubt, the village advises calling the codes officer before the project starts10.

A permit becomes invalid if work does not start within six months, and it expires 12 months after issuance1.

Who issues building permits in Baldwinsville, and how do you reach them?

The village's own Code Enforcement office issues building permits for land inside village limits, not Onondaga County11. Call (315) 635-2481 or email [email protected]; the village also hosts an online building and zoning permit application10.

The application is in writing on the code office's form, signed by the owner or agent, and includes the tax map number, address, occupancy classification and at least two sets of construction documents11. Those construction documents must be prepared by a licensed architect or engineer11. Fees are set by the village Board of Trustees and are due at application; we could not confirm the current amounts, so ask the Code Enforcement office12.

Does Baldwinsville have zoning, and what does it mean for lot size, setbacks and height?

Yes. The Village of Baldwinsville adopts and administers its own zoning ordinance, Code Chapter 345, and county or town zoning is not the rule for land inside the village2. The village is divided into 12 classes of districts, shown on a zoning map dated February 11, 2020 that the Village Clerk keeps82. The map, not a general summary, controls which district a parcel is in2.

In the R-1A residential district, single-family lots must be at least 8,500 square feet, with up to 10% of subdivision lots allowed to be smaller as long as the subdivision averages at least 11,000 square feet6. Lot width at the front building line is at least 80 feet6. Front yards are at least 30 feet, rear yards at least 40 feet, and combined side yards at least 18 feet, with neither side under 8 feet13. Buildings, including accessory buildings, may cover no more than 25% of the lot14. Dwellings in R-1A may not exceed 30 feet in height7. Other districts have different standards, which we did not confirm.

Can you live in an RV, tiny home or accessory dwelling in Baldwinsville?

We could not confirm the village's rules on long-term RV occupancy, tiny homes, accessory dwellings or manufactured homes, so do not assume any of them is allowed. The village's zoning chapter has separate provisions that may cover trailers and prohibited uses, and the Code Enforcement Officer is the person to ask before you buy or park anything10. New York's rules for state campgrounds apply to those campgrounds only and do not answer whether you can live in an RV on your own lot.

How do septic permits work inside Baldwinsville?

Private septic is allowed inside the village only where no public sanitary sewer is available15. A house on a street with a village sewer must connect within 90 days after official notice when the public sewer lies within 100 feet of the property line4. Existing private systems must be abandoned and filled once public sewer becomes available15.

Where a septic system is allowed, it must meet Onondaga County Department of Health requirements3. The county's Bureau of Public Health Engineering reviews plans for individual sewage disposal systems; call (315) 435-6600 or email [email protected]16. We could not confirm whether a county permit is needed for each in-village installation, so ask the Bureau before you buy a lot without sewer.

Building a home in Baldwinsville: the steps, in order

  1. Find the parcel's zoning district on the village zoning map and read the district rules in Chapter 3458.
  2. Confirm whether public sewer is available; if not, contact the county health Bureau about a septic design3.
  3. Apply for a building permit with the Code Enforcement office, including construction documents prepared by a licensed architect or engineer11.
  4. Keep work exposed for the required inspections, which cover items such as footing and foundation, framing and a final inspection17.
  5. Obtain a certificate of occupancy or certificate of compliance before anyone occupies the building5. A temporary certificate may be issued before completion5.
  6. If you are dividing land, note that the village code has a subdivision chapter and that Onondaga County Health must stamp all filed subdivision maps1819.

What stays with Onondaga County, and what to check before you buy

Septic review and subdivision-map review stay with the Onondaga County Health Department even for village lots319. For land outside the village, use the Onondaga County page, since village rules do not apply there.

Before buying, ask the Code Enforcement Officer which district the lot is in, whether sewer is within reach, and whether the lot is in a flood area, since private development in mapped flood zones needs a local floodplain permit20. If the lot fronts a state highway, a driveway needs a NYS Department of Transportation permit21. Onondaga County's effective property tax rate is 2.6%22.

Watch-outs

  • We could not confirm village rules on RV occupancy, tiny homes, accessory dwellings, owner-built homes, wells or short-term rentals, so ask the Code Enforcement Officer before relying on any of them10.
  • The R-1A figures here are for that district only; other districts have different lot, yard and height standards, so check the zoning map first8.
  • Building permit and inspection fees are set by the Board of Trustees; we could not confirm the current amounts12.
