Do you need a building permit in the Town of Amherst, NY?

Yes. The Town of Amherst requires a separate building permit or quick permit before construction starts, with a short list of exempt categories such as swings, playhouses under 144 square feet and playground equipment tied to a one- or two-family home1. The exemption never excuses work that breaks the uniform code or energy code1.

Starting without a permit costs double the regular fee or $50, whichever is greater, on top of other penalties1. New York State sets the floor: every town must require permits for work covered by the Uniform Code9.

The town's building code text applies to all areas of Amherst outside the Village of Williamsville2. If the address is in the village, ask the village office, not the town, which permit rules apply; we could not confirm the village's own arrangements.

Who issues building permits in Amherst, and how do you reach them?

The Town of Amherst Building Department reviews plans, issues building permits and sends inspectors to active work sites10. Reach it at (716) 631-7080 at 5583 Main St in Williamsville10. The Commissioner of Building administers the state uniform code, the energy code and the town's Chapter 832.

An application needs a completed building application form, a dimensioned site plan showing setbacks, drainage, sewage disposal and utilities, and construction documents stamped under New York Education Law11. Fees are paid to the town clerk, and an application that is not issued expires six months after processing is complete unless the commissioner extends it11. The fee schedule itself we could not confirm; ask the Building Department.

Inside Amherst, the town issues building permits; Erie County does not12.

Does Amherst have zoning, and what do lot sizes and setbacks look like?

Yes. The Town of Amherst zones land under Chapter 203 of its code, with residential districts including RR, S-A, R-1 through R-4 and MHR-8313. Rules differ by district, so find the parcel's district before you plan anything.

In the R-1 district, a single-family lot needs at least 21,780 square feet and 100 feet of width5. Required yards are 30 feet in front, 35 feet in back, 8 feet on each side and 20 feet combined sides14. Buildings may cover up to 35% of the lot and stand 2 stories or 35 feet1516. A one-story dwelling must have at least 1,200 square feet of floor area, and a taller one 1,40017.

In the Rural Residential (R-R) district, each dwelling needs at least 3 acres and 200 feet of width6. The front yard is 50 feet18, and residential building coverage tops out at 25%19. Dividing land is governed by Chapter 204 of the town code20.

How do septic permits work in Amherst?

Septic permits in Erie County, including Amherst, come from the Erie County Department of Health, not from the town's Building Department4. Building a new home that needs an onsite wastewater system means hiring a licensed design professional, who submits an engineer's report, plans, the permit application and a $300 fee21. The Department issues the construction permit once the plans meet its regulations4. Your design professional inspects during construction22.

Much of Amherst may be on public sewer, in which case none of this applies. We could not confirm which streets are sewered or the town's rules for connecting; ask the Amherst Engineering Department before you buy. County rules for connecting to an Erie County district sewer require a written permit from the district23. Septic and private-well properties also need a property-transfer certification from the Health Department before title passes24. For septic questions call 716-961-680025.

Can you live in an RV or tiny home in Amherst?

We could not confirm any Amherst rule on living in an RV, a tiny home or camping on private land, so call the Building Department at (716) 631-7080 before you buy10. Do not assume a lot allows it.

Accessory dwelling units are allowed in limited form: a special use permit is required, valid for up to two years and renewable, with one unit per lot and the owner living on the property7. The unit must be at least 500 square feet and no more than two bedrooms7.

A manufactured home needs a building permit and a certificate of occupancy anywhere in the county, and local zoning may also apply26. Amherst lists an MHR-8 residential district in its zoning code, but we could not confirm its use rules13.

Building a home in Amherst: the steps, in order

  1. Find the parcel's zoning district in Chapter 203 and check lot size, yards and height against your plan3.
  2. Ask the Planning Department at (716) 631-7051 whether a subdivision, site plan or rezoning review applies27.
  3. If the site needs a septic system, hire a licensed design professional and apply to the Erie County Department of Health21.
  4. Apply to the Building Department with a site plan and stamped construction documents11.
  5. Pay fees at the town clerk and begin work within six months, or the permit can expire11.
  6. Call for inspections of the site, footing and foundation, framing and building systems before covering any work28.
  7. Finish with a final inspection and a certificate of occupancy before anyone moves in10.

What stays with Erie County, and what to check before you buy in Amherst

Erie County, not the town, handles septic permits and property-transfer certifications4. For land outside Amherst, see the Erie County page.

Before buying, ask the Building Department at (716) 631-7080 whether the parcel sits in a mapped flood area10. We could not confirm town rules on driveway curb cuts, wells, permit fees or short-term rentals; ask the Building Department. Driveways onto a state highway need a state permit29.

Costs: Erie County's effective property tax rate is about 2.1%, with a median bill near $4,525 a year3031. A homeowner acting as their own general contractor on an owner-occupied one- to four-family home files form BP-1 only if paid helpers work fewer than 40 hours a week combined8.

Watch-outs

  • Inside the Village of Williamsville, the town's building code text does not apply, so confirm with the village which office issues building permits2.
  • Starting work without a permit costs double the regular fee or $50, whichever is greater1.
  • The rules above come from the R-1 and R-R districts; other Amherst districts have different lot sizes and yards, so confirm the parcel's district before relying on them13.
  • We could not confirm Amherst rules on RVs, tiny homes, wells, driveways, fees or short-term rentals; call the Building Department at (716) 631-708010.
