Does the Town of Newfane have zoning, and what does it mean for lots, setbacks and RVs?

The Town of Newfane, New York has its own zoning chapter, adopted by the Town Board in 19701. The chapter divides the town into 11 classes of districts, shown on the adopted Zoning Map8. Niagara County does not zone for the town, so the district your parcel sits in decides what you can build.

In the AR (Agricultural/Residential) district the minimum lot area is 80,000 square feet, with front setbacks of 75 feet, side setbacks of 20 feet each and a rear setback of 60 feet69. In R-1 (Single Family Residential) the minimum lot is 20,000 square feet, with 50-foot front, 10-foot side and 50-foot rear setbacks69. Buildings may cover at most 10 percent of an AR lot and 35 percent of an R-1 lot10. Maximum structure height is 35 feet in both districts11.

RV parks and campgrounds are a special exception in the RR and MHP districts and are seasonal only; the town's table does not say whether an RV may be lived in on an individual private lot, so ask the Building Inspector before parking one on land you own512. Mobile-home parks are permitted only in MHP and require public sewer13. We could not confirm any town rule on tiny homes.

Do you need a building permit in the Town of Newfane, and who issues it?

The Town of Newfane Building Inspector & Code Enforcement office reviews plans, issues building permits and conducts inspections for work inside the town2. Statewide, New York requires a building permit for work that must conform to the Uniform Code, and local authorities administer that requirement4. A town may exempt a one-story detached shed of 144 square feet or less4, but Newfane's own exemptions were not confirmed, so ask before skipping a permit for any structure.

To meet the Building Inspector you must make an appointment, and inspections require 24 hours' notice2. The town's page lists a minimum permit fee of $25.00 and a permit renewal fee of $50.002; the fee for a new house was not confirmed, so ask the office for a quote. Occupancy requires a certificate of occupancy or certificate of compliance for work that needed a building permit14.

Special-exception uses, such as RV parks and campgrounds, need a special exception permit before a building, zoning or occupancy permit can be issued15. Short-term rentals are regulated in the Town of Newfane2; traveler's lodging is permitted in R-2, a special exception in AR and RR, and prohibited in R-1 and MHP7.

How do septic permits work in the Town of Newfane?

Septic approval for Newfane comes from the Niagara County Health Department, not the town3. No one may construct, install, connect, alter or extend a sewage disposal system in the Niagara County Health District without written approval from the Public Health Director16. For new construction on a vacant lot, the county reviews plans that must be designed and prepared by a licensed NYS Professional Engineer, and design plan review costs $29016.

The town's zoning ties into this: where public sewer is not available, no development is permitted in the AR and R-1 districts if the county decides there is insufficient private sanitary waste-disposal capacity6.

Soils matter. Only 1.6% of Niagara County's soils rate as not limited for a conventional septic drain field, so most lots need a site evaluation and often an engineered system17. The county requires a percolation rate under 60 minutes per inch and a two-foot separation from impervious soil or high groundwater; if percolation testing fails, a sand filter system is the next option16. Call the Environmental Health main office at (716) 439-744418.

Building a home in the Town of Newfane: the steps, in order

  1. Find the zoning district for the parcel on the town's Zoning Map and read that district's lot size, setbacks and allowed uses8.
  2. Ask the Niagara County Health Department whether public sewer is available or whether the lot can take a private system3.
  3. If you need a private system, hire a licensed NYS Professional Engineer to design it and file plans with the county16.
  4. Make an appointment with the Town Building Inspector and apply for a building permit2.
  5. If your use is a special exception, obtain a special exception permit first15.
  6. Call for inspections with 24 hours' notice2.
  7. Obtain a certificate of occupancy or compliance before moving in14.

What stays with Niagara County, and what to check before you buy in Newfane?

Septic approval for every address in the Town of Newfane stays with the Niagara County Health Department3. For land outside the town, see the Niagara County page. Subdivision maps are filed with the Niagara County Clerk after review by the Office of Real Property19.

A driveway onto a state highway needs a permit from the NYS Department of Transportation20. Whether the town requires its own driveway permit was not confirmed; ask the Building Inspector.

Niagara County's effective property tax rate is 2.3%21 and the median property tax bill is $4,052 a year22. Floodplain development inside a mapped flood area needs a local permit, usually through the building inspector or code enforcement official23.
