The Borough of Branchville, New Jersey (Sussex County) zones its own land under Chapter 1231 and enforces building permits through its own borough Building Department2. Septic permits for individual systems inside the borough come from the Branchville Board of Health, not the county3. Sussex County itself has no zoning power4; for land outside borough limits, see the Sussex County page.

Does Branchville, NJ have zoning, and what does it mean for lot size and setbacks?
Yes. The Borough of Branchville administers its own zoning under Chapter 1231. Its districts are Residential 1, Residential 2, Residential 3, Commercial, Professional and Office, and Highway Commercial11.
In the Residential 1 and Residential 2 districts, a principal building lot needs at least 15,000 square feet, 100 feet of width and 150 feet of depth6. Required yards are 35 feet in front, 35 feet in the rear and 15 feet on the side7. A principal building can be up to 35 feet tall, measured from the front elevation, with an exemption for structures raised to meet flood elevation standards8.
Dwellings in those districts need at least 960 square feet of livable first floor for a ranch-type house, or 750 square feet for a two-story house12. Residential 3 has a larger lot minimum and larger dwelling minimums, so check the district for your parcel with the borough6.
Do you need a building permit in Branchville, and who issues it?
Yes. New Jersey's Uniform Construction Code makes it unlawful to build, enlarge, alter or demolish a structure without first applying to the construction official and getting a permit5. In Branchville the borough's own Building Department enforces that code2. Sussex County does not issue building permits; the county says building permits and zoning information are handled by the municipalities13.
Fees follow the borough's Chapter 52 schedule, and the certificate of occupancy fee is $909. The borough Construction Department keeps office hours on Tuesdays and Thursdays beginning at 4:00 PM at the Municipal Office14.
Building your own home does not remove the permit: the owner-builder exemption concerns builder registration only, and an owner-built new home needs an affidavit filed before a certificate of occupancy is issued15.
How do septic permits work in Branchville?
Inside Branchville, no one may locate, construct or alter an individual sewage disposal system until the borough Board of Health issues a permit3. The borough applies the state's individual subsurface sewage disposal standards16.
State law also bars any building permit until the board of health having jurisdiction certifies the proposed sewerage facilities17, and a septic system cannot be covered until a board of health representative inspects it18. A property on the borough sanitary sewer needs a permit to connect19.
For Sussex County Environmental Health's published fee schedule, which lists a standard residential system at $150 with four inspections, ask the borough whether those county fees apply inside Branchville20. The county's Office of Environmental Health at 973-579-0370 holds septic plan records21.
Can you live in an RV or tiny home in Branchville?
We could not confirm that. The borough's code limits a residential lot to one stored boat and one stored travel trailer, which is a storage limit and not a rule about living in an RV10. Branchville's rules on camping, tiny homes and manufactured homes were not found, so ask the Zoning Officer through the borough office at 973-948-4626 before buying14.
New Jersey limits HUD manufactured homes to single-family use and sends their installation through federal oversight22.
Building a home in Branchville: the steps, in order
- Confirm the zoning district and lot dimensions in Chapter 123 with the borough11.
- Get Board of Health approval for the septic system, or a sewer connection permit if the lot is on borough sewer319.
- Apply to the Construction Department for a construction permit2.
- Pass the periodic inspections the code requires, including footing and framing23.
- Obtain the certificate of occupancy after final inspection24.
What stays with Sussex County, and what to check before you buy
Sussex County's Planning Board reviews site plan and subdivision applications25. Inside Branchville, land division is also regulated by Chapter 10426. Land outside borough limits follows different rules, covered on the Sussex County page.
A driveway onto a state highway needs a state access permit27. Flood rules, driveway rules and private wells inside the borough were not confirmed; a private well needs a state drilling permit and a local well construction permit28.
Sussex County's effective property tax rate is 2.5%29.
Watch-outs
- Branchville's rules on RVs, tiny homes, accessory dwellings, floodplain development and driveways were not confirmed; ask the borough office at 973-948-462614.
- Septic fees inside the borough may differ from the county fee schedule; confirm which applies with the Board of Health before budgeting30.
- Septic soil ratings are county-wide: only 5% of Sussex County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system31.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
