Stanly County, North Carolina

Zoning, building permits and septic rules in Locust, North Carolina

The City of Locust, North Carolina (Stanly County) sets its own zoning and issues zoning compliance permits through its Planning & Zoning department1. Building permits come from the county, not the city: Stanly County Central Permitting or the Cabarrus County Building Standards Department, depending on which side of the county line the lot sits, and neither issues one until the city zoning permit is in hand23. Septic permits are a county health matter4.

Does Locust, NC have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Locust regulates development inside its limits through its own Land Development Ordinance, run by the city's Planning & Zoning department1. The city has published districts including OPS, GR, NR, CC, HC, LHC, CBI and MH9.

In the general residential district, a lot without a subdivision sketch or preliminary plan approved before the ordinance took effect needs at least 20,000 sq ft and 90 ft of width7. Setbacks for those lots are 40 ft front, 25 ft rear, 10 ft side and 20 ft on the street side of a corner lot10. Other districts have their own dimensions, and we did not confirm them, so ask Locust Planning & Zoning about the exact district before you buy11.

The city is updating its ordinance for Chapter 160D, so numbers in the older published copy may change1.

Do you need a building permit in Locust, and who issues it?

Locust does not issue building permits itself. Inside Locust, a building permit comes from the county that covers the lot: Stanly County Central Permitting for the part of the city in Stanly County, or the Cabarrus County Building Standards Department for the part in Cabarrus County23.

The city's zoning permit comes first. A zoning permit is required to obtain a building permit from the county when placing any new structures on a property5. Neither county will issue a building permit until the city's zoning compliance permit has been obtained2.

Stanly County's permits run through its OpenGov platform12. We did not confirm the city's own rules on building inspections or certificates of occupancy, so ask the county office that issues your permit.

How do you get a zoning permit in Locust?

Residential zoning applications go to the Locust Planning & Zoning department, in person or by mail at 186 Ray Kennedy Drive11. The fee is due when the application is submitted, and permits may not be granted the same day5. The city says smaller projects are handled within two weeks of a complete application5.

The zoning permit is required before the county building permit when placing any new structure on a property5. We could not confirm the current fee amounts, so call the city at 704-888-526011.

How do septic permits work inside Locust?

For the part of Locust in Stanly County, septic permits are handled by the Stanly County Environmental Health Department, which provides soil testing for septic systems and inspects and approves septic tank systems413. North Carolina requires an improvement permit and construction authorization before a wastewater system is built or repaired14.

In Stanly County, an Authorization for Wastewater System Construction must be issued before building permits can be obtained or the septic system installed15. A site evaluation also requires an application and backhoe pits15. Plan for that before the building permit step.

We could not confirm whether city sewer serves a given lot, or which health department covers a lot on the Cabarrus County side. Ask the city at 704-888-5260 before you assume septic11.

Can you put a manufactured home, tiny home or RV on a lot in Locust?

Manufactured homes are treated as a use with supplemental regulations under the city's ordinance, and the city says existing mobile home parks may not be expanded6. North Carolina law bars a city from excluding manufactured homes from its entire zoning jurisdiction16.

A tiny home can be a permanent dwelling in North Carolina if it is permitted by the local building official and meets applicable local zoning and setback rules17. We did not find a Locust rule on living in an RV or on a tiny home specifically, so ask Locust Planning & Zoning before you place one11.

Building a home in Locust: the steps, in order

  1. Confirm the district, lot size and setbacks with Locust Planning & Zoning11.
  2. If the lot is on private septic, apply to Stanly County Environmental Health for the site evaluation; the construction authorization must be issued before building permits15.
  3. Obtain the city's zoning compliance permit, which the county requires first2.
  4. Apply for the building permit with Stanly County Central Permitting or Cabarrus County Building Standards23.
  5. Request inspections; permit holders must request them18.
  6. Do not occupy until a certificate of occupancy or compliance is issued19.

What stays with Stanly County, and what to check before you buy in Locust

Septic, wells and building permits do not move to the city. Stanly County handles septic4 and North Carolina wells are permitted by the local health department20. Stanly County's own zoning applies outside municipal zoning jurisdictions, not inside Locust21; for land outside the city, see the Stanly County page.

Owner-builders in Stanly County who act as their own general contractor must file an owner affidavit when the project costs over $40,000, and cannot rent, lease or sell for 12 months after the certificate of occupancy8. Stanly County's typical home value is $309,91222, and its effective property tax rate is 0.6%23.

Watch-outs

  • The city's Land Development Ordinance is being updated for Chapter 160D, and the copy we reviewed dates from 2021, so confirm dimensions with Locust Planning & Zoning711.
  • Locust straddles the Stanly and Cabarrus County line, so the building permit office depends on which county the parcel is in23.
  • We could not confirm RV rules, accessory dwelling rules, floodplain permits, or driveway permits inside Locust; ask Locust Planning & Zoning11.

Unanswered questions are usually a sign that Locust publishes no rule on the point, not that none exists. Stanly County’s page lists the county offices to call.
