Do you need a building permit in Wall Township, NJ?

Yes. New Jersey requires a construction permit for new construction and for structural, plumbing, mechanical or electrical work on existing buildings, and ordinary maintenance is the exception10. Wall Township operates its own enforcing agency for that code, called the Building Department of the Township of Wall1. The Building Department states that it enforces the New Jersey Uniform Construction Code in Wall Township2.

Wall's construction fees are set by the township in a published schedule, and the plan review fee is 20% of the construction permit fee, with a state surcharge added9. For work that needs plan review, the Building Department says reviews may take up to 20 business days2.

Who issues building permits in Wall Township, and how do you reach them?

The Wall Township Building Department at 2700 Allaire Road issues construction permits and runs inspections; call (732)449-84442. Its page says that after plans are approved by the Land Use Office, an applicant can apply for construction permits2. The county does not issue the permit: the Uniform Construction Code is enforced by municipally employed, state-licensed code officials10.

When the building is finished, the state requires a certificate of occupancy before a new building is used or occupied11.

Does Wall Township have zoning, and what does it mean for lot size?

Yes. Wall Township adopts and administers its own zoning in Chapter 140, Land Use and Development Regulations, and its zoning map divides the township into published districts36. The county does not zone: Monmouth County's own regulations state that land use and intensity of development are controlled by municipal zoning12.

Lot sizes are set district by district. The rural residential districts require a minimum lot size of five acres in RR-5 and six acres in RR-67. Minimum dwelling size, setbacks, lot coverage and height are set by the district schedule in the township code; we could not confirm those figures here, so ask the Land Use Office for the schedule for a specific parcel13. We also could not confirm Wall's rules on RV occupancy, tiny homes or accessory dwellings.

How do septic permits work in Wall Township?

New Jersey law bars a building permit for a new realty improvement until the board of health having jurisdiction certifies that the water supply and sewerage facilities comply with state standards5. A septic tank or tile field cannot be covered until an authorized board of health representative has inspected it14.

Which health office covers Wall is the part we could not confirm. The Monmouth County Office of Public Health oversees septic approvals and inspections only for its member municipalities15, and other Monmouth County municipalities are assigned to different local health departments16. Ask the Wall Township Building Department which health office certifies septic and wells for your address. Properties on municipal water and sewer generally do not involve the county health department15.

Building a home in Wall Township: the steps, in order

  1. Confirm the parcel's zone and lot-size rules with the Land Use Office74.
  2. Submit a New Home Zoning Permit Application to the Land Use Office to learn whether additional approvals are needed4.
  3. Get septic and well certification from the health office with jurisdiction before the building permit issues5.
  4. Apply to the Building Department for construction permits once plans are approved2.
  5. Call for the required inspections with at least 24 hours' notice17.
  6. File the owner's affidavit if you built the home yourself, then obtain the certificate of occupancy8.

What stays with Monmouth County, and what to check before you buy

Outside Wall's own authority, the county reviews certain subdivisions and site plans, and covers septic only for its member municipalities1815. Site plans for one- or two-family residential units are expressly exempt from county Development Review Committee review19. A driveway onto a state highway needs a state access permit20. For the county-wide picture, see the Monmouth County page.

Carrying costs are county-level: Monmouth County's effective property tax rate is 1.8%21.

Watch-outs

  • Owner-builders in New Jersey are exempt from builder registration, not from construction permits; the certificate of occupancy requires an owner's affidavit22.
  • Which health office certifies septic and wells inside Wall Township is unconfirmed; the Building Department can tell you before you sign a contract16.
  • A zoning permit from the Land Use Office comes first; the building permit follows once plans are approved2.
