Zoning, building permits and septic rules in Elephant Butte, New Mexico

Elephant Butte, New Mexico requires a city zoning permit for most construction, issued by the city's Land Use Department1. The city has no building permit department, so the State of New Mexico issues the building permit2. Septic permits come from the New Mexico Environment Department, and homes inside the city must connect to city sewer where it is available34.

Does Elephant Butte have zoning, and what does it mean for lot size, setbacks and RVs?

Elephant Butte administers its own zoning inside city limits through the Land Use Department under Chapter 155 of the city code5. Sierra County itself has no zoning ordinance, so the city's code is the zoning that applies on a lot inside the city, and the county's lack of zoning does not carry over10.

In the R-1-A single-family residential district, the city's hearing notice lists a front setback of 30 feet and side and rear setbacks of 5 feet, or 10 feet where the lot abuts BLM or BOR land7. The zoning commission can vary these setbacks, so confirm your own lot's district with the Land Use office7.

Mobile homes must meet Elephant Butte's Ordinance 201 standards for age, condition and installation before they can be placed9. We could not confirm the city's rules on minimum lot size, minimum home size, long-term RV living or accessory dwellings, so ask the11 before you buy.

Do you need a building permit in Elephant Butte, and who issues it?

Building in Elephant Butte takes two permits from two offices. The city's Land Use Department issues the zoning permit that most types of construction need1. The State of New Mexico issues the building permit itself, because Elephant Butte has no building permit or inspection department2.

The city also asks you to contact its land use office before adding a deck, an addition, a cover or a fence, and warns that skipping permits can bring fines and removal of the work1. Call the city to set an appointment for any permit need12.

The state building permit comes from the13 in Las Cruces. A homeowner building their own primary residence can apply for a homeowner permit, which still needs state permits and inspections8. Permit fees are based on project valuation and calculated by the state14. We did not find a published city zoning-permit fee schedule, so ask the Land Use office.

Who inspects new construction in Elephant Butte?

The city itself conducts no building inspections6. State-permitted residential work goes through the Construction Industries Division, whose required inspections are foundation, concrete slab or under-floor, frame, weather-resistive barrier and final15. Under the state code, a home cannot be occupied until the building official issues a certificate of occupancy after the final inspection16. We could not confirm which building code the city has adopted beyond the state's, so ask the Construction Industries Division office in Las Cruces.

How do septic permits work in Elephant Butte?

Septic permits for homes in Elephant Butte come from the New Mexico Environment Department, not the city3. State rule requires a permit before any new on-site liquid waste system is installed, and a dwelling cannot be built on a lot needing one until the permit is issued17. Applications go to the local NMED field office18. The listed fee for a conventional system up to 1,000 gallons per day is $22519.

Sewer changes the answer. The city requires owners of developed property to connect to city sewer as it becomes available, at the owner's expense4. A June 2025 city notice listed a $42 administration fee, a $55 refundable deposit, a $1,050 development fee (waived for dwellings with water service before March 31, 2006) and a $35 monthly service fee, and fees may have changed since4. Ask the city whether sewer reaches your lot before applying for a septic permit.

Can you live in an RV or tiny home in Elephant Butte?

We could not confirm whether Elephant Butte allows long-term RV living or a tiny home on a given lot, because those answers sit in the city's zoning code; ask the11 before you buy or move anything onto the lot. Do not assume that Sierra County's lack of zoning applies inside the city.

Statewide, a tiny house used as a dwelling on a permanent foundation must meet the New Mexico Residential Code and Appendix AQ, with a floor area of 400 square feet or less excluding lofts20. A tiny house on a chassis with a permanent axle is treated as a recreational vehicle until the axles are removed20. That is the state's building rule, not the city's permission to place one.

Building a home in Elephant Butte: the steps, in order

  1. Call the Land Use Department to set an appointment and confirm your lot's zoning district and setbacks12.
  2. Ask the city whether sewer is available at your lot; if not, apply to the local NMED field office for a septic permit418.
  3. Get the city zoning permit, which the state needs before it issues a building permit1.
  4. Submit the state building permit application, plans and fee to the Construction Industries Division21.
  5. Schedule the required state inspections as work proceeds15.
  6. Do not move in until the final inspection passes and the certificate of occupancy is issued16.

What stays with Sierra County, and what to check before you buy in Elephant Butte

Septic permits and statewide building rules do not depend on the city line: NMED handles septic and the State of New Mexico handles building permits32. For land outside city limits, see the Sierra County page, because the city's zoning does not apply there.

Sierra County's typical home value is $181,189, its effective property tax rate is 0.5%, and it gets 11.8 inches of precipitation a year222324. About 19.8% of Sierra County soils rate as not limited for a conventional septic drain field, so many lots need a site evaluation or an engineered system25. The state requires approval from the local Floodplain Administrator before building in a mapped flood hazard area, so ask the Land Use office who serves your lot26.

Watch-outs

  • The city's online code is current only through 2024 and predates the 2025 Ordinance 224 amendment to Section 155, so confirm current zoning text with the Land Use office5.
  • Lot size, minimum home size, height, lot coverage, RV living and accessory dwellings inside Elephant Butte were not confirmed; ask the City of Elephant Butte Land Use Department11.
  • Sewer connection fees quoted here come from a June 2025 notice and may have changed4.
  • Setback figures come from a city hearing notice, not the code text, and the zoning commission can grant variances7.
