Do you need a building permit in Wampsville, New York?

Yes. The Village of Wampsville requires a building permit before work begins when the work must comply with the New York Uniform Code or Energy Code, including construction, enlargement, alteration, improvement, relocation and demolition.9 Listed exceptions include qualifying one-story detached sheds and similar accessory structures no larger than 144 square feet, certain shallow above-ground pools, finish work and limited repairs, but exempt work still must comply with applicable codes.9

The Village administers the state Uniform Code and Energy Code locally.11 Published Village fees include $250 for new one-family residential construction and $25 for a final certificate of occupancy or compliance.12 The Village Board may amend the fee schedule, so confirm the current amount with the Code Enforcement Office before filing.13

Who issues building permits in Wampsville, and how do you apply?

The shared Town of Lenox/Village of Wampsville Code Enforcement Office handles the Village building-permit process.14 Submit the application, site plan and required construction documents to Code Enforcement; the published form says the Building Department approves or disapproves plans within 10 business days.15

The Code Enforcement Office is at 205 S. Peterboro St. in Canastota; call 315-697-5575 or email [email protected].14 After issuance, keep the approved plans available at the property and contact the office as each inspection stage becomes ready.16 Wampsville requires at least 48 hours' notice for construction inspections, which can include the site, footing, foundation, framing, electrical, insulation, plumbing, mechanical systems, energy-code compliance and final completion.16 A certificate of occupancy or compliance is required before permitted work or a changed occupancy may be used.17

Does Wampsville have zoning, and what are the lot and setback rules?

Wampsville has Village zoning, and the applicable rules depend on the parcel's district.2 In R-20, the minimum lot is 20,000 square feet with 80 feet of width, while the minimum floor area is 1,100 square feet per dwelling unit.187 R-20 yards are at least 50 feet in front, 20 feet at the side and 40 feet at the rear.19

In R-30, the minimum lot is 30,000 square feet with 100 feet of width, and the minimum floor area is 1,200 square feet per dwelling unit.208 R-30 yards are at least 50 feet in front, 20 feet at the side and 50 feet at the rear.21 Both residential districts cap lot coverage at 25% and building height at 35 feet.22232425 Confirm the official zoning-map designation with the Village before designing to any district table.26

How do septic approvals work inside Wampsville?

Wampsville will not issue a new-residential building permit without approval for a sewer connection or an onsite sewage-treatment system.3 For an onsite system, the Village publishes a septic permit form and requires approval before any part of the wastewater system is covered, with at least 24 hours' notice to the Town/Village inspector.5

Madison County Public Health provides septic-placement guidance, observes percolation and deep-hole tests, and reviews and approves alternative onsite wastewater designs and construction.4 The county office is at 138 N Court Street - Building 5 in Wampsville; call 315-366-2361 or email [email protected].27 Only 11.9% of mapped Madison County soils are rated without severe limitations for a conventional septic drain field, so resolve testing and system design before fixing the house location.28 The official material does not establish one universal approval path for every conventional system; ask Code Enforcement and Public Health which office must sign each step for the parcel.4

Can you live in an RV, tiny home or manufactured home in Wampsville?

Wampsville allows an occupied motor home only on a lot containing a single-family residence, for no more than two weeks during a calendar year.6 That rule does not support using a vacant parcel as a long-term RV homesite.6

We could not confirm a separate tiny-home classification. A proposed small dwelling still needs review under the applicable zoning district, building code and permit process, and the residential tables set minimum floor areas of 1,100 square feet per dwelling unit in R-20 and 1,200 in R-30.78

Mobile homes are generally limited to an approved Mobile Home Park District, although specified temporary placements may receive a special permit.10 In a mobile-home park, each unit must have at least 980 square feet of floor area, and the park and individual lots have additional size requirements.29 Ask Code Enforcement to classify the exact unit and parcel before purchase.14

Building a home in Wampsville: what are the steps?

  1. Confirm that the property is inside the Village and obtain its zoning district from the Village map; district rules control allowed uses, lot size, yards, coverage and height.26
  2. Lay out the home against the district standards and determine whether flood-hazard or subdivision review applies.3031
  3. Resolve sewer or onsite wastewater approval before filing for new residential construction, and coordinate soil testing or an alternative design with Madison County Public Health when needed.34
  4. Submit the building-permit application, site plan and construction documents to the Code Enforcement Office and wait for permit issuance before starting work.151
  5. Give Code Enforcement at least 48 hours' notice as required stages become ready, and keep work accessible until accepted.16
  6. Complete the final inspection and obtain the certificate of occupancy or compliance before using the home.32

What should you check before buying land in Wampsville and Madison County?

Start with the official Village zoning district and verify that the proposed dwelling type fits its use, lot, setback, coverage and height rules.2 Ask Code Enforcement about tiny homes, accessory dwellings, private wells, utility connections and driveway access because the reviewed materials do not provide a complete parcel-level answer for those topics.14

Treat wastewater feasibility as a purchase contingency because only 11.9% of mapped Madison County soils avoid severe limitations for a conventional drain field.28 Check flood mapping as well: uses in a Special Flood Hazard Area can require a Village Planning Board special permit, and floodway encroachments face additional restrictions.30 If access connects to a New York State highway, building or modifying the residential driveway requires a state transportation permit.33 Madison County's effective property-tax rate is about 2.3%, and its median annual property-tax bill is about $4,058; the actual parcel bill will differ.3435

Watch-outs

  • Do not start covered work before the Wampsville building permit is issued.1
  • An RV cannot serve as long-term housing on a vacant Wampsville lot; the confirmed allowance is limited to two weeks per calendar year on a lot containing a single-family residence.6
  • New-home building approval depends on an approved sewer connection or onsite sewage-treatment system.3
  • Only 11.9% of mapped Madison County soils avoid severe limitations for a conventional septic drain field, so verify the system design before committing to a house site.28
  • The owner-builder paperwork concerns workers' compensation documentation and does not remove the Village building-permit requirement.361
