Do you need a building permit in East Fishkill, NY?

Yes, for nearly all construction. The Town of East Fishkill requires a building permit for any work that must conform to the New York State Uniform Code or the Energy Code, and the permit must be in hand before work begins1. The exemptions are narrow; one example is a single detached shed, playhouse or similar structure of no more than 144 square feet, with only one such structure on the lot1. An exempt structure still has to meet the codes11.

The application is written, on a form the Code Enforcement Officer accepts, and the property owner signs it12. The town publishes separate application packages for dwellings, additions, decks, sheds, mobile homes, pools and more13. Fees follow a schedule the Town Board sets by resolution9.

Who issues building permits in East Fishkill, and how do you reach them?

The Town of East Fishkill Building Department issues building permits for land inside the town; unincorporated-county shortcuts do not apply, because Dutchess County leaves building permits to its towns, villages and cities14. The department sits on the lower level of Town Hall at 330 Route 376 in Hopewell Junction, and the Building Inspector and Zoning Administrator line is (845) 221-242713.

The Building Inspectors, Zoning Officer and Floodplain Administrator work from the same offices13. For new driveways, grading and filling, steep slope disturbance, wetland disturbance and floodplain development, the town's Engineering Department takes the application directly at (845) 221-242815.

Does East Fishkill have zoning, and what does it mean for your lot?

East Fishkill zones its own land. The Town Code's zoning chapter organizes the rules into districts, with the details in attached schedules2. Dutchess County does not zone: zoning for land use happens at the municipal level4, and the county's zoning map is for general reference only16.

We could not confirm the numeric lot size, setback, height and minimum home size limits for any district, so check the Schedule of Bulk Regulations for your parcel's district before you buy. The Zoning Officer in the Building Department can tell you the district and confirm what a lot allows, including accessory dwellings, which we also could not confirm13.

How do septic permits work in East Fishkill?

Septic approval comes from Dutchess County, not the town. The Dutchess County Department of Behavioral & Community Health (DBCH) has jurisdiction over onsite wastewater systems, and the New York State Department of Health also has jurisdiction17. The county asks for a New York State licensed Professional Engineer to get your lot approved18.

The order matters. When you apply for a town building permit, the building inspector sends the county its SAN 34 form, DBCH checks the approval and holds a pre-construction conference, and the county recommends the town issue the building permit only afterward3. If the pre-construction inspection turns up unexpected soil conditions or plan errors, no building permit is recommended3. After installation and before final cover, the installer must call the county District Office for an inspection19.

The Dutchess County soil data are not encouraging for conventional systems: about 15% of soils rate as not limited for a standard drain field, so expect a site evaluation and possibly an engineered design20. We could not confirm the town's own rules for individual septic systems or sewer connection; ask the Building Department.

Can you live in an RV or tiny home in East Fishkill?

Plan on no, unless the unit sits in a licensed trailer park. The Town Code says no one may use or park a house trailer in the Town of East Fishkill except within a duly licensed trailer park or camp7. A trailer park also needs a Town license and may be located only in zones the zoning ordinance permits7.

We could not confirm how the town treats a modern travel trailer, temporary camping or a tiny home on a foundation, so ask the Building Inspector and Zoning Administrator at (845) 221-2427 before you buy or move anything onto a lot13. A tiny home built as a dwelling would still need a building permit and a certificate of occupancy16.

Building a home in East Fishkill: the steps, in order

  1. Ask the Zoning Officer which district your lot is in and whether the use you plan is allowed13.
  2. Hire a New York State licensed Professional Engineer for DBCH lot and septic approval18.
  3. File the written building permit application, signed by the owner, with the Building Department12.
  4. Expect a pre-site inspection, then plan review by the Building Inspector13.
  5. Wait for the county pre-construction conference before the permit is recommended3.
  6. Keep work accessible and exposed until the Code Enforcement Officer or an authorized inspector accepts it21.
  7. Get the county septic inspection before final cover, then the town's certificate of occupancy before moving in196.

What stays with Dutchess County, and what to check before you buy

Septic and well approvals stay with the county health department. Anyone who constructs or abandons a water well in Dutchess County needs a permit from the Commissioner or the designee, applied for at least 15 days ahead8. Where an approved public water or sewer system is available and accessible within a realty subdivision, new individual systems may not be built22. Subdividing land needs county water and sewer approval too, and local subdivision authority stays in place23.

For land outside the town, use the Dutchess County page. Dutchess County's typical home value is about $504,723, its median property tax bill is about $7,226 a year, and the effective rate is about 2%242510. Ask about flooding, too: East Fishkill has a Floodplain Administrator and requires a floodplain development permit1315.

Watch-outs

  • We could not confirm East Fishkill's lot sizes, setbacks, minimum home size, accessory dwelling rules or short-term rental rules; ask the Zoning Officer at (845) 221-242713.
  • The town's own septic provision that we confirmed covers trailer camps, not every individual system, so confirm the process for a house lot with the county health department26.
  • A town building permit alone is not enough: the county recommends the town issue the permit only after its septic review3.
  • The 2025 New York State Uniform Code took effect December 31, 2025, so older plans may need updating27.
  • Do not rely on a county-level answer for a lot inside East Fishkill; the town sets zoning and building permits, not Dutchess County4.
