Do you need a building permit in the Town of Washington, NY?

Yes. The Town of Washington requires a building permit for any work that must conform to the Uniform Code or Energy Code, including construction, enlargement, alteration, removal or relocation of a building, and installing a solid-fuel heating appliance, chimney or flue1. The exemptions in Section 74-5 apply1. The state allows towns to exempt one-story detached sheds and playhouses of up to 144 square feet9, and the Town's building department says sheds smaller than 144 square feet are exempt10.

The application is in writing on a form the Building Inspector accepts, signed by the owner or the owner's agent11. The permit proposal must also conform to Chapter 165 zoning unless the Zoning Board of Appeals grants a variance2. Work stays exposed until the Building Inspector inspects and accepts it12, and a certificate of occupancy is required before the building is used6.

Who issues building permits in the Town of Washington, and how do you reach them?

Inside the Town of Washington, the town's own Building Inspector issues building permits1. The Building Department is at 10 Reservoir Dr., Millbrook, and the phone is (845) 677-341913. Dutchess County does not issue the building permit for land inside the town; the county's role is septic and well review14.

A driveway or private road serving the building must be improved to the satisfaction of the Town Highway Superintendent or designated engineer, and the certificate of occupancy cannot issue until the driveway is completed under Planning Board conditions and Chapter 16515.

Does the Town of Washington have zoning, and what about RVs, tiny homes and lot size?

Yes. The Town of Washington has its own zoning, published as Chapter 16516, and the Town's Zoning Administrator enforces it10. Dutchess County does not zone; zoning happens at the town, village and city level4. The county's zoning map is for general reference, and district questions go to the town17.

A second residential structure, such as a guest house, needs Town Planning approval, and the Town's building department says the code requires double the acreage of the zone10. Minimum lot sizes, setbacks, RV living, tiny homes and manufactured homes depend on the zoning district, and we could not confirm those standards. The Town publishes them in Appendix B of the zoning code; ask the Building Department before you buy. Any new subdivision of land needs town approval8.

How do septic permits work in the Town of Washington?

The building permit and the septic review are separate steps. Dutchess County's Department of Behavioral & Community Health reviews septic systems and wells, and the New York State Department of Health also has jurisdiction5. When you apply for a building permit, the Town has you complete the top of the DBCH SAN 34 form, and the building inspector sends it to the county18.

The county recommends the town issue the building permit only after a file review and a pre-construction conference, and if the inspection finds problems such as unexpected soil conditions, no permit is recommended3. Lot approval takes a NYS-licensed Professional Engineer18. Dutchess County's soil ratings suggest planning for a site evaluation: about 15% of soils rate as not limited for a conventional drain field19. Water wells need a permit from the county Commissioner or designee7.

Building a home in the Town of Washington: the steps, in order

  1. Look up your zoning district and tax grid number on the county parcel mapping tool, then read the district's rules in the Town zoning code10.
  2. Get lot approval from the county, using a NYS-licensed Professional Engineer18.
  3. File the written building permit application with the Building Department11; the town sends the SAN 34 form to the county18.
  4. Wait for the county's pre-construction conference before the town issues the permit3.
  5. Keep work exposed for inspection12.
  6. Call the county for the septic inspection before the system is covered20.
  7. Obtain the certificate of occupancy6.

What stays with Dutchess County, and what to check before you buy

Dutchess County keeps septic and well review, and county sanitary code approval for realty subdivisions21. Where an approved public water or sewer system is available in a subdivision, a new individual system may not be allowed22. We could not confirm a Town of Washington rule on sewer or water connection distance.

Dutchess County's effective property tax rate is about 2%23, with a median tax bill of $7,226 a year24. The typical home value is about $504,72325. For land outside the town, see the Dutchess County page.

Watch-outs

  • We could not confirm the Town's rules on RVs, tiny homes, camping, manufactured homes, accessory dwellings or district lot sizes; call the Building Department at (845) 677-341913.
  • The county's rule that septic must be approved before the building permit means a lot with poor soils can stall the whole project3.
  • Dutchess County's property taxes run about 2% of value, so budget for carrying costs23.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
