Do you need a building permit in Baxter Estates, New York?

Yes. Inside the Village of Baxter Estates, a building permit is required for any work that must conform to the Uniform Code or the Energy Code17. The village code lists exceptions, such as playground equipment for one- or two-family dwellings, but we did not read the full list, so ask before assuming a project is exempt1.

The village adopted the New York State Uniform Fire Prevention and Building Code and administers it itself8. Inspections are done by the Village Superintendent of Buildings or appointed inspectors, before certificates of occupancy are issued97. Statewide, a certificate of occupancy or compliance is required for all work that needed a building permit10.

Who issues building permits in Baxter Estates?

The Village Superintendent of Buildings issues building permits inside Baxter Estates, not Nassau County and not the Town of North Hempstead18. Nassau County's own page says local building permits come from the applicable city, town or village11.

We could not verify a phone number or counter address for the village's building office, because the village website blocked our checks. Ask the Village Superintendent of Buildings, through the village clerk's office, how to apply7.

Does Baxter Estates have zoning, and what does it allow?

Baxter Estates has its own zoning, which divides the village into three use districts: Residence A (single-family), Residence F (multiple dwellings) and Business A2. The official zoning map is on file with the village clerk and the Superintendent of Buildings12.

In Residence A, the single-family district, a lot must be at least 8,500 square feet with at least 85 feet of street frontage4. A dwelling needs at least 1,600 square feet of habitable floor area and 800 square feet of ground coverage5. That minimum size makes a small tiny home a poor fit in Residence A5.

Nassau County has no countywide zoning ordinance; each city, town and village zones for itself13.

What are the setbacks, height and lot-coverage limits in Baxter Estates?

In the Residence A district, the front yard must be at least 35 feet deep, unless the average-of-neighbors rule applies, and the rear yard at least 20 feet14. Side yards must be at least 15 feet each, or the distance that brings the abutting setback to 30 feet14.

The building area may not exceed 25% of the lot, and impervious surface may not exceed 45% of the lot6. A single-family dwelling is limited to 2.5 stories and 30 feet, measured from average preexisting ground level to the highest ridge15.

These figures are for Residence A only; Residence F and Business A have their own standards in Chapter 175 of the village code2.

How do septic permits work inside Baxter Estates?

Nassau County's Department of Health has jurisdiction over septic systems for realty subdivisions of 5 or more lots3. For a home that is not part of a new subdivision, or an existing home being renovated, the county tells applicants to contact the local building department for septic approval requirements3.

In areas served by public sewers, Nassau County requires residential and commercial facilities to connect to the sewer16. We could not confirm whether a given Baxter Estates address is sewered; ask the Nassau County Department of Health Bureau of Environmental Engineering at 516-227-969216.

Can you live in an RV or tiny home in Baxter Estates?

We could not confirm a village rule on RV occupancy, temporary camping or tiny homes in Baxter Estates. Residence A permits only the uses listed in the village zoning code, and its 1,600-square-foot minimum habitable floor area applies to every new dwelling5. Ask the Superintendent of Buildings before parking an RV for living or planning a small dwelling7.

What stays with Nassau County, and what should you check before you buy?

Septic review for subdivisions of 5 or more lots stays with the Nassau County Department of Health3. Subdivisions on property within 300 feet of a municipal boundary also go to the Nassau County Planning Commission, with the village planning authority's endorsement on the final map17. Construction on county-owned roads needs contact with both the village and Nassau County Department of Public Works11.

Before buying, confirm the zoning district on the village zoning map, the lot size against the Residence A minimums, and whether the address is on public sewer124. Nassau County's effective property tax rate is 1.5%18.

Watch-outs

  • Residence A lots must be at least 8,500 square feet with 85 feet of frontage, and dwellings must have at least 1,600 square feet of habitable floor area45.
  • Total floor area is also capped at 31–36% of lot area depending on lot size, on top of the 25% building-area limit46.
  • We could not confirm the village's building permit fees, application procedure, owner-builder rules or short-term rental rules; ask the Village Superintendent of Buildings7.
