Does Greenwich Township, NJ have zoning, and what does it mean for lot size and setbacks?

Greenwich Township administers its own zoning ordinance, Chapter 16 of the township code, and approvals run through the land use board1. Warren County does not zone: New Jersey counties have no authority to zone unincorporated land10. The ordinance lists many districts, including R-75, R-7, R-2, R-1, TC, HPA and several business districts11. Check which district your parcel is in before you buy, because the numbers change a lot between them.

  • R-75: lots need at least 7,500 square feet7. Buildings need a 25-foot front yard, 10-foot side yard and 35-foot rear yard12, and buildings may cover no more than 20% of the lot13.
  • R-2: without public water, lots need at least 81,000 square feet, and 40,250 square feet where off-site public water serves the development8. Setbacks are 75 feet front, 40 feet side and 100 feet rear14, with impervious cover capped at 10%15.
  • R-1: lots need 81,000 square feet unless off-site public water serves the lot, which allows 40,250 square feet16. Setbacks are 50 feet front, 30 feet side and 50 feet rear17, with impervious cover capped at 15%18.

In all three districts, homes are limited to 2 1/2 stories or 35 feet19. Every dwelling must also meet a minimum floor area of 850 square feet for one bedroom, 1,000 for two, 1,200 for three, 1,600 for four and 2,000 for five9. That floor-area rule rules out most tiny homes on foundations.

Do you need a building permit in Greenwich Township, and who issues it?

Yes. A construction permit is required for new construction, and for structural, plumbing, mechanical and electrical work, under New Jersey's Uniform Construction Code2. Ordinary maintenance and routine repairs do not need one20. Warren County does not issue building permits21.

Greenwich Township's construction page lists the NJ DCA Office of Local Code Enforcement, Northern Regional Office in Asbury, as the agency for inspections, and the township's contact list names the State of NJ DCA as its building inspector3. For the application itself, call the township at (908) 859-090922 to confirm where to file, since we could not confirm the intake step from the township's page. A complete application must be approved or denied within 20 business days23. Fees are set by each municipality's own schedule24.

Owner-builders: a person building a new home for personal use is exempt from the state's new-home-builder registration, but the exception does not exempt the work from permits or inspections6. A certificate of occupancy requires an owner affidavit that the work conforms to law25.

How do septic permits work in Greenwich Township, NJ?

Septic permits for Greenwich Township come from the Warren County Health Department, which issues permits for individual systems under 2,000 gallons per day under N.J.A.C. 7:9A4. The Health Department will call the applicant when a permit is ready to be picked up, and its number is 908-475-620026. Septic and well work stays with the county even though the township handles zoning.

New Jersey requires a permit before a realty improvement that needs sewerage facilities is built27, and septic tanks and fields must be inspected before they are covered28. Warren County soils are demanding: only about 6% of county soil is rated "not limited" for a conventional drain field, so expect a site evaluation and possibly an engineered system29. Private wells need a permit under the state well-drilling rules30. Zoning also ties lot size to public water in R-1 and R-2, so a lot with no public water usually means the larger minimum16.

Can you live in an RV or tiny home in Greenwich Township, NJ?

No for an RV or camp trailer. Greenwich Township's zoning chapter says trailers, camp trailers and house trailers may not be used for dwelling or sleeping purposes, and the exceptions cover trailers used as temporary field offices on construction projects and trailers owned by a township property owner5. Parked trailers must also sit within the residential zone's yard setbacks5. Living in one while you build is not allowed.

Tiny homes are not defined in the pages we reviewed, so we could not confirm a tiny-home rule. A tiny home on a foundation still has to meet the township's minimum floor areas9 and the Uniform Construction Code2. Ask the Zoning Officer at (908) 859-0909 before you buy22. Accessory residential dwelling units are only a conditional use in the R-7 and town center zones3132.

Building a home in Greenwich Township: the steps, in order

  1. Confirm the zoning district and its lot size, setbacks and coverage limits with the Zoning Officer at (908) 859-090922.
  2. If you are dividing land, expect land use board review; tracts of 30 or more acres can use the cluster subdivision path33.
  3. Get septic approval from the Warren County Health Department at 908-475-620026.
  4. Apply for the construction permit with a complete Code Permit Application and plans; new construction needs plans and specifications23.
  5. If the driveway meets a county road, a County driveway permit is required34; a State highway needs a State access permit35.
  6. Book inspections at least 24 hours ahead through the Northern Regional Office3. Footing, foundation, utility-service and final inspections are required for one- and two-family dwellings, and utility-service inspections include septic36.
  7. Pass the final inspection to receive the certificate of occupancy37.

What stays with Warren County, and what to check before you buy in Greenwich Township

The township sets zoning; Warren County handles septic and private wells4. For land outside Greenwich Township, see the Warren County page. Check the zoning district on the Chapter 16 map and its lot-size rule11, whether public water is available, the soil evaluation, and flood rules, which we could not review. Warren County's effective property tax rate is 2.5%, with a median bill of $8,156 a year3839. Typical home value in the county is $429,48440.

Watch-outs

  • We could not confirm Greenwich Township's rules on tiny homes, manufactured homes, temporary camping, short-term rentals, wells, floodplain development or building fees; ask the Zoning Officer at (908) 859-0909 before you commit22.
  • Trailers may not be used as a dwelling or for sleeping anywhere in the township, so plan housing during construction5.
  • Owner-builder status does not skip permits or inspections: only builder registration is waived6.
  • Lot-size minimums in the rural residential districts drop only where off-site public water serves the lot; otherwise the larger minimum applies8.
