Does Barnegat Township have zoning, and what does it mean for lots, RVs and tiny homes?

Yes. Barnegat Township adopts and administers its own zoning in Chapter 55 of the township code1. Ocean County cannot zone, because New Jersey limits zoning authority to municipalities3. The township publishes districts including R-40, R-20, R-MF and a preserved waterfront zone8.

Standards depend on the district. In the R-MF zone, a single-family lot needs 7,500 square feet, 75 feet of width and 100 feet of depth9. Setbacks there are 30 feet in front, 8 feet on one side, 20 feet for both sides combined and 25 feet in the rear10. Buildings top out at 35 feet or 2.5 stories11. Other districts differ, so ask the zoning officer for your lot's district standards.

Vehicle campgrounds are a permitted use in R-4012, but we could not confirm any rule that lets you live in an RV, manufactured home or tiny home on a private lot. Call the zoning officer before you buy.

Do you need a building permit in Barnegat Township, and who issues it?

Yes. A construction permit is required for new construction and for work on existing buildings under New Jersey's Uniform Construction Code5. In Barnegat Township the township's own building official's office enforces that code2. Ocean County does not issue building permits for the township13.

The Construction Office also says a separate zoning permit is required before construction, alteration or excavation for any building or structure, or any use of a building or land4. Call the Barnegat Township Construction Office at 609-698-00804. New homes also need a certificate of occupancy before use14. We could not confirm the township's fee schedule.

How do septic permits work in Barnegat Township?

New Jersey requires the board of health with jurisdiction to certify water and sewerage plans before a building permit issues15. The township's Construction Office lists county health department approval for septic and wells as a prior approval4. Septic in Ocean County appears to run through the Ocean County Health Department6, reachable at 732-341-970016.

We could not confirm whether the township's own sewage disposal chapter adds requirements, so ask the health department which board of health covers your lot. Conventional drain fields rate poorly here: USDA rates 0% of county soils as not limited for them17, so expect a site evaluation and possibly an engineered system. The state also requires inspection before a septic system is covered18.

Building a home in Barnegat Township: the steps, in order

  1. Confirm the district and standards with the zoning officer at the Construction Office, 609-698-00804.
  2. Line up outside approvals the township lists: Pinelands approval west of the Parkway, DEP approval near waterfront and wetlands, and state highway access approval on state roads4.
  3. Get county health department approval for septic and well4.
  4. Apply for the zoning and construction permits4.
  5. Pass the required inspections at the footing, rough plumbing and electrical, and framing stages19.
  6. If you built it yourself, file the owner-built affidavit before the certificate of occupancy7.

What stays with Ocean County, and what to check before you buy?

Ocean County does not zone3, but its Planning Board reviews subdivisions that affect county roads or drainage20. Septic and wells go through the county health department4. For the county's wider picture, see the Ocean County page.

Check whether the lot lies east or west of the Parkway, since the township notes Pinelands approval applies west only4. The township also has a flood damage prevention chapter that we could not confirm details of, so ask the Construction Office about flood zones. Ocean County's effective property tax rate is 1.8%21.

Watch-outs

  • We could not confirm rules for living in an RV, manufactured home or tiny home on a private lot in Barnegat Township; ask the zoning officer at 609-698-00804.
  • Nuisance rules bar waste from privies or cesspools reaching Barnegat Bay or Double Creek, which matters for waterfront lots22.
  • Owner-builders still need permits and inspections; the affidavit is a condition of the certificate of occupancy, not an exemption23.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
