Zoning, building permits and septic rules in Lafayette Township, New Jersey

Lafayette Township, in Sussex County, New Jersey, requires a construction permit for a new home, and the township's own construction office handles it1. Lafayette sets its own zoning, with a 5-acre minimum lot in its R-5.0 district2. Septic approval comes from the board of health with jurisdiction, and Sussex County publishes septic fees3; confirm with the Lafayette Board of Health which applies to your lot4.

Does Lafayette Township, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. Lafayette Township adopts and enforces its own zoning in Chapter 13 of the township code, and Sussex County has no authority to zone67. The township's zoning officer enforces the ordinance14.

For a conventional single-family lot, the minimum lot area is 5 acres in the R-5.0 district2, 4 acres in R-4.08 and 2.5 acres in R-2.59. These minimums apply only if the lot has enough unconstrained land under the ordinance.

Principal-dwelling yards in R-5.0 are at least 75 feet in front, 60 feet at the side and 125 feet at the rear15. Height is capped at 35 feet for principal buildings in R-5.016, and lot coverage is capped at 10% there17. Find your parcel's district before relying on any of these numbers; we could not confirm the parcel-to-district mapping, so ask the zoning officer18.

Do you need a building permit in Lafayette Township, and who issues it?

Yes. New Jersey's Uniform Construction Code makes it unlawful to construct, enlarge, alter or demolish a structure without first filing an application and obtaining a permit5. In Lafayette Township the township's own construction office enforces that code1; Sussex County does not issue building permits19.

No permit can issue until required state, county and local approvals are in place20. Inspections are periodic, and the township now takes inspection requests through an online form instead of by phone1. A certificate of occupancy is required before a new building is used21.

We could not confirm the township's permit fee schedule or its application steps; the construction office's page points to the township's forms and applications page.

How do septic permits work in Lafayette Township?

New Jersey law bars a building permit for a new home until the board of health having jurisdiction certifies that the proposed water supply and sewerage facilities meet state and any stricter local standards11. The system must also be inspected before it is covered22.

Sussex County's Office of Environmental Health publishes the septic fee schedule: $150 for a standard residential system with four required inspections, and $200 where pumps, alarms or pressure calculations are needed23. Lafayette also has its own Board of Health4. We could not confirm whether the county or the township board reviews a given Lafayette lot, so call the Board of Health first, then the county office24.

Soils matter: about 5% of Sussex County soils rate "not limited" for a conventional drain field, so expect a site evaluation and possibly an engineered system25. Wells need a state drilling permit plus a municipal or county health permit26.

Can you live in an RV or tiny home on your land in Lafayette Township?

Not in an RV, in the township's three residential districts. Recreational vehicles with sleeping facilities may be parked or stored there but may not be occupied at any time10. Occupancy rules in the township's other districts were not checked.

We could not confirm a township rule for tiny homes or for a single manufactured home on a lot. The statewide rule limits HUD manufactured homes to single-family use27. Ask the zoning officer before you buy14.

The only accessory apartments the ordinance lists in the residential districts are affordable accessory apartments28.

Building a home in Lafayette Township: the steps, in order

  1. Confirm the lot's zoning district and minimum lot size with the zoning officer14.
  2. Get the board of health's septic and water certification, since no building permit issues without it11.
  3. If you are subdividing, apply to the Land Use Board, which reviews subdivisions and site plans and hears variances29; subdivisions also go to the Sussex County Planning Board before recording30.
  4. Apply for the construction permit at the township construction office1.
  5. Request each inspection through the township's online form1.
  6. If you built or acted as your own contractor, file the owner's affidavit with the construction official before the certificate of occupancy12.

What stays with Sussex County, and what to check before you buy

The county's page for land outside the township is Sussex County. For Lafayette lots, the county reviews subdivision and site-plan applications under its Land Development Standards31, and it publishes septic fees32.

Owner-builders are exempt from new-home builder registration, but not from construction permits or inspections33. Sussex County's effective property tax rate is 2.5% and the median bill is $8,462 a year1334. Floodplain rules and driveway permits were not confirmed; a driveway onto a state highway needs a state access permit35.

Watch-outs

  • The 5-acre, 4-acre and 2.5-acre minimums apply only to conventional lots with enough unconstrained land, and lot averaging or cluster layouts follow different rules2.
  • RV occupancy is banned in the residential districts, so living in a camper while you build is not allowed there10.
  • We could not confirm who reviews septic plans for a Lafayette lot; call the Lafayette Board of Health before signing a contract4.
  • The township construction office keeps short hours, so call 973-383-1817 before visiting1.
