Zoning, building permits and septic rules in Roswell, New Mexico

Roswell, New Mexico requires a building permit for residential building of any kind inside city limits1. The city also zones all property within its limits by district2. Septic permits are a state matter handled through the New Mexico Environment Department, not the city3. Land outside the city falls under Chaves County's rules instead.

Do you need a building permit in Roswell, New Mexico?

Yes. Inside Roswell city limits, the city's building permit form covers "renovations, remodels, additions or building of any kind"9. The city lists storage sheds larger than 200 square feet, patio covers, gazebos, decks, pergolas, porches, carports and pools as projects that need a building permit1.

Smaller projects use a different form. A storage shed of 200 square feet or less needs a placement permit rather than a building permit1. Applications go through CloudPermit, an online system where new users register by email10.

The city also inspects buildings, structures, signs and land for compliance with its zoning ordinance11. Electrical permits are handled differently right now: the city's page says the State of New Mexico is conducting electrical permit reviews and issuing electrical permits until further notice9.

Who issues building permits in Roswell, and how do you reach them?

The City of Roswell issues residential building permits itself; the Chaves County planning office does not issue them inside city limits1. Building Inspections is at 500 N. Main Street, Roswell, NM 88201, phone (575) 637-62809.

Zoning and subdivision questions go to City of Roswell Community Development at 400 W 2nd Street, phone 575-637-628012. The city's zoning ordinance names the Building Inspector, Fire Marshal, Code Enforcement Division and Planning and Zoning Staff as the people who inspect buildings and land11.

If the lot is outside the city, the county's rules apply instead; see the Chaves County page.

Does Roswell have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. Roswell's zoning ordinance governs all property inside city limits according to the zoning district where it sits, with exceptions only for property exempted by law2. The official zoning map is kept in the Planning and Zoning Department and is the final authority on a parcel's zoning13.

R-1 single-family homes: the minimum lot is 6,000 square feet7, with a front setback of 25 feet on local or collector streets and 35 feet on arterials, a rear setback of 20 feet, and a maximum height of 35 feet1415. These apply to lots recorded after the ordinance took effect; older lots follow the rules in force when they were recorded7.

Tiny homes: the RTH Residential Tiny Home Subdivision District requires at least 2.5 acres, and each lot may have one home on a permanent foundation of no more than 400 square feet6.

Manufactured homes: the RMS Mobile Home Subdivision District allows them with a 4,500 square foot minimum lot16.

Backyard second home: a second detached structure on a qualifying R-1 lot is allowed only if the existing dwelling was built before January 1, 2010 and sits at least 75 feet from the front property line17.

How do septic permits work in Roswell, New Mexico?

Septic is a state program, not a city one. New Mexico requires a permit from the state before anyone installs or modifies an on-site liquid waste system18, and in Chaves County the New Mexico Environment Department administers it3. Applications are submitted to the local NMED field office19, which for Roswell is the NMED office at 1914 W 2nd20.

A conventional system with a design flow up to 1,000 gallons per day carries a $225 permit fee21. Homeowners can install a conventional system at their own residence after qualifying with NMED22, and every homeowner installation still needs an NMED final inspection23.

We could not confirm whether a given Roswell address must connect to city sewer or whether the city restricts septic systems inside its limits. Ask Community Development at 575-637-6280 before assuming a septic system is an option12. Across Chaves County, about 29.3% of soils rate as not limited for a conventional drain field, so a site evaluation is wise on any lot that will need septic24.

Can you live in an RV or tiny home in Roswell?

Short RV stays are allowed on a residential lot with a house, but long-term RV living is not. The city allows a travel trailer or RV parked on a residential lot for no more than 7 days and no more than 3 occupancies per calendar year5.

Each stay needs a permit from Planning and Zoning Staff, the unit must stay mobile and unskirted, and it cannot be permanently connected to sewer, water or electricity5. That rules out living in an RV on a bare lot while you build.

Tiny homes are allowed in one district: the RTH Residential Tiny Home Subdivision District, on a permanent foundation, up to 400 square feet, built under the state's Appendix Q for tiny houses6. We could not confirm a general rule for temporary tent camping on private land inside Roswell; ask Community Development12.

Building a home in Roswell: the steps, in order

  1. Confirm the lot's zoning district on the official zoning map at Community Development, 575-637-62801312.
  2. Check the district's lot size and setbacks; in R-1 the minimum lot is 6,000 square feet7.
  3. If you are creating a new parcel, follow the city's subdivision code25.
  4. Ask Community Development whether the address has city sewer, and if it does not, start the NMED septic permit at the Roswell field office, 575-624-60461220.
  5. Apply for the building permit online through CloudPermit10.
  6. If you plan to act as your own builder, the state's homeowner permit covers your primary residence, and the major portion of the work, by dollar amount, must be done by you8.
  7. Book inspections through the city's CloudPermit account9, and have the septic system pass NMED's final inspection23.

What stays with Chaves County, and what to check before you buy in Roswell

Inside Roswell, the city sets zoning and issues building permits21. Septic permits still come from the state3. Land outside the city is different: Chaves County's zoning ordinance covers territory that is not within the municipalities or the Roswell-Chaves County Extraterritorial Zoning Area26. A parcel that sounds like it is in Roswell may sit in that outer ring, so confirm the jurisdiction with the city and the Chaves County Planning & Zoning Department before buying. Details for outside the city are on the Chaves County page.

County figures to weigh: Chaves County's effective property tax rate is 0.6%27, the median property tax bill is $915 a year28, and annual precipitation averages 13.4 inches29. Chaves County sees severe drought in 48% of years30.

Watch-outs

  • Electrical permits and plan reviews in Roswell are currently handled by the State of New Mexico rather than the city, until further notice9.
  • Zoning rules above are for specific districts such as R-1, RTH and RMS; check the official zoning map for the lot you are buying before relying on them13.
  • We could not confirm the city's permit fee schedule, which building code editions it currently applies, or whether the city offers an owner-builder exemption; ask Building Inspections at (575) 637-62809.
  • Land just outside city limits may fall in the Roswell-Chaves County Extraterritorial Zoning Area or in county zoning, with different rules31.
