Dawes County, Nebraska

Zoning, building permits and septic rules in Chadron, Nebraska

Chadron, Nebraska (Dawes County) adopts and administers its own zoning inside city limits1. The city's Building and Zoning office requires building permits for all new residential construction and additions2. Septic systems are registered with the state Onsite Wastewater Program rather than the city3. Land outside city limits answers to Dawes County instead4.

Does Chadron, Nebraska have zoning?

Yes. The City of Chadron adopts and administers its own zoning regulations and zoning district map for land inside city limits1. The city clerk maintains the zoning map, and it is shown at City Hall5.

Chadron's base districts are AG, RR, R-1, R-2, R-3, MH, LC, CC, DC, GC, LI and GI, with MU and PUD as overlay districts5. Lot rules change by district, so find the parcel's district before you plan anything:

  • R-1 (Low-Density Residential): single-family lots need at least 8,000 square feet and 75 feet of width7. Setbacks are 30 feet in front and 20 feet at the rear10. Buildings may cover at most 35 percent of the lot11.
  • RR (Rural Residential): lots need at least 1 acre12, with a 30-foot front setback and a 25-foot rear setback13.
  • AG (Agricultural): lots need at least 2.5 acres14, with 50-foot front and rear setbacks15.

The zoning rules we could read do not capture every table note, so confirm any dimension with the city before you buy.

Do you need a building permit in Chadron, and who issues it?

Chadron's Building and Zoning office, part of Community Development, issues building permits inside city limits2. The city states that building permits are required for all new residential or commercial construction sites, additions and structural alterations2. Cosmetic work such as siding, roofing and painting generally needs no permit2.

Chadron has adopted the 2018 International Building Code and the 2018 International Residential Code, excluding sections R309.5 and R313 on sprinklers for one- and two-family dwellings6. Separate city permits apply to demolition16, and to moving a building over 400 square feet, which also needs a bond of at least $5,00017.

A building that received a city permit cannot be occupied until the building official issues a certificate of occupancy18. Call the Building and Zoning office at 308-432-0506 to ask about your project2. We could not confirm current permit fees, so ask the office for the fee schedule.

How do septic permits work inside Chadron?

Septic rules in Nebraska come from the state, not from the city's Building and Zoning office. Any dwelling that produces wastewater must have an onsite system that meets Title 124 or connect to a public sewer19. Any onsite system that is built, altered or changed must be registered with the state Onsite Wastewater Program, and the work must be done by a state-certified professional3.

Most Nebraska systems are built under Authorization by Rule, which does not require a state construction permit, but some systems need a permit because of wastewater volume or site conditions20. City or county requirements apply separately and in addition8.

We could not confirm whether a given lot inside Chadron is served by city sewer or what the city requires when sewer is not connected. Ask the Building and Zoning office whether sewer reaches your lot before you plan on a septic system.

Can you live in an RV or tiny home in Chadron?

We could not confirm Chadron's rules for living in an RV, tiny home or manufactured home on a lot inside city limits. Chadron has an MH district5, but the district table that sets which uses are allowed where did not give a readable answer for RVs or tiny homes.

Nebraska law classifies a tiny house as a manufactured home, modular unit or recreational vehicle, and state classification does not give unrestricted permission to live in it; local zoning, building and health requirements still apply21. Ask the Building and Zoning office, at 308-432-0506, which district your lot is in and whether the intended use is allowed there2.

Building a home in Chadron: the steps, in order

  1. Find the parcel's zoning district with the Building and Zoning office, since lot size and setbacks depend on it5.
  2. Ask the same office whether city sewer serves the lot; if not, plan a Title 124 onsite system registered with the state Onsite Wastewater Program193.
  3. Apply for a building permit from the city before starting new residential construction2.
  4. Build to the 2018 International Residential Code as Chadron has adopted it6.
  5. Get a certificate of occupancy before anyone moves in18.

Building on your own property does not make you a contractor under Nebraska's Contractor Registration Act, but that exemption does not waive building permits or inspections9.

What stays with Dawes County, and what to check before you buy

The city's rules stop at city limits. Land outside Chadron falls under the Dawes County zoning resolution, which the county describes as applying to the unincorporated area22. The county's Zoning Office, the Dawes County Assessor's office, handles zoning permits there, and sends anyone inside Chadron back to the city23. See the Dawes County page for the rules on land outside the city.

Chadron's zoning jurisdiction can also reach an unincorporated area beyond the city boundary1. If the parcel is just outside city limits, ask both offices which one controls it.

County-level figures: Dawes County's effective property tax rate is 1.3 percent24, and annual precipitation averages 18.3 inches25. A mapped floodplain triggers its own permit under Nebraska floodplain rules26; we could not confirm Chadron's floodplain article, so ask the city whether the parcel is mapped.

Watch-outs

  • Chadron's own zoning can extend into the unincorporated area beyond the city boundary, so a parcel near city limits may answer to the city instead of the county1.
  • We could not confirm the current Chadron building permit fee schedule; ask the Building and Zoning office at 308-432-0506 before budgeting2.
  • We could not confirm Chadron's rules for RVs, tiny homes, accessory dwellings, short-term rentals, wells or minimum home size; call the Building and Zoning office before buying for any of these2.
  • Local city or county septic requirements apply on top of the state's Title 124 rules8.
