Do you need a building permit in the Town of Hamlin, NY?
Yes. The Town of Hamlin administers the New York State Uniform Code and Energy Code, and no one may start work that needs a building permit without first getting one from the town111. One-story detached accessory structures tied to a one- or two-family home are exempt only at 144 square feet or less1.
The town's code enforcement officer also inspects the work, and a certificate of occupancy or certificate of compliance is required for any work that had a building permit1213. The permit fee is set by the Town Board and due when you apply; we could not confirm the amounts, so ask the building inspector's office14.
New York's owner-builder rules do not waive the permit. A homeowner's insurance exemption certificate for a building permit does not remove building-code, zoning or inspection requirements15.
Who issues building permits in the Town of Hamlin, and how do you reach them?
The Town of Hamlin's own building inspector issues building permits and enforces the zoning code, not Monroe County1617. The office is at 1658 Lake Road and the phone is (585) 964-818116.
Monroe County does not issue building permits or set local zoning for towns; its planning department reviews certain municipal actions that are referred to it18. Reader beware: searches for "Monroe County building department" lead to the wrong office for a Hamlin parcel.
Does the Town of Hamlin have zoning, and what does it mean for lot size, home size and setbacks?
Yes. The Town of Hamlin has its own zoning in Chapter 520, with residential districts R-VL, R-L, R-L1, R-M, R-H and SC, plus commercial, industrial and special-purpose districts219. Monroe County itself has no countywide zoning20.
Dimensions depend on the district:
- R-VL (very low density): minimum lot 2 acres and 250 feet wide8; front setback 100 feet and side and rear setbacks 15 feet21; dwellings at least 1,200 square feet for one story or 1,400 square feet for two6.
- R-L1 (one acre): minimum lot 1 acre and 120 feet wide9; front setback 70 feet and side and rear setbacks 15 feet22; single-family dwellings at least 2,000 square feet7.
Principal buildings in both districts top out at two stories or 40 feet, whichever is higher2324. We could not confirm lot coverage, accessory-dwelling or tiny-home rules; ask the building inspector.
How do septic permits work inside the Town of Hamlin?
Septic permits for every address in Monroe County, including the Town of Hamlin, come from the Monroe County Department of Public Health, Bureau of Public Health Engineering325. The county requires a permit to construct, alter, repair or extend a private sewage disposal system, and no part of an installation may be backfilled until it is inspected3.
The county states that inspections will be completed within 48 hours of request25. A certificate of approval is required before you occupy a premises with a newly built system26.
Where a public sanitary sewer is available and accessible, a private system generally may not be built27. In Hamlin, very low-density residential zones are those not served by public water or sewer28. Only 11.4% of soils in Monroe County rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system29. We could not confirm the town's own sewer-connection distance rule.
Can you live in an RV or tiny home on your land in the Town of Hamlin?
Only briefly, and only with a house already on the parcel. A travel trailer or motor home may be placed on a parcel in all zoning districts except RM, RH and SC for up to 14 consecutive days without a permit4. A building inspector permit allows up to 15 more days, renewable once4.
The RV must be at least 10 feet from any building, must have potable water and an approved waste system, and cannot be a full-time or principal dwelling4. Recreational use requires a principal dwelling already on the parcel5.
House trailers and mobile homes may be occupied only within a house-trailer park or tourist camp, or on land approved as a farm labor camp10. We could not confirm a tiny-home provision; call the building inspector before buying land for one.

- If you need septic, apply to the Monroe County Department of Public Health325.

Watch-outs
- Hamlin's dimensional rules differ by district, so confirm the parcel's district before relying on any lot size, setback or home-size number19.
- A permit is required for most work, and exemptions are narrow: a one-story detached accessory structure must be 144 square feet or less1.
- We could not confirm Hamlin's driveway, floodplain, subdivision or short-term rental rules; ask the Town of Hamlin building inspector at (585) 964-818116.
- RV stays beyond 14 consecutive days need a building inspector permit and still cannot be full-time occupancy4.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
