Zoning, building permits and septic rules in the Town of Hackettstown, New Jersey

Building or changing a home in the Town of Hackettstown, Warren County, New Jersey will most likely take both a town zoning permit and a construction permit1. Does Hackettstown, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. The Town of Hackettstown zones its own land, and the zoning officer administers it2. Warren County does not zone, because New Jersey gives zoning power to municipalities rather than counties3.

The Town's residential permit sheet names four districts: R-12.5, R-15 and R-30 single-family residential, plus R-12.5/Off single-family and office10. Lot rules depend on the district:

  • R-30: a principal building needs at least 30,000 square feet and 125 feet of frontage5. Yards are 25 feet on each side, 50 feet in front and 40 feet in the rear11.
  • R-15: at least 15,000 square feet and 80 feet of frontage6, with 15-foot side yards and 30-foot front and rear yards12.
  • R-12.5: at least 12,500 square feet and 60 feet of frontage13, with 10-foot side yards and 20-foot front and rear yards14.

Planned developments can use different numbers, and the Town's full Land Development Ordinance controls6. We could not confirm height limits, lot coverage or a minimum dwelling size, so ask the zoning officer.

Do you need a building permit in Hackettstown, and who issues it?

Yes, in practice you need two. The Town says that for changes to property you "will most likely require both zoning and construction permits"1. The zoning permit covers new residences, garages, sheds, decks, fences, pools, additions and fixed generators, and the Town warns the list is not complete1.

The construction permit comes from the Town's construction office under the New Jersey Uniform Construction Code15. Any new construction, and structural, plumbing, mechanical or electrical work on existing buildings, needs a construction permit; ordinary maintenance does not16. A complete application must be approved or denied within 20 business days17. Fees are set by the municipality, and the Town's zoning permit fee is shown on the application itself1819. The county does not issue building permits20.

Who do you call for building and zoning in Hackettstown?

Zoning permits go through the Town of Hackettstown Zoning Department21. Applications are available at the municipal building or online, and residential applicants attach a survey or an accurately hand-drawn site map19.

Construction permits and inspections go through the Town's Construction Office at 215 W Stiger St, which offers online access to construction permits22. Do not go to a Warren County planning counter for either one: inside Hackettstown, the Town is the office that decides.

How do septic permits work in Hackettstown?

We could not confirm who issues septic permits for a lot inside Hackettstown town limits. New Jersey law bars a building permit until the board of health with jurisdiction certifies the water supply and sewerage plans23. The septic tank, field or pit must also be inspected before it is covered24.

The Warren County Health Department issues septic and private well permits in the county725. Hackettstown also has its own Board of Health, so ask the county health department and the Town which board has jurisdiction over your address. Also ask whether a public sewer connection is available, since we could not confirm whether new homes in town must connect.

Warren County soils make the question matter: only about 6% of county soils are rated "not limited" for a conventional drain field26, so expect a site evaluation or an engineered system.

Can you live in an RV or tiny home in Hackettstown?

We could not confirm a rule for living in a recreational vehicle, camping on private land or occupying a tiny home inside Hackettstown, so do not assume any of them is allowed. The Town's zoning officer is the office to ask before you buy.

New Jersey limits HUD manufactured homes to use group R-5, single-family dwellings, and requires federal installation standards9. Whether Hackettstown's districts accept a manufactured home on a given lot is also unconfirmed.

What are the steps to build a home in Hackettstown, in order?

  1. Confirm the lot's zoning district, minimum lot size and yards with the Zoning Department2110.
  2. Ask the county health department and the Town which board has jurisdiction over septic and wells for your address2523.
  3. Apply for the zoning permit with a plot plan19.
  4. Apply to the Construction Office for the construction permit; plans are required for new construction, and building starts once the permit is issued1722.
  5. Stop work for the required inspections: footing, foundation, utility service (septic included), midpoint and final27.
  6. Get the certificate of occupancy after the final inspection28. If you built the home yourself, file the owner affidavit with the construction official first8.

What stays with Warren County, and what to check before you buy in Hackettstown?

Septic and well permits sit with the health authority, not the zoning office, and the Warren County Health Department is the county office to call25. A driveway onto a county road needs a permit from the Warren County Engineer29, and one onto a state highway needs a New Jersey DOT access permit30. For land outside town limits, see the Warren County page.

County-level numbers matter for budgeting: Warren County's effective property tax rate is 2.5%31, with a median bill of $8,156 a year32.

Watch-outs

  • Hackettstown's zoning sheet is a general guide, and the Town says the zoning permit does not release you from other local, county or state approvals1.
  • Planned developments in Hackettstown can follow different bulk rules than the standard districts5.
  • We could not confirm septic jurisdiction, sewer connection rules, floodplain rules, height limits or RV and tiny-home rules inside Hackettstown; ask the Zoning Department and the Warren County Health Department25.
  • New Jersey allows an owner to build a home for personal use without builder registration, but permits, inspections and code compliance still apply33.
