Does Carlsbad, NM have zoning, and what does it mean for RVs, mobile homes and lot size?

Yes. The City of Carlsbad zones land inside its incorporated limits under a unified zoning ordinance1. The ordinance names R-R, R-1, R-2, C-1, C-2, Industrial and PUD districts, and the official zoning map is kept in the City Clerk's office9. Look up a parcel's district before you buy, because the standards below change by district.

In the R-1 district the minimum lot area is 6,000 square feet per dwelling unit, with 50 feet of street frontage and a 40-foot height limit1011. In the R-R Rural Residential district the height limit is also 40 feet12.

A mobile home may be occupied or placed only in a properly zoned district, mobile home park or mobile home subdivision, and moving one within the city requires a placement permit6. Allowed uses need a zoning permit, and conditional uses need a conditional use permit13. We could not confirm separate rules for tiny homes or accessory dwellings in the city's zoning ordinance, so ask the Planning and Regulation Department before you plan either14.

Do you need a building permit in Carlsbad, and who issues it?

Yes. Inside Carlsbad city limits, a building, mechanical, plumbing and/or electrical permit is required before construction or work starts2. The City of Carlsbad Building Department oversees plan reviews, permits and inspections for residential and commercial projects2. Contractors must be licensed in New Mexico and hold a City of Carlsbad business registration2.

The city's zoning permit is a separate step handled by the Planning and Regulation Department13. Zoning application fees are $100 for a map or text amendment and $50 for a conditional use permit or an appeal15. Building permit fees come from the Building Department's own fee schedule, which we did not confirm here, so ask that office for a quote2.

This is a city rule. Outside city limits, in unincorporated Eddy County, a different set of offices applies; see the Eddy County page.

How do septic permits work inside Carlsbad?

Septic permits inside Carlsbad come from the state, not the city. New Mexico law bars anyone from installing or modifying an on-site liquid waste system without a permit from the state Environment Department3. Applications go to the department field office for the installation area, which for Carlsbad is the New Mexico Environment Department's Carlsbad Field Office316.

A septic permit and fee are required before construction or modification, and the department must deny an application if the proposed system does not meet 20.7.3 NMAC5. If a lot connects to city sewer, a septic system may not be needed at all. For a lot that will not connect to city sewer, we could not confirm what Carlsbad requires beyond the state permit, so ask the Utilities Department14.

County-level soil data is a caution: about 27% of Eddy County soils rate "not limited" for a conventional drain field17.

Can you live in an RV on your land in Carlsbad, NM?

Only for a limited time. A property owner may be permitted to live in a recreational vehicle for up to six months on a building site where a residential building permit has been issued4. The ordinance does not give a blanket allowance for living in an RV on vacant land.

Temporary housing the city approves must connect to city water and sewer or be completely self-contained apart from electrical service, and connection depends on approval from the Utilities Department Director18. A self-contained unit that does not connect to city sewer needs a sanitation plan approved by the state Environment Department, furnished to the city19.

Campgrounds inside city limits are a separate use with their own limits: at least three tent spaces, no more than three RV spaces and at least one acre20. A campground does not answer the question of living in an RV on your own lot.

Building a home in Carlsbad: the steps, in order

  1. Confirm the parcel is inside city limits and find its zoning district with the Planning and Regulation Department14.
  2. Get zoning approval. Allowed uses need a zoning permit, and conditional uses need a conditional use permit13.
  3. Check the floodplain. Any construction in a floodplain requires a Floodplain Development Permit7.
  4. Ask about a drainage and grading permit, which is required for most development before grading, paving, excavating or filling14.
  5. Apply for building, mechanical, plumbing and electrical permits through the Building Department2.
  6. If city sewer is not available, apply to the state Environment Department for a septic permit5. If you plan a domestic well, the State Engineer's form is required8.
  7. Hire a contractor licensed in New Mexico with a Carlsbad business registration2.

What stays with Eddy County, and what to check before you buy

City rules stop at the city limits. Land outside Carlsbad is in unincorporated Eddy County, where the county and state rules on the Eddy County page apply instead. Confirm which side of the line a parcel sits on before you rely on anything here.

Septic permits and domestic wells stay with the state whichever side you are on: the Environment Department issues septic permits3 and the State Engineer handles domestic well permits8. A well permit expires if the well is not completed and the well record filed within one year8.

County-level figures help with budgeting. Eddy County's effective property tax rate is 0.5%21, and the area receives about 13 inches of precipitation a year22. Large parts of Carlsbad lie in the Pecos River, Dark Canyon or Hackberry Draw floodplains, so ask the city's floodplain manager about a specific lot14.

Watch-outs

  • We could not confirm which edition of the building code Carlsbad adopted by ordinance, how certificates of occupancy work, or whether tiny homes and accessory dwellings are allowed, so confirm each with the Building Department before you buy2.
  • Zoning standards differ by district; the lot-size and height numbers above apply only to the districts named10.
  • Federal and state-owned land inside city limits may not be subject to the zoning code, though private activity on that land is1.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
