Does the Town of Greenport, NY have zoning?

No. The Town of Greenport, Columbia County, New York states on its Building Department page that it does not have zoning13. That means no zoning districts, and no zoning-based minimum house size, lot size, setbacks, lot coverage or building height911101213.

No zoning does not mean no rules. The Planning Board reviews site plans, and the Town Code has separate chapters on mobile homes and trailers, sewage disposal and flood damage prevention114. Any new construction other than one- and two-family homes needs site-plan review before a building permit is issued3.

Columbia County does not zone for its towns; each city, town and village decides for itself15. For land outside Greenport, see the Columbia County page.

Do you need a building permit in the Town of Greenport, and who issues it?

Yes, for work that must conform to the New York State Uniform Code or Energy Code. State rules make local authorities require building permits for that work2, and in Greenport the Code Enforcement Office & Building Department handles them3. The state lets a town exempt one-story detached sheds and similar structures up to 144 square feet, but an exemption never excuses code violations2. Ask the Building Department whether Greenport uses that exemption.

Inspections follow the permit, and a certificate of occupancy or compliance is required for work covered by a building permit1617. If the project needs Planning Board site-plan approval, that approval must come before the building permit or certificate of occupancy18.

The state does not require regular periodic inspections of owner-occupied one- and two-family homes, though an owner can invite one16.

How do septic permits work in the Town of Greenport?

Where no public sanitary sewer is available, Greenport requires a private sewage disposal system that meets New York State Department of Health standards and is under the control of the local county health office4. For Greenport that means the Columbia County Department of Health519. The Town Code adds that a septic permit does not take effect until the installation is finished to the Superintendent's satisfaction, and that no permit issues where the lot is too small for subsurface absorption20.

The county process requires plans by a New York licensed professional engineer, a county site visit, and final inspection with engineer certification6. Applications are accepted only from April 1 through October 1; the fees are $500 for a single lot plus a $700 engineer plan review, and they are non-refundable21.

If a public sewer later reaches the building, the Town Code requires connecting within 90 days22.

Can you live in an RV, trailer or mobile home on land in the Town of Greenport?

Only in limited ways. Trailer camps inside Greenport need a Town license and must meet county and state health requirements, with only one trailer per lot7. An occupied mobile home outside a licensed mobile-home park is allowed only under the exceptions in the Town's Chapter 85, and its water and sewage systems must satisfy the Columbia County Department of Health8.

One exception covers an owner building a dwelling: that permit lasts up to a year, and the unit must be removed when it expires8. Another lets a farm owner house full-time farm workers in a mobile home with a Town Board permit23. Mobile homes outside parks also have a side setback of at least 15 feet8.

We could not confirm a rule for tiny homes or accessory dwelling units in Greenport; ask the Building Department before buying3.

Building a home in the Town of Greenport: the steps, in order

  1. Call the Town of Greenport Code Enforcement Office & Building Department to confirm what your project needs3.
  2. Where no public sewer is available, apply to the Columbia County Department of Health for septic approval, with an engineered plan, between April 1 and October 1619.
  3. If the project is anything other than a one- or two-family home, file for Planning Board site-plan review at least 15 days before the meeting you want24.
  4. Apply for the building permit with the Building Department23.
  5. Keep work exposed until it is inspected and accepted16.
  6. Obtain the certificate of occupancy or compliance before moving in17.

What to check before you buy land in the Town of Greenport

Septic comes first. Only 0.4% of soils in Columbia County rate "not limited" for a conventional drain field, so expect a site evaluation and probably an engineered system256.

We could not confirm several Greenport rules: owner-builder exemptions, private well permits, accessory dwelling units and development in flood-hazard areas. The Town Code has a Flood Damage Prevention chapter, so ask the Building Department about a specific parcel3. Ask the Columbia County Department of Health about wells19.

Taxes are a county-level figure: Columbia County's effective property tax rate is 1.5%, with a median bill of $4,795 a year2627. Short-term rentals under 30 consecutive days must register and pay the county's 4% occupancy tax28, and registered short-term rentals in Greenport face a Building Department inspection at least every three years29.

Watch-outs

  • No zoning in Greenport does not remove Planning Board site-plan review or the Town Code's mobile-home, sewage and flood chapters1.
  • Septic applications to Columbia County are accepted only from April 1 through October 1, so plan the timing of a build around that window21.
  • We could not confirm Greenport's rules on tiny homes, accessory dwelling units, private wells, owner-built homes or flood-hazard development; call the Building Department before you buy3.
