Does Ogdensburg have zoning, and what does it mean for lot size and setbacks?

Yes. The Borough of Ogdensburg zones its own land under Chapter 30, Land Development, which divides the borough into 12 districts2. Sussex County does not zone for the borough11. The official zoning map is the paper land use and zoning map kept in the borough clerk's office, dated October 28, 202512.

Rules change by district, so find your parcel's district first. In the R10 single family district, a dwelling needs 10,000 square feet, 100 feet of width and 40 feet of frontage6. R10 yards are 35 feet in front, 30 in the rear and 25 on the side13, with 30% maximum lot coverage14 and a 35-foot height limit15. Homes in R10 must have at least 1,250 square feet of floor area8.

The R100 large-lot district is much stricter: 100,000 square feet and 200 feet of width per dwelling7, yards of 75 feet front and rear and 40 feet on each side16, 15% lot coverage17 and at least 2,000 square feet of floor area9. The other districts were not reviewed.

Do you need a building permit in Ogdensburg, and who issues it?

Yes for new construction. The borough's Zoning Department states that a zoning permit is required before a building permit for new construction, additions, sheds, barns, garages, fences, pools, decks and outdoor wood boilers1. New Jersey's Uniform Construction Code then requires a construction permit for any new construction and for structural, plumbing, mechanical and electrical work on existing buildings3. Ordinary maintenance is the exception3.

The borough's website lists a Building Department page for the State of New Jersey, which routes inspection requests to the Department of Community Affairs Northern Regional Office, in writing only18. We could not confirm from the borough's pages which desk accepts building permit applications or what Ogdensburg's fee schedule is; call Borough Hall to ask19. New Jersey municipalities set their own construction permit fees20.

How do septic permits work in Ogdensburg?

Septic records for Ogdensburg addresses are searched through the Sussex County Division of Health, which also handles plan requests4. Sussex County lists a $150 fee for a standard residential system, with 4 required inspections, and $200 when pumps or alarms are needed5.

New Jersey law bars a building permit until the board of health with jurisdiction certifies the sewerage facilities, and a septic system cannot be covered until the board of health inspects it21. Ogdensburg also has its own Board of Health, so confirm with Borough Hall whether the borough or the county issues the septic approval for your lot19. We could not confirm that.

Soils matter: USDA rates only about 5% of Sussex County soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system22. Private wells need a state drilling permit, and municipal or county health officials issue the construction permit23.

Can you live in an RV or tiny home in Ogdensburg?

We could not confirm Ogdensburg's rules on living in an RV, camping on a lot, tiny homes or accessory apartments. The borough code has a chapter on trailers and trailer camps that we did not read, so do not assume either way. Ask the Zoning Officer before you buy or park anything on a lot1. For a manufactured home, New Jersey limits HUD homes to use group R-5 single-family dwellings and puts installation oversight with the federal government24.

Building a home in Ogdensburg: the steps, in order

  1. Find your parcel's zoning district on the borough's zoning map and check lot size and yards for it12.
  2. Get a zoning permit from the Zoning Officer before applying for a building permit1.
  3. Arrange septic approval and well approval before construction starts21.
  4. Obtain the construction permit; New Jersey requires all state, county and local approvals first25.
  5. Request inspections in writing as work proceeds18. Footing, rough plumbing and electrical, and framing inspections come before finishes cover the work26.
  6. Pass the final inspection to get a Certificate of Occupancy27. Owner-built homes must also file an affidavit with the construction official28.

Subdividing a lot also triggers county planning board review29 and the borough's own subdivision rules30.

What stays with Sussex County, and what to check before you buy in Ogdensburg

Sussex County does not issue building permits or set zoning for Ogdensburg11. The county's Planning Board reviews site plans and subdivisions31, and the Division of Health handles septic records4. The county page for land outside the borough is Sussex County.

Before buying, check the district on the zoning map, septic soils, and flood-hazard rules; the borough has a floodplain chapter we did not read, so ask Borough Hall19. Sussex County's effective property tax rate is 2.5% and the median tax bill is $8,462 a year3233. About 84% of the county is wooded34.

Watch-outs

  • The borough's pages did not show who accepts building permit applications or the fee schedule; call Borough Hall before you budget19.
  • We reviewed only two of the borough's residential districts; other districts have different lot sizes and yards, so confirm your parcel's district with the Zoning Officer1.
  • Owner-builders are exempt from builder registration only; permits, inspections and an affidavit still apply10.
  • We could not confirm rules on RVs, tiny homes, accessory apartments, short-term rentals or flood-hazard development in Ogdensburg; ask the Zoning Officer1.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
