The Town of Whitehall, Montana requires permits before a building or other structure is erected, moved or altered inside town limits, and applications go to Town Hall for Planning Board review12. Whitehall runs its own zoning with Residential, Commercial and Industrial districts3. Septic permits come from Jefferson County Environmental Health, and we could not confirm that its program covers addresses inside town4.

- Power Bluetti Solar generators and home battery backup for living off the grid.
- Septic Soil percolation test kit Run your own perc test before paying an engineer — the first thing a septic office asks about.

Does Whitehall, Montana have zoning, and what does it mean for lots, RVs and rentals?
Yes. The Town of Whitehall adopted its own zoning ordinance, which governs development and use of land within town limits and land annexed to the Town5. The Town is divided into Residential, Commercial and Industrial districts, and the maps kept at Town Hall are the final word on a parcel's current zoning3.
In the Residential District, single-household and two-household dwellings need a minimum lot area of 7,500 square feet7. Buildings may occupy the entire lot except for required yard setbacks and parking10. Short-term rentals of single-family homes in the Residential District are a conditional use that needs Planning Board approval first8.
We did not find a minimum dwelling size in the Residential District standards, or an accessory dwelling provision in the ordinance. Ask Town Hall before you design a small home or a second unit.
Do you need a building permit in Whitehall, and who issues it?
Yes. Inside Whitehall town limits, no building or other structure may be erected, moved, added to or structurally altered, and no land use changed, without valid permits1. The Town's own page says a development permit is mandatory before adding any exterior structure, such as a fence or shed11.
The application goes to Town Hall and is reviewed by the Planning Board, which normally meets on the second Monday of each month at 7 p.m.2 A completed packet must reach the office by noon on the Wednesday before the meeting to make that month's agenda2. A variance request can be added to the same application11.
Fees are set by the Town Council, are available in Town offices, and must be paid in full before a permit issues9.
We could not confirm which building code the Town enforces or whether it inspects construction. Montana's state Building Codes Program has jurisdiction wherever a local government has not chosen to enforce a certified code12. Ask Town Hall which applies to your lot.
How do septic permits work inside Whitehall?
Jefferson County Environmental Health, the county sanitarian, issues septic permits in the county4, and a septic application and permit are required before construction13. Montana also requires a drainfield permit from the local health department even when a subdivision approval exists14.
The county's published pages do not say whether this program covers addresses inside Whitehall's town limits, and we could not confirm whether the Town requires its own approval for an on-site system. Call15 before you plan around a septic system on a town lot, and ask Town Hall whether your lot is on town water and sewer.
For soils, USDA rates about 16% of Jefferson County's soils as not limited for a conventional drain field16. That is a county-wide figure and a strict rating, so expect a site evaluation and possibly an engineered system outside the town's mains.
Can you live in an RV or tiny home in Whitehall?
Living in a recreational vehicle or mobile home on a lot inside Whitehall is prohibited outside an approved RV park unless a temporary-use permit is granted through the variance process6. Plan on a Planning Board hearing if you want to stay in an RV while you build.
Parking is different from occupying. Whitehall allows up to two unoccupied recreational vehicles in any district, outside the sight-vision triangle, as long as no living quarters are maintained or business practiced in the vehicle6.
We did not find a separate tiny-home rule or a general temporary-camping rule for private land inside town. A tiny home on a permanent foundation would go through the same development permit and zoning review as any other dwelling1; confirm with Town Hall.
Building a home in Whitehall: the steps, in order
- Confirm the parcel's zoning district on the zoning map at Town Hall3.
- Check lot area and use rules for that district; Residential lots for houses need 7,500 square feet7.
- Ask Town Hall which building code and inspections apply, and ask15 about septic or sewer for the lot.
- Submit the development permit application and plans to Town Hall by noon on the Wednesday before the Planning Board meeting2.
- Pay the fees set by the Town Council; no permit issues until they are paid9.
- Attend the Planning Board meeting, held on the second Monday of the month, and add a variance request if you need one2.
What stays with Jefferson County, and what should you check before you buy?
Septic permits stay with the county sanitarian4. For land outside town limits, the county's zoning, site permits and floodplain permits follow different rules; see the Jefferson County page. The county Planning Department lists floodplain administration among its tasks17, but we could not confirm who handles floodplain permits inside town, so ask Town Hall.
For a private well, Montana's exempt-well exception covers groundwater developments of 35 gallons per minute or less and no more than 10 acre-feet per year, and a Notice of Intent filing fee of $400 applies beginning in 202618. We could not confirm whether the Town restricts private wells.
County-level numbers: the effective property tax rate in Jefferson County is 0.6%19.
Watch-outs
- Septic coverage inside Whitehall town limits is unconfirmed; call Jefferson County Environmental Health and Town Hall before you buy a lot that is not on town sewer4.
- RV occupancy on a town lot needs a temporary-use permit through the variance process, so do not plan to live in an RV on a Whitehall lot while you build6.
- Do not apply Jefferson County's unincorporated-area zoning rules to a Whitehall lot; the Town's own ordinance governs land inside town limits5.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
