Does West Cape May have zoning, and what does it mean for lot size and setbacks?

Yes. The Borough of West Cape May, in Cape May County, adopts its own zoning under Chapter 27 of the borough code, with districts R-1 through R-5, C-1 through C-3 and P9. Cape May County does not zone parcels; New Jersey gives that power to municipalities10.

In the R-1 urban residential district, a single-family lot needs at least 5,000 sq. ft., with 20 ft front and rear yards, 6 ft side yards, 40% maximum lot coverage and a 35 ft height limit411. In the R-2 rural residential/agricultural district, the single-family minimum is 7,500 sq. ft. with a 150 ft lot depth12. R-3 through R-5 and the commercial districts were not reviewed, so check the zoning map at the borough offices for any specific lot9.

Any lot not served by an off-site sewerage system needs at least 35,000 sq. ft. in every district, unless the lot will be served by sewer under an approved application5. Table values were amended in July 20264, so confirm the current figures with the borough before you buy.

Do you need a building permit in West Cape May, and who issues it?

Yes. Construction, alteration, demolition and changes of use in West Cape May fall under New Jersey's Uniform Construction Code, and a permit is required13. The permit is issued by the municipal construction official, not the county2. Inspections happen at set stages, such as footings, rough plumbing and electrical, and framing, and a certificate of occupancy follows final inspection1415.

West Cape May adds its own steps. A borough zoning permit is required before a building is erected or altered, and it lapses if no building permit issues within six months16. The borough also requires a certificate of occupancy for new or altered buildings, with proof of proper disposal of construction and demolition debris17.

We could not confirm which office reviews and inspects construction permits for the borough. Call the Borough Offices at18 and ask who the construction official is and where to file.

How do septic permits work inside West Cape May?

Septic permits for West Cape May are handled by the Cape May County Health Department, Environmental Services Division, which reviews design and inspections of septic systems with licensed professional engineers319. New Jersey law bars issuing a building permit until the board of health certifies that the sewerage facilities comply20.

Where borough sewers are provided, private septic tanks and cesspools are not permitted at all6. A new home on a sewered street instead needs a borough connection permit; the residential permit and inspection fee is $300 and the new service connection fee is $1,200, with connection costs borne by the owner21.

On an unsewered lot, plan for the 35,000 sq. ft. minimum5. Cape May County's soils make this harder: about 0.2% of the county's soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system22. We could not confirm which borough streets are unsewered; ask the borough's water and sewer office.

Can you live in an RV or tiny home in West Cape May?

We could not confirm a borough rule on living in a recreational vehicle, camping on private land or a tiny home. The borough code has chapters on trailers and campgrounds that we could not review, so call the Borough Offices before parking an RV or placing a tiny home on any lot18.

One rule is clear: in the R-1 district only single-family and duplex dwellings are allowed by right, and all other uses are prohibited, so a manufactured or mobile home cannot be used as a dwelling there23. Statewide, HUD manufactured homes are limited to single-family use24. Other districts were not assessed.

Can you build your own home in West Cape May?

Owner-builders can build a home for their own use, but permits and inspections still apply. New Jersey's exception for owner-builders covers new-home builder registration only; it does not waive construction permits or Uniform Construction Code compliance7. Before a certificate of occupancy issues, the owner files an affidavit with the construction official certifying that the work conforms to law and acknowledging that owner-performed work is not covered by the New Home Warranty and Builders' Registration Act25.

Building a home in West Cape May: the steps, in order

  1. Confirm the lot's zoning district and sewer status with the Borough Offices918.
  2. If the lot is unsewered, start with the Cape May County Health Department, because the board of health must certify sewerage facilities before a building permit can issue2019.
  3. Get a borough zoning permit; it lapses if no building permit issues within six months16.
  4. Apply for the building permit under the Uniform Construction Code13.
  5. If you need a well, get a New Jersey DEP well-drilling permit before drilling8.
  6. Pass the staged inspections and final inspection, then obtain the certificate of occupancy1417.

What stays with Cape May County, and what to check before you buy in West Cape May

A driveway or other access onto a State highway needs a state permit28. We could not confirm the borough's flood-damage rules or any short-term rental rule; ask the Borough Offices, especially for a lot near the water.

Costs are county-level: Cape May County's effective property tax rate is 1.3%, with a median bill of $5,233 a year2930. The typical home value is $804,63731.

Watch-outs

  • Borough zoning table values were amended in July 2026, so confirm current lot sizes and setbacks with the Borough Offices before you buy4.
  • Septic is a county matter, not a borough one; the Cape May County Health Department must sign off before a building permit can issue20.
  • Where borough sewers are provided, a septic system is not allowed, and connection fees of $300 and $1,200 apply21.
  • We could not confirm borough rules on RVs, tiny homes, accessory apartments or flood zones; call the Borough Offices before you commit18.
